(1) That $3,420.32 be transferred from the General Fund to the Public Works Fund.

(2) That the $252000.00 interdepartmental.loan from the General Fund to the Public Works Fund be
eliminated.
This action will reduce the Unappropriated Surplus in the General Fund from $61,925.96 to $33,112.94,
and will also eliminate the deficit in the Public Works Fund.
Alderman Short moved to accept the recommendation of the Finance Committee and take the action as outline
above.
The motion was seconded by Alderman Faucette and passed unanimously.
The Mayor reported that the Police & Fire Committee, Fire Chief Burl Skelton, and the Mayor had studied
e several locations for the new Central Fire Station and that some property located at the Southwest corner
of the intersection of Locust Avenue and Center Street could be purchased for $36,000.00 which was
suitable for the station both in size and location.
The Mayor and Fire Chief recommended this site be purchased for the above amount.
After a very long discussion, the City Attorney read a proposed resolution authorizing the purchase of
this property.
Alderman Short moved that the Resolutiop be adopted. The motion was seconded by Alderman Burgin and upon
roll call the following vote was recorded: "Aye" Heflin, Christie, Wheeler, Burgin, and Short.

There being five "Ayes" and only two "Nays", the Mayor declared the Resolution adopted.

BE IT RESOLVED BY THE CITY COUNCIL OF FAYETTEVILLE, ARKANSAS, TO -WIT:
That the Mayor and City Clerk are hereby authorized to take all actions necessary for the purchase
quisition of a tract of real estate located on the Southwest corner of Locust and Center Street,
yetteville, Arkansas, from the present owners, for a total purchase price of $36,000.00, as a building
to for the new Central Fire Station,

The minutes of the regular meeting on Monday, January 28, 1963, a copy of which had been previously
mailed to each of the alderman, were approved as written.
The mayor reported that he was in receipt of a letter from Alderman Earnest Standllresigning from
the Council effective as of this date.
Alderman Wheeler then moved that the council elect Mr. Edmond P. Watson as a member of the Council
from Ward 2 to the vacancy of Earnest Standley and accept his resignation.
The motion was seconded by Alderman Burgin and passed uninimously.
Justice of Peace, George Caudle, was present and administered the Oath of Office to Mr. Watson.
Mr. Watson then took his seat with the other member of council as an Alderman from Ward 2.

The City Clerk read a resolution from the Planning Commission which was spread of record in the
minutes of this Council and reads as follows:
RESOLUTION PC 2-63
WHEREAS, on February 5, 1963, at the regular annual meeting of the Planning Commission action was
taken.on F. F. Nonnamaker's Subdivision problem which was referred•back to the Planning Commission;
and
WHEREAS, a resolution from the City Council requesting the Planning Commission's.recommendation
of the vacating of an alley in Block 1 of Putman's Addition was on the agenda of -the above-mentioned
meeting.

2-63 NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That it be made known the Planning Commission recommended that Mr. Nonnamaker file a
sub -division plat of the entire area involved, particularly because of the problem of future
development of his property, so that the Planning Commission can more intelligently consider the
problem.
SECTION'2. That due to the lack of time the Planning Commission did not make any recommendation on
the vacating of an alley in Block 1 of Putman's Addition.

After a long discussion Alderman B$rg4n moved to accept the recommendation of the Planning Commission
in regard to Mr. Nonnamaker's request as set out in the resolution PC 2-63.
The motion was seconded by Alderman Short but before a vote was taken Mr. Nonnamaker agreed to
work out a solution to his problem with the City Building Inspector. Alderman Burgin with the
approval of Alderman.Short then withdrew his motion.
The Bulding Inspector presented a final plat which was a replat of a part of 'Hammond Addition
to the'City of Fayetteville, Arkansas'. The Building Inspector reported that the Planning Commission
had recommended the acceptance of the plat. The City Attorney reported that before the Ordinance
was.passed it would be necessary to hold a public hearing to vaobate or move a street in this addition.
The City Attorney then read a proposed resolution setting forth the date, time, place, and purpose
of the Public Hearing to vaccite said street.

4-63 Be it resolved by the City Council of the City of Fayetteville. Arkansas; that whereas, at a regular
meeting of the City Council of the City of Fayetteville, Arkansas, a Petition was presented to
said Council for the vacating and abandoning of a street which is described as follows: Roselawn
Street which lies in Hammond's'Addition to the City of Fayetteville which is bounded to -the North
by Holly Street, on the East by Woolsey Street, on the West by Shady Street.
That the above -'stated Petition was presented to the Planning Commission of the City of Fayetteville,
Arkansas, and that said Petition was approved by the Planning Commission; that the 25 th day *f
February, 1963, is the date set for the hearing of this Petition and that the City Clerk is hereby

WHEREAS, a petition was duly filed with the City Council of the City of Fayetteville, Arkansas, on the
11th day of February, 1963, asking the City Council to vacate and abandon all that portion of the street
designated as follows: Roselawn Street lying in Hammond's Addition to the City of Fayetteville, Arkansa
which is bounded to the North by Holly Street, on the East by Woolsey Street, and on the West by Shady
Street.
WHEREAS, after due notices as required by law, the City Council has, at the time and place mentioned in
the notice, heard all persons desiring to be heard on the question and has ascertined that the portion"
of the street hereinabove described has heretofore been dedicated to the public use as a street; has not
been actually used by the public generally for a period of at least five (5) years subsequent to the
filing of the plat; that all of the owners of the property abutting on the portion of said street
sought to be vacated have filed with the City Council their.written consent to said abandonment; and
that public interest and welfare will not be adversely affected by the abandonment of said street.
NOW THEREFORE,-BETIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTFVILLE, ARKANSAS:
SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vacates, and abandons all its rights,
together with the rights of the public generally, in.and to the street goesignated as follows:

unto said City of Fayetteville, Arkansas, its successors and assigns, an easement or right-of-way on,
over, under and.across the said street hereby va4&ed for the purpose of constructing, installing, layiz
and reiaying,, relocating and maintaining all public utilities now locatdd, or which may hereafter be
located, upon said vacated street by said City or any corporation having a franchise or right-of-way
from said City, without redourse by the owner, owners, or occupants for damages incurred by the
construction or maintenance of said utilities.
SECTION 2. A copy of the Ordinance dulyrrcertifie.d by the City Clerk shall be filed in the office of
the Recordee of the County and recorded in the Deed Records of the County.
SECTION 3. This Ordinance shall'be in force and effect from and after its passage, approval, and
publication.

that public interest and welfare will not be adversely affected by the abandonment of said street.
NOW THEREFORE,-BETIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTFVILLE, ARKANSAS:
SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vacates, and abandons all its rights,
together with the rights of the public generally, in.and to the street goesignated as follows:
Roselawn Street lying in Hammond's Addition to the City of Fayetteville, Arkansas, which is bounded to
the North by Holly:Street, on t:e East by Woolsey Street, and on the West by Shady Street, reserving
unto said City of Fayetteville, Arkansas, its successors and assigns, an easement or right-of-way on,
over, under and.across the said street hereby va4&ed for the purpose of constructing, installing, layiz
and reiaying,, relocating and maintaining all public utilities now locatdd, or which may hereafter be
located, upon said vacated street by said City or any corporation having a franchise or right-of-way
from said City, without redourse by the owner, owners, or occupants for damages incurred by the
construction or maintenance of said utilities.
SECTION 2. A copy of the Ordinance dulyrrcertifie.d by the City Clerk shall be filed in the office of
the Recordee of the County and recorded in the Deed Records of the County.
SECTION 3. This Ordinance shall'be in force and effect from and after its passage, approval, and
publication.
