The City Council of Fayetteville, Arkansas, met in regular session on Monday, June 25, 1962, at 7:30 P.
Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney
Bass Trumbo, City Engineer W. C. Smith, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and
Aldermen: Heflin, Christie, Wheeler, Thomas, Burgin, Faucette, and Short.
Absent: None,
The minutes of the regular meeting on Monday, June 11, 1962, a copy of which had previously been mailed
to each of the Aldermen,were approved as written. '
The Building Inspector presented the final plat for a subdivision to be known as`the Stubblefield Addit:
to the City of Fayetteville, Arkansas.
After a long discussion, Alderman Burgin introduced a proposed ordinance which was read in its entirety
by the City Attorney for the first time entitled, "AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF
STREETS, ALLEYS, AND EASEMENTS IN STUBBLEFIELD ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS".
No further action was taken at this time and the ordinance was left on the first reading.
The City Building Inspector reported that he had been receiving requests for Permits to move buildings 6ri
the City and that the Building Code as adopted in our Building Code Ordinance No. 1120, passed and approv
December 17, 1956, required a bond and that a joRMV hearing be held but the Ordinance was not clear as t
the amount of the bomd or who was to conduct the hearing.
He requested that the Council take some action to clear that clause in the Building Code Ordinance.
After a long discussion, Alderman Short moved that the Building Inspector be and he is hereby authorized
and directed to enforce Section 102.12 of the National Building Code as adopted by the City in Ordinance
No. 1120, Passed and Approved December 17, 1956, by giving the adjacent property owners due notice of the
intention to move the building to the proposed location and an opportunity to be heard, if they so desire
also to set the amount of indemnity bond required'by the Ordinance of the owner of the building to be
moved upon the City Streets and to be relocated inside the corporate limits of the City of Fayetteville,
Arkansas.
The motion was seconded by Alderman Faucette and upon roll call the following vote was recorded, "Aye"
Heflin, Wheeler, Thomas, Faucette, and Short. "Nay" Christie and Burgin.
There being five "Ayes" and only two "Nays", the Mayor declared the motion passed.
Attorney A. D. McAllister, Jr. and several citizens from the Elkins Area appeared before the Council in
regard to the formation of a Suburban Water District along Arkansas State Highway No. 16 from the City
of Fayetteville to Elkins.
After a long discussion, Alderman Burgin moved that the Mayor and City Clerk be and they are hereby
authorized and directed to sign in behalf of the City of Fayetteville, Arkansas, a petition to be filed
in the office of the County Clerk of Washington County, Arkansas, for the formation of a Suburban Water
Improvement District in the area along Arkansas State Highway No. 16 from Fayetteville, Arkansas, to
Elkins, Arkansas.
The motion was seconded by Alderman Wheeler and passed unanimously.
The City Attorney reported that, in order to col#plete the sale of the City Shop property, it would be
necessary to vacate and abandon an alley extending across the property.
After a brief discussion, Alderman Burgin moved that the Mayor be authorized to execute a petition to
vacate and abandon the alley extending across the City Shop property.
The motion was seconded by Alderman Short and passed unanimously.
The Uity Attorney then read a proposed resolution setting the date, time, place, and purpose of a public
hearing to vacate the alley across the Uity Shop property.
Alderman Thomas moved that the resolution be adopted.
The motion was seconded by Alderman Wheeler and passed unanimously, whereupon the Mayor declared the
Resolution adopted.
RESOLUTION 10-62
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
That whereas at a regular meeting of the City Council of the City of Fayetteville, Arkansas, a peti
was presented to said Council for the vacating of an alley which is described as follows:
A portion of an alley located in Block Twenty -One of Ferguaon's Addition to the City of Fayetteville,
Arkansas, lying between lots Five through Nine on the East and lots Ten through Fourteen on the West,
running from the South line of the Sixth Street Right-of-way to the St. Louis-SanFrancisco Railway
Right-of-way.
That the above stated petition was presented to the Planning Commission of the City of Fayetteville,
Arkansas, and that said petition was approved by the Planning Commission.
That the 9th day of July, 1962, is the date set for the hearing of this petition and that the City
Clerk is hereby directed to give notice of such meeting bypublication once a week for two consecutive
weeks in the Northwest Arkansas Times, a newspaper having general circulation in Fayetteville, Arkansas,

There being no further business, Alderman Heflin moved to adjourn. The motion was seconded by Alderman
Short and passed unanimously, whereupon the Mayor declared the meeting adjourned.
