The City Attorney introduced and,at the request of the Council, read a proposed ordinance in its entir dinance entitled, "AN ORDINANCE VACATING AND ABANDONING A PORTION OF GREGG STREET LYING BETWEEN HIGHWAY 62 AND b. ST. LOUIS -SAN FRANCISCO SPUR, FAYETTEVILLE, ARKANSAS". 1313 Alderman Burgin moved that the ordinance pass. The motion was seconded by Alderman Wheeler and passed unanimously, whereupon the Mayor declared the Ordinance passed. Alderman Short then moved that the emergency clause be adopted. The motion was seconded by Alderman Bu and passed unanimously, whereupon the Mayor declared the emergency clause adopted. ORDINANCE NO. 1313 ORDINANCE VACATING AND ABANDONING A PORTION OF GREGG STREET LYING BETWEEN HIGIWAY 62 AND THE ST. LOUI FRANCISCO SPUR, FAYETTEVILLE) ARKANSAS. WHEREAS, a petition was duly filed with the City Council of the City of Fayetteville, Arkansas, on d day of July, 1962, asking the City Council to vacate and abandon all that portion of the street des ed as follows: A portion of Gregg Street lying between Blocks Twenty-one (21) and Twenty-three (23) guson's Addition to the City of Fayetteville, "rkansas, lying South of the South right-of-way line of hway 62 and North of the North right-of-way line of the St. Louis -San Francisco Spur, and WHEREAS, after due notices as required by law, the council has, at the time and place mentioned in t ice, heard all persons desiring to be heard on the question and has ascertained that the street or the tion thereof, hereinbefore described, has heretofore been dedicated to the public use as a street here cribed; has not been actually used by the public generally for a period of at least five years subsequ the filing of the plat; that all the owners of the property abutting upon the portion of the street to ated have filed with the Council their written consent to such abandonment; and that public interest a .fare will not be adversely affected by the abandonment of such street. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vacates, and abandons all its rights, her with the rights of the public generally, in and to the street designated as follows: A portion of Street lying between Blocks Twenty-one (21) and Twenty-three (23) of Ferguson's Addition to the City yetteville, Arkansas, lying South of the South right-of-way line of Highway 62 and North of the NortY -of-way of the St. Louis -San Francisco Spur. SECTION 2. A copy of the Ordinance duly certified by the City Clerk shall be filed in the Office of Recorder of the County and recorded in the Deed Records of the County. SECTION 3. That because the passage of this Ordinance is necessary for the preservation of the pub h, peace, and safety, an emergency is hereby declared to exist and this Ordinance shall be in full and effect from and after its passage, approval, and publication. Budd, dow of Jack Budd, and Carol Rose Budd and Jack Austin Budd, surviving heirs of Jack Budd. lderman Short moved to accept the two deeds and to authorize the City Clerk to cause same to be recorded in the Circuit Clerk's Office of Washington County, Arkansas, with the Deed Records of the County. The motion was seconded by Alderman Wheeler and passed unanimously.
