Davis, City Controller Albert J. Jones, City Attorney Bass Trumbo, City Engineer W. C. Smith, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and Aldermen: Heflin, Christie, Goff, Wheeler, Thomas, Burgin, Faucette, and Short. Absent: None. WHEREAS, a petition was duly filed with tthe City Clerk of the City of Fayetteville, Arkansas, asking the City Council to vacate and close an alley located between Sixth Street and Seventh Street and East of Block 2 of Ferguson's Addition and West of Block 28 of Jennings' Addition to the City of Fayetteville, Arkansas, and WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley hereinabove described has heretofore been dedicated to the public as an alley; that it is necessary and desirable to use a portion of the above-described alley for the purposes of church construction; that the petition above mentioned included the signatures of ten owners of real property in the City of Fayetteville, Arkansas, and that said petition includes a majority of the owners of real property abutti. upon said alley; and that public interest and welfare will not be adversely affected by the vacation and closing of said alley. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. The City of Fayetteville, Arkansas, hereby releases, vacates, and abandons all its right together with the rights of the public generally, in and to the alley located between Sixth Street and Seventh Street and East of Block 2 of Ferguson's Addition and West of Block 28 of Jennings' Addition to the City of Fayetteville, Arkansas, reserving unto said City of Fayetteville, Arkansas, its successors and assigns, an easement or right-of-way on, over, under and across the said alley hereby vacated for the purpose of constructing, installing, laying, and relaying, relocating and maintaining all public utilities now located, or which may hereafter be located, upon said vacated alley by said City or any corporation having a franchise or right-of-way from said City, without recourse by the owner, owners, or occupants for damages incurred by the construction or maintenance of said utilities. Section 2.A copy of this ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of the County and recorded in the Deed Records of the County. Section 3. AVIS, CITY CLERK Resolution The City Attorney introduced and read a proposed resolution to accept and.approve an offer of a Federal 4-62 Grant in the construction of sewage works in the City of Fayetteville, Arkansas. Alderman Heflin moved that the resolution be adopted. The motion was seconded by Alderman Thomas and passed unanimously, whereupon the Mayor declared the Resolution adopted. RESOLUTION 4-62 WHEREAS, the City Council of the City of Fayetteville, Arkansas, has authorized a program of construc ion of sewage works at an estimated cost of $64,071.25, and the United States Government, acting through the Public Health Service, has offered a Federal grant in the amount of $18,471.38, as designated on Part A, Offer and Acceptance, now under consideration by this body. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the City of Fayetteville, Arkansas, that said offer as submitted, together with the terms and conditions thereof, is hereby accepted and approved; and the Mayor is hereby authorized and directed,to sign said Offer,and Acceptance and any other necessary documents required to complete the project on behalf of said City of Fayetteville, Arkansas. BE IT FURTHER RESOLVED, that the City of Fayetteville, Arkansas, has or will procure a fee simple or such other estate or interest in the site of the project, including the necessary easements and rights-of- way, as to assure undisturbed use and possession for the purposes of construction, operation and mainten- ance of the works for the estimated life of the project, and that in the event such title, estate or interest in such site, easements or rights-of-way may in the future be contested, the City of Fayetteville. Arkansas, will defend and maintain its title in such site and hold the United States Government blameless) in such action. The minutes of the regular meeting on Monday, March 12, 1962, a copy of which had previously been mailed to each of the Aldermen were approved as written. The Mayor reported that this was the time,and place set for a public hearing on the petition of the Public Wiggins Memorial Methodist Church to vacate an alley between 6th Street and 7th Street and East of Block hearing to vacate 2 of Ferguson's Addition and West of Block 28 in Jennings Addition to the City of Fayetteville, Arkansas. alley near) The City Attorney reported that the City Clerk had caused a notice of the.public hearing to be published Wiggins Memorial