Fayetteville, Arkansas Purpose The Mayor reported that the purpose of the meeting was to receive and open bids, Por a proposed new Police Station and to discuss the bids on the proposed new fire stations which had been received at the special session of the Council on April 25, 1963. The Mayor further reported that all members of the Council had been rAtified by U. S. Mail and by telepho: Opening of The bids were opened by the Mayor and read by the Architect Warren Segraves. bids After the bids were tabulated by the architect it was found that the low bid was the one by the Shirley Consttuction Company, Fayetteville, Arkansas, and the total amount df $12023.00 for the Police Station., including the alternate bids and Mr. Segraves recommended that the contract be awarded to the Shirley Construction Company. After a brief discussion Alderman Burgin moved to accept the recommendation of Architect Warren Segraves Shirley and award the contract to the Shirley Construction Company, Fayetteville, Arkansas, for the total sum Construction of $128P23.00 upon the approval of the contract,and payment and Performance bond by the Archtect and Coi awarded City Attorney and evidence of proper insurance and that the Mayor'and City Clerk be and they are hereby Contract authorized to execute the contradt. The motion was seconded by Alderman Short and passed unanimously. Architect Segraves recommended that the contract for the equipment for the Police' Station be awarded to Southern the low bidder which was The Southern Steel Company, San Ant6n1o,Texas for a total sum of $2,363.34. Steel Co. Alerman Burgin moved to accept the recommendation of the Architect and award the contract for the equipmei awarded cont- for the Police Station and City Jail to the Southern Steel Company, San Ant6nio, Texas, for the total sum ract. of $2,863.34 and that the Mayor and City Clerk be and they are hereby authorized to execute the contract upon approval of the Architect and City Attorney of the contract, payment and performancd bond, and evidence of proper insurance. Fayetteville, Arkansas $5,215.00 After a long discussion Alderman Short r moved to award the contract for the Central Fire Station to the Fire Shirley Construction Company of Fayetteville, Arkansas, at their base bid of $145,737.00 and that the Mayor and City Clerk be and they are hereby authorized to execute the contract after the examination t of the contract, payment and performance bond, evidence of proper insurance, and other related documents by the Architect and City Attorney. The motion was seconded by Alderman Burgin and upon roll call the following vote was recorded: "Aye" Christie, Wheeler, Thomas, Burgin, Faucette, and Short. "Nay" Heflin There being six "Ayes" and only one "Nay's the 1',ayor declared the motion passed. 225 WHEREAS, the volume of cases originating within the territorial limits of said Divison and triable in the United States District Court for the Western District of Arkansas has reached such proportions that such facilities are necessary and justified for the use andeonvenience of the citizens of said Division; and . 9-63 (WHEREAS, the old Post Office' Building :located in the center of the square in Fayetteville, Arkansaq, ntinued. has recently been vacated by reason of the opening of a new Post Office Building in said City; and WHEREAS, there are many Federal agencies operating in the City of Fayetteville with offices in various sections and various buildings; and WHEREAS, the removal of the Post office from the business section of the City has resulted in a hardship and inconvenience to the citizens in the main business section of the City; and bidder gave several alternate bids other than the base bids which were WHEREAS, it'has been determined by the agents of the Federal Gevermnent that the old Post Office Building cannot be converted for Federal Court facilities and other Governmental usage. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fayetteville, Arkansas, that this organization requests the appropriate Federal Officials .to consider the old Post Office Building located in the center of the square in Fayetteville, Arkansas, b}.atsbmesotherr..oappf;mpniateulocatibn be;utilizbd foi the sight of a new Federal Building, with said building to includd Federal Court Facilities, and any other Governmental agencies which are deemed appropriate. Johnsen, Chief Judge, United States Court of Appeals for the Eighth Circuit, Omaha 2, Nebraska; Honorable John E. Miller, Judge of the United States District Court of the Western District of Arkansas, Fort Smith, APkansas; Senators J. W. Fulbright; and John L. McClellan; and Congreesman James W. Trimble. There being five "Ayes", no "Nays" and only one"Abstaining", with two Aldermen ahsent, the Mayor declared the motion passed as there was a majority of all the Aldermen voted "Aye". The City Attorney introduced and at the request of the Council read a proposed ordinance in its entirety for the first time entitled,"AN ORDINANCE ACCEPTING THE DEDICATION OF CERTAIN REAL ESTATE FOR STREET PURPOSES IN THE CITY OF FAYETTEVILLE, ARKANSAS". Alderman Burgin moved that the rule be suspended and the Ordinance be placed on a second reading. The motion was seconded by Alderman Wheeler and passed unanimously. The ordinance was then read for the second