302 AN ORDINANCE ACCEPTING A REVISED ZONING DISTRICT MAP OF THEFPROPERTY LOCATED WITHIN THE CITY LIMITS OF
�AYETTEVILLE, ARKANSAS.
WHEREAS, since the date of the acceptance of the original zoning district map on June 13, 1960,

Attorney Pete Estes and a large group of citizens appeared before the Council protesting the location of
the Salvation Army Headquarters 'at 501 South College Avenue which was in conflict with the Zoning Ordinanc

A petition was filed with the Building Inspector on February 15, 1962, by a large number of citizens resid
in this area, protesting the location of the Salvation Army at that place, but on May 11, 1962, the Board
Adjustment granted the request of the Salvation Army to operate at that location (501 South College Ave.).
After a very long discudsion, Alderman Heflin moved that the Council go on record as being opposed to the
decision of the Board of Adjustment permitting the Salvation Army to move into a building at 501 South
College Avenue, which is in a Residential Zone.
The motion was seconded by Alderman Christie and upon roll call the following vote was recorded: "Aye"
Heflin, Christie, and Thomas. "Nay" None.
Abstaining and not voting: Wheeler, Burgin, Faucette, and Short.
There being only three "Ayes", no "Nays", with four "Abstaining", the Mayor declared the motion failed to
pass for lack of a majority vote of the entire Council.

The Chief of Police reported that a Two-way radio was needed by the Police Department which could be pur-

chased from Smith's Two-way Radio Co., Ffyetteville, Arkansas, at a cost to the City of $484.50.
After a brief discussion, Alderman Thomas moved to accept the recommendation of the Police Chief and to

authorize the Mayor and Chief of Police to purchase a Two-way radio from the Smith's Two-way Radio Co.
for the sum of $484.50 with no State Sales Tax.
The motion was seconded by Alderman Faucette and passed unanimously.

BREEDING PLACE FOR MOSQUITOES, FLIES AND GERMS HARMFUL TO THE HEALTH OF THE COMMUNITY; PRESCRIBING A
PROCEDURE TO BE FOLLOWED IN SUCH CASES; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES".
Alderman Burgin moved that the rules be suspended and theordinance placed on the third and final reading.
The motion was seconded by Alderman Short and passed unanimously, whereupon the ordinance was read for the
third and last time.
The Mayor then declared the Ordinance open for discussion. There being no, discussion, the Mayor asked the
question, "Shall the Ordinance pass"? Upon roll call the following vote was recorded, "Aye" Heflin,
Christie, Wheeler, Thomas, Burgin, Faucette, and Short. "Nay" None.

WATER OR ANY OTHER UNSANITARY THING, PLACE OR CONDITION WHICH MIGHT BECOME A BREEDING PLACE FOR MOSQUITGES
IFLIES AND GERMS HARMFUL TO THE HEALTH OF THE COMMUNITY; PRESCRIBING A PROCEDURE TO BE FOLLOWED IN SUCH
CASES; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. All property owners within the City of Fayetteville, Arkansas, are hereby required to cut
, grass, remove garbage, rubbish, and other unsanitary and unsightly articles and things from their
rty and to eliminate, fill up, or remove stagnant pools of water or any other unsanitary things,
or condition which might become a breeding place for mosquitoes, flies and germs harmful to the

SECTION 2. If the owner or owners of any lot or other real property within the City of Fayetteville,
er the giving of twenty(20) days notice in writing by the Chief of Police, shall refuse or neglect to
form the duties in connection with his or their property, as specified in Section 1 hereof, the Chief
Police is hereby authorized to enter upon the property and have said weeds, rank grass or other gegeta-
n cut and removed, or eliminate any unsanitary and unsightly condition, and the cost thereof shall be c
rged against said premises and shall constitute a lien thereon.
Ji SECTION 3. In case the owner of any lot or other real property is unknown or his whereabouts is not
known or is a non-resident of this State, then a copy of the written notice hereinabove referred to shall
be posted upon the premises and before any action to enforce such lien shall be had, the City Clerk shall
rtake an affidavit setting out the facts as to unknown address or whereabouts of non-residents, and there-
upon service of publication as now provided for by law against non-resident defendant may be had and an
attorney ad litem shall be appointed to notify the defendant by registered letter addressed to his last
known place of residence, if same can be found.
SECTION 4. The lien herein provided for may be enforced at any time within 18 months after work has
been done by an action in the Chancery Court.
SECTION 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 6. It has been determined that this Ordinance is necessary and is vital to the health, welfar ,
and safety of the public; therefore, an emergency is hereby declared to exist and this Ordinance shall be
an full force and effect from and after its passage and approval,

Exchange of alderman Christie reported that a request had been made by the property owner who wishes to straighten the

West line of said lot 9, which point is twenty-three (23) feet North of the Southwest corner of said
9; and running, thence in a Northeasterly direction to a point which is ten (10) feet East and twelve
(12) feet South of the Northwest corner of said lot 9; thence North seventy-two (72) feet to a point o
the North line of said 10, which point is ten (10) feet East of the Northwest corner of said lot 10;
thence West ten (10) feet to the Northwest corner os said lot 10: thence South ninety-seven (97) feet

After a brief discussion, Alderman Burgin moved that the City Attorney be and he is hereby authorized and
directed to prepare the necessary papers for the transaction to straighten the street Right -Of -Way for
Harmon Avenue and that the Mayor and City Clerk be and they are hereby authorized and directed to execute
