Smith, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and rmen: Heflin, Christie, Wheeler, Thomas, Faucette, and Short. nt: Alderman Burgin, minutes of the regular meeting on Monday, July 9, 1962, a copy of which had premioosly been mailed to of the Aldermen, were approved as written. �he City Attorney presented a petition requesting that the City vacate and abandon a portion of Gregg vacate venue (which had never been opened for traffic) and which had been signed by several property owners Gregg of adjoining property. he City Attorney stated that, since the City owned some property involved in the closing of the street., he Council should authorize the Mayor to sign the petition. Alderman Short moved that the Mayor be and he is hereby authorized to sign the petition to vacate and abandon a portion of Gregg Avenue where the City Shop is no located. �fhe motion was seconded by Alderman Thomas and passed unanimously. The Mayor signed the petition in the presence of the Council) to.(Phe City Attorney then read a proposed resolution setting forth the date, time, and place of a public dac, hearing on the petition to vacate and abandon a portion of Gregg Avenue where the City Shop Building is ublic now located, vacate blderman Short moved that the resolution be adopted. The motion was seconded by Alderman Faucette and passed unanimously, whereupon the Mayor declared the Resolution adopted. RESOLUTION 14-62 BE IT RESOLVED BY -THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: THAT, whereas, at a regular meeting of the City Council of the City of Fayetteville, Arkansas, a ition was presented to said City Council for the vacating and abandoning of a street which is desc follows: A portion of Gregg Street lying between Blocks Twenty-one and Twenty-three (23) of Ferguson's Additic to the City of Fayetteville, Arkansas, lying South of the South Right-of-way line of Highway No. 62 and North of the North Right-of-way line of the St. Louis -San Francisco Spur. That the above -stated petition was presented to the Planning Commission of the City of Fayetteville, isas, and that said petition was approved by the Planning Commission. That the 13th day of August, 1962, is the date set for the hearing of this petition and that the ty Clerk is hereby directed to give notice of such meeting by publication once a week for two consecutiv eks in the Northwest Arkansas Times, a newspaper having a general circulation in Fayetteville, Arkansas. WHEREAS, a public hearing was held before the Planning Commission of the City of Fayetteville, kansas, on June 26, 1962, on the petition of G. C. BROWN, Alderman Short reported that the Finance Committee, after careful consideration and being fully aware of the contribution that the Boys' Club is making toward year around youth activities at the Youth Center, recommends that the total sum of $1,JDO.00 be given to tie Youth Center Board for operation of the progr for the fiscal year of 1962. The amount of $800.00 will be given on August 1, 1962, representing $100.00 per month retroactive from January 1, 1962, and that the remainder be given at the rate of $100.00 on the first of each succeeding month during the year of 1962. The Finance Committee further recommends that the Park and Recreation 03mmittee study the needs of the Youth Center and be prepared to recommend for next year (1963) budget: 1. The necessity for the City's continued participation. 2. The amount required. 3. The number of years for such participation. Alderman Short then moved to accept the recommendation of the Finance Committee as outlined above in its entirety. The motion was seconded by Alderman Faucette and passed unanimously. Alderman Short further reported that the Finance Committee made recommendations as follows: 1. That the fiscal year of the Water & Sewer Department be changed from January 1 -December 31, to :e August 1- July 31. This is desirable for the following reasons: A. The two basic funds of the City,viz. Water & Sewer Fund and General Fund, are already separated they should and must be because of bond requirements in Water & Sewer. B. The auditing and budgeting loads of the Administration and the Council can be spread over a period of time. 2. That an audit as of July 31, 1962; for the Water & Sewer Department be ordered at the present with the subsequent audit covering the annual period from August l to duly 31. 3. That the Water & Sewer Audit be awarded to Myers, Scarbrough & Baker and that the General Audit awarded to Douglas Walker & Associates. Alderman Short then moved to accept the above outlined recommendations of the Finance Committee in its entirety. The motion was seconded by Alderman Wheeler and passed unanimously. Alderman Short then introduced and read in its entirety a proposed ordinance entitled, "AN ORDINANCE AMENDING ORDINANCE N0. 1166, PASSED AND APPROVED APRIL 18, 19582 AND FOR OTHER PURPOSES". Alderman Short moved that the rules be suspended and the ordinance placed on the second reading. The motion was seconded by Alderman Heflin and passed unanimously. The ordinance was then read for the second time. Alderman Short then moved that the rules be further suspended and the ordinance placed on the third and final reading. The motion was seconded by Alderman Heflin and passed unanimously. The ordinance was then read for the third and last time. The Mayor then declared the ordinanceopen for discussion. There being no discussion, the Mayor asked the tjuestion, "Shall the Ordinance pass?" Upon roll call the following vote was recorded, "Aye" Heflin, Christie, Wheeler, Thomas, Faucette, and Short. ORDINANCE N0, 1310 N ORDINANCE AMENDING ORDINANCE N0. 1.1661 PASSED AND APPROVED APRIL 18, 1958, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That Section 16 of Ordinance No. 1166, passed and approved April 18, 1958, be and the same is hereby amended to read as follows: "That the system shall be operated on a fiscal year basis beginning he first day of August (August 1) and ending the thirty-first day of July (July 31)". SECTION 2. That all ordinances and parts of ordinances in conflict with this ordinance are hereby repealed, and this action being necessary for the public health, safety, peace, order, comfort, and ponvenience, within the City of Fayetteville, Arkansas, an emergency is hereby declared to exist,and this rdinance shall be in full force and effect from and after its passage and approval. T. Russell Subdivision'of the'SE� of the NE� of Section seven (7), Township Sixteen (16) North, Range 30 West, together with Valley Drive in said subdivision. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: r , Messrs Roy Scott and Alsey Holland of the Hospital Board appeared before the Council and presented a Fetitign petition signed by nine members of the Hospital Board in which they requested that the City Council enact for Initi tive an ordinance and refer the same to the people of Fayetteville at the General Election on November 6, 1962, Ord. for Ands for whereby money could be obtained for an addition to the City Hospital for a Nursing Home Cor aged. City Hospital After a long discussion, Alderman Christie moved to refer this to the Hospital Committee for study and Addition recommendation at the next regular Council meeting. I rhe motion was seconded by Alderman Short but more discussion followed and Alderman Christie with the Consent of Alderman Short, withdred his motion. Petition referred blderman Christie then moved to refer this to the Hospital, Building, and Finance Committees for study and to Hospital, recommendation at the next regular Council meeting, the report to be made by.the Hospital Committee. D. McAllister, Jr., acted as City Attorney. The minutes of the regular meeting on Monday, July 23, 1962, a copy of which had previously been mailed tc each of the Aldermen, were approved as written. Appoint The Mayor reported that he had received a letter of resignation from Alderman Ralph Goff who had moved Ernest Standley from Ward Two and could not legally serve as Alderman from that Ward. Alderman The Mayor further reported that it was the duty of the Council, only, to appoint an Alderman to the vacancy. Alderman Wheeler moved that Mr. Ernest Standley (Ward 2) be appointed to fill the vacancy to the unexpired " term of Ralph Goff whose term ends December 31, 1963, andto accept the resignation of Ralph Goff, as Alderman Ward 2. The motion was seconded by Alderman Heflin and passed unanimously. Oath of Office was then administered to Mr. Standley by Municipal Judge V. J. Ptak and Mr. Standley took his seat with the Council.
