The motion was seconded by Alderman Faucette and passed unanimously. . rhe City Attorney then introduced and at the request of the Council, read a proposed ordinance entitled, �AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL STREETS, ALLEYS, AND EASEMENTS IN PITTMAN'S NORTHWEST SUBDIVISION TO THE CITY OF FAYETTEVILLE,`ARKANSAS". Alderman Burgin moved that the Ordinance be passed. WHEREAS, there has been duly presented to the City Council of the City of Fayetteville, Arkansas, a t dated July 25, 1960, known as Pittman's Northwest Subdivision to the City of Fayetteville, Arkansas, being part of the Southwest Quarter (SK) of the Northeast Quarter (NE�) of Section 8, Township 16, th, Range 30 West of the 5th Principal Meridian, by which the owners of the platted real estate have icated for the public use the streets, alleys, and easements shown upon said plat; and WHEREAS, the City Planning Commission of the City of Fayetteville, Arkansas, has recommended the )tance of said plat. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. WHEREAS, a public hearing was held before the Planning Commission of the City of Fayetteville, Arks, March 30, 1962, on the petition of Mary Bessie Blake and Mr. and Mrs. E. E. The Building Inspector reported that a petition presented to the Planning Commission by Messrs. Tom Report from Feathers and Humphrey Heaster to rezone certain property on west Maple Street for a Multi -family Duplex Planning Comm. had been denied by the Planning Commission, on Feathers- Mr. Heasty appeared before the Council in regard to this petition and explained that he wished to build Heasty petition, a two-family duplex dwelling on the lot in question. After a long discussion, Alderman Thomas moved to adopt a resolution to refer this petition back to the Planning Commission for.study and recommendation as to the construction of a Two-family Duplex residence. The motion was seconded by Alderman Christie and upon roll call the following vote was recorded: "Aye" Heflin, Christie, GoA$, Wheeler, Thomas, Burgin, and Faucette. "Nay" Short, There being seven "Ayes" and only one !Nay", the Mayor declared the resolution adopted. Petition referred RESOLUTION 5-62 back to Planning Commission: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: by resolution. That the petition of Messrs. Tom Feathers and Humphrey Heasty to rezone an area on the corner of Oliver Avenue and Maple.Street, which was denied by the Planning Commission at a public hearing on March 30, 19621 be referred back to the Planning Commission for further study and recommendation with reference to rezoning for a brick -constructed, two-family duplex residence. Franchise The Mayor then declared the Ordinance open for discussion. Ordinance After a long discussion, the Mayor asked the question, "Shall the Ordinance pass"? passed! Upon roll call the following vote was recorded, "Aye" Heflin, Christie, Goff, Wheeler, Thomas,.Burgin, Faucette, and Short. "Nay" None. There being ei,$ht "Ayes" and no "Nays", the Mayor declared the Ordinance passed. ORDINANCE NO.1295, Ordinance No. 1295 AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE N0. 1167, AS AMENDED BY ORDINANCE NO. 1223, AND MORE PARTICULARLY INCREASING THE ANNUAL FRANCHISE TAX OF THE SOUTHWESTERN BELL TELEPHONE COMPANY, AS AMENDED, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SAction 1. That Section 2 of Ordinance fro. 1167, as amended by Ordinance No. 1223, is hereby amended to read as follows, to -wit: "Section 2. That the Southwestern Bell Telephone Company shall pay to the City on or before the lst day of May, 1962, for the period of May 1, 1962, through December 31, 1962, inclusive, and there- after for the period of January 1 through December 31, on or before the 1st day of March, the sum of Seventeen Thousand ($17,000.00) Dollars, with a proportionate reduction in the amount for the p year of 1962, for the reason that this increase in the franchise tax will not become effective until May 1, 1962, and that the previous rate of $0.91 per telephone within the corporate limits of the City of Fayetteville, would apply until this ordinance becomes effective." The motion was seconded by Alderman Burgin and vacate I portion passed unanimously, whereupon the Mayor declared the resolution adopted. of Read Avenue Ito RESOEUTION 6-62 Planning Commission, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the proposed closing and vacating of a portion of Read Avenue be referred to the Planning Commission of the City of Fayetteville, Arkansas, for study and recommendation to the City Council. Harvester Loader -diggers, this being the lowest local bid meeting the specifications, that the tractors be gasoline driven and equipped with all weather -cabs at a net cost to the City of $ 10,865.00 plus 1547.90 for cabs, making a total net cost for two tractor loader -diggers of $11,412.90. Alderman Wheeler moved to accept the recommendation of the Water and Sewer Committee and make the purchase of two tractor loader -diggers (International) from Phillips Motor Co.for a net cost to the City of $11)412.90. Alderman Heflin moved to construct the sewer main as recommended and outlined above. The motion was seconded by Alderman Wheeler and passed unanimously. Alderman Wheeler further reported that the Engineer's cost figures for the portion of the sewer mains t constructed by Carl Ferguson on North 71 Highway lying adjacent to the Veterans' Hospital was $1596.00. Alderman Burgin moved that the City. pay thin amount of the construction costs upon completion and accer by the City Engineer. The motion was; seconded by Alderman Christie and passed unanimously. Alderman Short reported that the Finance Committee had recommended that the City take bids on some surplu property now owned by the City. After a brief discussion, Alderman Goff moved to instruct the Mayor and Finance Committee to prepare and advertise for bids on the surplus property now owned by the City. The motion was seconded by Alderman Heflin and passed unanimously. There being no further business, Alderman Heflin moved to adjourn. RESOLUTION 7-62 WHEREAS, A petition was presented to the City Council of the City of Fayetteville, Arkansas, on . 9, 1962, at its regular meeting to vacate and abandon a street which is described as follows: A portion'n of Read Avenue lying between Rockwood Trail and Southern Avenue, said street being located in the Mountain View Addition to the City of Fayetteville, Arkansas, recorded in Plat 100, Page 392• and, WHEREAS, said petition was presented to the Planning Commission of the City of Fayetteville, :ansas, and that said Planning Commission approved the petition provided utility easements were pr the City of Fayetteville, Arkansas;.