time. Alderman Burgin moved that the rule be further suspended and the Ordinance be placedon the third and final reading. The motion was seconded by Alderman Faucette and passed unanimously. The Ordinance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion. There being no discussion, the Yayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Heflin, Watson, Wheeler, Thomas, Burgin, and Faucette. ORDINANCE N0, 1349 AN ORDINANCE ACCEPTING THE DEDICATION OF CERTAIN REAL ESTATE FOR STREET PURFOSES IN THE CITY OF ARKANSAS Ord. No. BE IT ORDAINED BY HE CITY.COUNCIL OF THE CITY OF FAYEPTEVILLE, ARKANSAS: 1349 SECTION 1. That the City Council hereby accepts the dedicatioh of the following described property for street purposes, to -wit: Forty (40) feet of equal and uniform width off the North side of a tract described as a part of the Northwest Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of Section 3, Township 16 North, Range 30 and more particularly described as beginning at a point 490 feet and 10 inches East of the Southwest corner of said forty acre tract, and running thence East 224 feet to the West side of U.S. Highway No. (concrete rodd); thence in a Northeasterly direction along the West side of said Highway a distance of 213 feet; thence West 246 feet to the East side of the Old State Highway No. 71; thence in a Southeast direction with East side of Old Highway a distance of 213 feet to the place of beginning. a , Alderman Faucette read a letter from Attorney J. W. Murphy, Chairman of the Civil Service Commiss2on of Fayetteville, Arkansas, in which he stated the Civil Service Commission had recommended that the City ARpointment Council create the position of Assistant Chief of Police, as provided in the Budget for the year of 1963, of As,sistadt and that they had further recommended that City Patrolman Elmo Ritbhiebe appointed to this position. Chief of Alderman Faucette then moved to accept the recommendation of the Civil Service Commission and create the Police s;:c position of Assistant Chief of Police and to appoint Patrolman Elmo _Ritchie to that position. The motion was seconded by Alderman Wheeler and passed unanimously. Absent: None, Alderman Christie reported that -the Street Comriiittee-had recommended the -vacating and abandoning that portion of Edgewood Street lying West of Gregg Avenue and north of Prospect Street, as requested in the petition of F. F. Stice and Charlotte A. Stice, his wife, and Lois M. Cunningham, which was filed in the City Clerk's Office -on the 29th day of March, 1963, and on which said petition a public hearing was held on Monday, April 22, 1963, there being,no opposition to the vacating of said street. The City Clerk presented letters from the three utility companies, VL,Arkansas Western Gas Co., Southwestern Electric Power Co., and the Southwestern Bell Telephone Co. stating they had no opposition to the vacating of said street. The City Attorney then introduced,and at the request of the Council. -read a proposed ordinance in its entirety entitled, "AN ORDINANCE VACATING AND ABANDONING EDGEWOOD STREET LYING WEST OF GREGG AVENUE AND NORTH OF PROSPECT STREET, IN THE MITCHELL ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS"* Alderman Thomas moved that the ordinance pass. CRDINANCE N0. 1350 AN ORDINANCE VACATING AND ABANDONING EDGEVIOOD STREET LYING 19F,ST OF GREGG AVENUE AND NORTH OF PROSPECT STREET, IN THE MITCHELL ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS WHEREAS, a petition was duly filed with the City Council of the City of Fayetteville, Arkansas, on the 29th day of March, 1963, by Lois M. Cunningham, F. F. Stice and Charlotte A. Stice, husband and wife, asking the City Council to vacate and abandon all of the street designateW as follows: All of Edgewood Street lying West of Gregg Avenue and North of Prospect Street, said street being situated in the,Michell Addition of the City of Fayetteville, Arkansas, and WHEREAS, after due notice as required by law, the council has, at the'time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street, hereinbefore described, has heretofore been dedicated to the public use as a street; has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the property abutting upon the street to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street. NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vacgtes, and abandons all its rights, together with the rights of the public generally, In and to Edgewood Street lying West of Gregg Avenue and North of Prospect Street in the Mitchell Addition to.the City of'Fayetteville, Arkansas, reserving unto said City of Fayetteville, Arkansas, its successors and assigns, an easement or right-of-way on, over, under and across the South Twenty feet of said street hereby vacated for the purpose of constructi installing, laying, and relaying, relocating and maintaining all public utilities now located, or which may hereafter be located, upon said vacated street by said'City or any corporation having a franchise or right-of-way from said City, without recourse by the owner, owners, or occupants for damages incurred by the construction or maintenance of said utilities. SECTION 2. A co}7y of the Ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of the County and recorded in the Deed Records of the County. SECTION 3.
