Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney Bass Trumbo, City Engineer W. C. Smith, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and Alderman Laverne Heflin, Ardold Chrstie, Edmound Watson, Garland Wheeler, Grover Thomas, Ellis Burgin, George Faucette, and Carter Short. Absent : None. The minutes of the regular meeting on Monday, March 25, 1963, a copy of which had been previously mailed to each of the Alderman, were approved as written. The City Clerk presented the petition signed by 135 legal voters of the City of Fayetteville, Arkansas, tion calling for a Referendum vote on the repeal of Crdinance No. 1341 of the City of Fayetteville Ordinances passed and approved March 11, 1963. ndum After a long discussion the City Attorney introduced and at the request of the Council read a proposed ordianance in its entirety entitled "AN ORDINANCE, REPEALING ZONING ORDINANCE NO. 1341".' Alderman Thomas moved that the Ordinance pass. The motion was seconded by Alderman Faucette and upon roll call the following vote was recorded: "Aye" Heflin, Watson, Wheeler, Thomas, and Faucette. "Nay" Christie, Burgin, and Short. .The Clerk reported there were five "Ayes" and three "Nays" hence, the Ordinance failed to pass for the lack of a unanimous vote which is required to pass an ordinance on one reading. Alderman Thomas then moved that the rule be suspended and the ordinance be placed on.its second reading. The motion was seconded by Alderman Short and upon roll call the following vote was recorded: "Aye" Heflin, Watson, Wheeler, Thomas, and Faucette, and Short. "Nay" Christie and Burgin. There being six '!Ayes" and two "Nays", the Mayor declared the rule suspended and the ordinance placed on the second reading. The Ordinance was then read for the second time. Alderman Thomas moved that the rule be further suspended and the ordinance placed on the thud and final reading. The motiolwas seconded by Alderman Heflin and upon roll call the following vote was recorded: "Aye" Heflin, Watson, Wheeler, Thomas, Burgin, Faucette, and Short. "Nay" Christie.. There being seven "Ayes" and only one "Nay" the Mayor declared the rule further suspended and the ordinance placed on the third and final reading. The ordinance was then read for thetthird and last time. The Mayor then declared the ordinance open for discussion. There being no further discussion the Mayor asked the question, "Shall the ordinance pass?" Upon roll call the following vote was recorded "Aye" Heflin, Watson, Wheeler, Thomas, Burgin, Faucette, and Short. "Nay" Christie. There being seven "Ayes" and only one "Nay" the Mayor declared the ordinance passed. That all ordinances or parts of ordinances in conflict herewith are hereby repealed, and this ordinance shall be in full force and effect from and after its passage, approval and publication. ORDINANCE N0, 1345 AN ORDINANCE AMENDING ZONING ORDINANCE N0. 1239 AND REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ARKANSAS, APPROVED MAY 280 1962, TO RE7ONE CERTAIN REAL ESTATE FROM R-4 MULTI -FAMILY RESIDENTIAL AND DORMITORY DISTRICT TO C-3 CENTRAL COMMERCIAL DISTRICT. WHEREAS, a public hearing was held before the Planning Commission of the. City of Fayetteville, Arkansas, on April 2, 1963, on the petition of J. W. Barron, Jr., acting in behalf of C. V. and Pearl R. Alderman Short moved to accept the contract and that the Mayor and City Clerk be and they are hereby authroized to execute the sub -dividers contract with Mr. L. G. Burrell. The motion was seconded by Alderman Thomas and passed unanimously. The City Attorney introduced and at the request of the Copncil read a proposed ordinance in its entirety entitled, !'AN ORDINANCE ACCEPTING THE DEDICATION OF CERTAIN REAL ESTATE FOR STREET PURPOSES IN THE CITY OF FAYETTEVILLE, ARKANSAS". Alderman Short moved that the ordinance pass. The motion was seconded by Alderman Christie and passed unanimously, whereupon the Mayor declared the Ordinance passed. ORDINANCE N0. 1346 AN ORDINANCE ACCEPTING THE DEDICATION OF CERTAIN REAL ESTATE FOR STREET PURPOSES IN THE CITY OF FAYETTEVILLE, ARKANSAS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, Section 1. That the City Council hereby accepts the dedication of the following described property for street purposes, to -wit: A strip of land for street or road purposes located in the Southwest Quarter of the Southeast Quarter of Section 26, Township 17 North, Range 30 West, described as: Beginning 490 feet North of the Southwest corner of said 40 -acre tract, thence North 50 feet, thence East 482.5 feet to the West side of a 40 -foot I , road thence South along the West side of said road 50 feet to an existing fence line, thence West along said fence 482.5 feet to the point of beginning. General Contractors $4113.00 Alderman Wheeler further reported that the Water and Sewer Comittee had recommended that the contract be awarded to the low bidder which was the Tune Contruction Company for the total sum of $3070.00. Alderman Wheeler moved to accept the reccommendation of the Water and Sewer Committee and award the Contract contract to the Tune Constuction Company for $3070.00. awardedd The motion was seconded by Alderman Thomas and passed unanimously. to low bidder. Alderman Wheeler reported there was some difficulty in securing right-of-way for the sewer main to the corner of Gregg Avenue and Sixth Street and that two local bids had been received for this work for the labor only with the city to furnish all materials. The bids are as follower: Tune Construction Company $1,600.00 C. &. H. General Contractors $2,340.00 Alderman Wheeler stated that the Water and Sewer Committee would try to secure the necessary right- of-way easements, and they recommended that the contract be awarded to the low bidder which was the (tune Construction Company for $1,600.00 providing the Water and Sewer Committee can secure the right- of-way for a reasonable cost. lderman Wheeler then moved to accept the recommendation of the Water and Sewer Committee and award the contract as recommended. The motion was seconded by Alderman Christie and passed unanimously. General Funds Alderman Short reported that the Aduit Report/for the City for the year 1962 had been completed and he moved that the report be accepted and filed and that the Management letter be held for further study Audit Report by the Finance Committee. The motion was seconded by Alderman Burgin but before a vote was taken Accepted and) Alderman Thomas moved to amend the motion to the extent that the Management letter be made a part Filed hof the Audit Report and filed. This motion was seconded by Alderman Watson and passed unanimously whereas it became a part of the original motion. The motion as amended was then passed unanimously by the Council. 7-63 Alderman Faucette reported that several meetings had been held by the Police and Fire Committee in regard to the purchase of property for a fire station to be located in the North part of the City and that they have reo(commended the purchase of -three lots from Jerry Simpson for the sum of $5,500.00. Alderman Faucette then moved to accept the recommendation of the Police and Fire Committee and purchase three lots from Jerry Simpson located in the North part of the City for the sum of $5,500.00. The motion was seconded by Alderman Short and passed unanimously. The Mayor reported that the term of J. F. Robinson (Board of Adjustment) and of Warren Segraves (Board of Appeals) had expired January 1, 1963 and he recommended they be repointed for five year terms as of January 1, 1963, Alderman Burgin moved to accept the recommendation of the Mayor and make the appointments as recommended The motion was seconded by Alderman Wheeler and passed unanimously. John Lewis representing Rauscher Pierce Company (Bonding Firm) reported that the resolution 6-63, due to some legal techinicalit*es, be amended. He then read the proposed resolution as amended. The Mayor stated that consideration should be directed by the Council to the question of the passage and adoption of a resolution to provide for refunding the outstanding Waterworks and Sewer Refunding and Construction Revenue Bonds of the City. After discussion by the Council, Alderman Ellis Burgin introduced in writing a resolution entitled, "A RESOLUTION PROVIDING FOR THE'REFUNDING OF THE OUTSTANDING WATERWORKS AND SEWER REFUNDING AND CONSTRUC REVENUE BONDS OF THE CITY OF FAYETTEVILLE, ARKANSAS; FOR THE ISSUANCE OF WATERWORKS AND SEWER REVENUE REFUNDING BONDS THEREFOR; REPEALING RESOLUTION N0, 6-63 OF THE RESOLUTIONS OF THE CITY OF FAYETTEVILLE, ADOPTED MARCH 14, 1963; DECLARING AN EMERGENCY: AND FOR OTHER PURPOSES", Whidh resolutionsthe City Clerk read in t)111 0 Alderman Ellis Burgin then moved that the rule requiring an ordinance or resolution to be read in full on three different days be suspended and that said resolution be placed on its second reading, which motion was seconded by Alderman Carter Short. Thereafter, the Mayor put the question on the adoption of said motion, and the roll being called, the following voted: "Aye", Laverne Heflin, Arnold Christie, Edmond Watson, Garland Wheeler, Grover Thomas, Ellis Burgin, George Faucette, Carter Short. "Nay", none. Whereupon, the Mayor declared that at least two-thirds of all members elected to the Council having voted in favor of the motion to suspend the rules, the motion was carried and the rules suspended. The resolution was then read by the City Clerk. Thereupon, Alderman Carter Short seconded by Alderman Grover Thomas, moved that the rule requiring an ordinance or resolution to be read on three different days he further suspended. The question was put by the Mayor and on roll call by the City Clerk, the following voted: "Aye" Laverne Heflin, Arnold Ch Edmond Watson, Garland Wheeler, Grover Thomas, Ellis Burgin, George Faucette, and Carter Short. "Nay" none. The Mayor declared that at least two-thirds of all members elected to the Council having voted in favor of the motion to suspend the rules, the motion was carried and the rules were further suspended. The Mayor then requested the City Clerk to read the Resolution in full, which was done. Alderman Carter Short, seconded by Alderman Edmond Watson, then moved that the final section, the emergency clause, be adopted, and on roll call by the City Clerk the following voted: "Aye" Laverne Heflin, Arnold Christie, Edmond Watson, Garland Wheeler, Grover Thomas, Ellis Burgin, George Faucette, and Carter Short. . "Nay" none. The Mayor, thereupon, declared that at least two-thirds of all members elected to the Council having voted in favor of the motion, the emergency clause was adopted. The said Resolution, to which no amendments were offered read as follows: RESOLUTION NO. 7-63 A RESOLUTION PROVIDING FOR THE REFUNDING OF THE OUTSTANDING WATERWORKS AND SEWER REFUNDING AND CONSTRUC REVENUE BONDS OF THE CITY OF FAYEPTEVILLE, ARKANSAS; FOR THE ISSUANCE OF WATERWORKS AND SEWER REVENUE REFUNDING BONDS THEREFOR; REPEALING RESOLUTION NO, 6-63 OF THE RESOLUTIONS OF THE CITY OF FAYETTEVILLE, ADOPTED MARCH 14, 1963; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES (Revolution 7-63 is the same as Resolution 6b63 with the exceptions which are herein stated) On page one paragraph two (Page 211, Book G) in the clause which states "but the City Council finds that the City can refund the said $5,313,000:0011; Should read "and the City Council finds, etc." The date Aprilil and October 1 is changed to June 1 and December 1 where ever occurring in Resolution On page three of Resolution 6-63 (Page 211, Book G) in paragraph four the word 'through' is omitted from the clause "Waterworks and Sewer Refunding and Construction Revenue Bonds as they mature through December 1, 1968 and for payment prior to maturity on Deczmber 1, 1968 together with the costs incide, to securing such refunding." The date 1968 is changed to read 1963.in this clause. , On page nine of the orginial resolution 6-63 page 213 in Book G change the statement in the second paragrpph to read "Notice of the call for the redemption shall be published by the City Clerk of the Ci for one insertion more than thirty (30) days before the date of sucA redemption in a newspaper of general circulation published in the City of Little Rock, Arkansas, and having a general circulation throughout the State of Arkansas, and in a financial journal published in the Borough of Manhattan, esolution City of New York, and after the date mentioned in said call, the bond or bonds so called will cease to o. 7-63 bear interest; provid&.; funds for their payment are on deposit at that time." Cont. On page 27 of 6-63 Section 22 page 217 in Book G paragraph two sub -paragraph two (2) is changed to read; in part, as follows: (2) The proceeds from the sale of the said bonds in the amount of $5,313,000.00 shall be deposited in a separate escrow account hereby created and designated as "City of Fayetteville, Arkansas Waterworks and Sewer Refunding and Construct�''o/pn_ Reven_y¢ oyds Refunding Fund" (herein sometimes designated as the "Refunding Fund") with K 0 Flte04C wiU, in Dallas, Texas, (herein sometimes designated_as the "Escrow Agent"), togeth r with' interest to be derived from the investment of the deposits or any part thereof, to pay the reasonable charges of the Escrow Agent in connection therewith, and to pay the principal of and interest on the outstanding Waterworks and Sewer Refunding and Construction Revenue Bonds of the City dated May 1, 1958, to be refunded, paid and discharged as the same become due, to the respective maturities of the said bonds or to their prior redemption on December 1, 1963." Section 25 page 217 in Book G is hereby changed to read as follows: "That Resolution No. 6-63 of the Resolutions of the City of Fayetteville adopted on the 14th day of March, 1963, is hereby repealed, and all other ordinlnces or resolutions or parts thereof in conflict herewith are hereby repealed to the extent of such conflict." APPROVED: �Z MAYO ATTEST: (SEAL)' Mr. John Lewis reported that since the Resolution 6-63 had been amended by Resolution 7-63 it would be necessary to execute a new contract with Rauscher, Pierce, and Company to include the amended changes. Alderman Burgin moved to accept the contract with Rauscher, Pierce and Company as amended and that the Mayor and City Clerk be and they are hereby authorized to execute the amended contract. .� The motion was seconded by Alderman Faucette and passed unanimously. The City Attorney presented a petition which had been filed with the City Clerk on the 29th of March 1963 to vaccate Edgewood Street in the City of Fayetteville, Arkansas. He read a proposed resolution for a public hearing on this petition. Alderman ghditn moved that the resolution be adopted. The motion was seconded by Alderman Faucette and passed unanimously, whereupon the Mayor declared the Resolution adopted. RESOLUTION N0, 8-63 WHEREAS, it appears that a petition to abandon and vacate Edgewood Street, was duly filed by F. F. Stice and Charlotte A. Stice Lois Cuhnin ham and W. W.Bassett Jr. with the City Clerk of the City of Resolution Fayetteville, Arkansas, on the 29th day of March, 19 3; and No. 8-63 WHEREAS, it appears that this is the next regular meeting of the City Council following the filing of. said petition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, TO -WIT: SECTION 1. That the 22nd day of April, 1963, at 7:30 o'clock P.M.; in the Council Room of the 6ity Adminsitration Building, be and the same is hereby fixed as the time and place* for the hearing upon said petition. SECTION 2. That the City Clerk of the City of Fayetteville, Arkansas, be and he is hereby directed to give notice of such hearing to all interested persons by publication thereof once a week for two (2) iA consecutive weeks in the Northwest Arkansas Timeg a newspaper published in Washington County, Arkansas, and having a general circulation in the City of Fayetteville, Arkansas.