in the Northwest Arkansas Times, a daily newspaper published in Washington County Arkansas, and having a Methodist Church. general circulation in the City of Fayetteville, for once a week for two consecutive weeks prior to the date set for the public hearing, that the City Clerk had caused ancAbstr"actbr'sfCertificate of the owners of record to be attached to the petition prior to the public hearing and that he also had a letter from each of the utility companies stating they had Lo objection to the alley being vacated and abandoned. There being no objection to the vacating of the alley, Alderman Burgin introduced a proposed ordinance which was read in its entirety by the City Attorney entitled, "AN ORDINANCE VACATING AND CLOSING AN ALLEY LOCATED BETWEEN SIXTH STREET AND SEVENTH STREET AND EAST OF BLOCK 2 OF FERGUSON'S ADDITION AND WEST OF BLOCK 28 OF JENNINGS' ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS", Alderman Thomas moved that the ordinance be passed. The motion was seconded by Alderman Wheeler and passe unanimously, whereupon the Mayor declared the Ordinance passed. Martin Machinery Co. was the low bid at $5,358.15, less a trade-in ofthe old compressor of $1633.60 sor, making a net cost to the City of $3,72+.55, and he recommended the purchase of this compressor, e of Alderman Wheeler moved that the recommendationof the City Engineer be accepted and to purchase the air compressor from E. A. Martin Machinery Co. at a net cost of $3,724.55. sor. The motion was seconded by Alderman Short and passed unanimously. A copy of all the bids received on an air compressor was spread of record in the minutes of the Council Report of The City Building Inspector reported that on October 9, 1961, the City Council had requested the City Planning Planning Commission to study the possibility of rezoning the south side of North Street between College Commission Avenue and Woolsey Avenue with reference to Doctors' Offices, and that the Planning Commission had on on rezoning March 13, 1962, at 4:00 o'clock P.M. in the Council Room of the City Administration Building, held a publ North St. hearing, at which .time all persons desiring to be heard, were permitted to voice their opinions about the rezoning of the south side of North Street between College Avenue and Woolsey Avenue. As there was much criticism and many objections, the Planning Commission recommended that this area not b rezoned. No further action was taken. 80 Alderman Burgin read two letters which the Building Inspector had received in reference to the expansion mit for the Tri-State Sales Co. building located in the 300 Block of North Rollston Avenue in the City of Fayett State Alderman Burgin reported that the Special Advisory Committee had met and recommended that the Tri-State: .es Co. Co. be permitted to make the improvements to their building as requested, After a brief discussion, Alderman Burgin moved that the Building Inspector be and he is hereby authoriz to issue a Building Permit to the Tri-State Sales Co., Fayetteville, Arkansas, to make improvements on t building by extending the building to the north property linea. and that the two letters be spread in the minutes asoa permanent record for future reference. No further action was taken and the ordinance was left on the second reading. At the request of the Council, the City Attorney read a proposed ordinance in its entirety entitled, "AN ORDINANCE FIXING THE ANNUAL SALARY OF THE FAYETTEVILLE CITY CLERK", Alderman Short moved that the ordinance pass. The motion was seconded by Alderman Thomas and upon roll ca the following vote was recorded, "Aye" Christie, Goff, Wheeler, Thomas, Burgin, Faucette, and Short. "Nay" None."Abstaining"T Heflin. There being seven "Ayes" and no "Nays" with one abstaining, the motion was overruled because a unanimous' vote was required to passethe ordinance on one reading. Alderman Burgin then moved that the rules be suspended and that the ordinance be placed on the second he motion was seconded by Alderman Goff and upon roll call the following vote was recorded, "Aye" Christ off, Wheeler, Thomas, Burgin, Faucette, and Short. That the annual salary of the Fayetteville.. City Clerk is hereby fixed at Twelve Hundred ($1,200.00) Dollars. Section 2. That the City Clerk shall enter into a bond for the faithful performance of his duties, said bond to be approved by the City Council. Section 3. ORDINANCE N0. 1292 AN ORDINANCE AMENDING ORDINANCE NO. 1207, AND MORE PARTICULARLY FIXING THE ANNUAL SALARY OF THE TRAFFIC CLERK OF THE CITY OF FAYETTEVILLE, ARKANSAS. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: on 1. That Section 8 of Ordinance No. 1207 is hereby amended to read as follows: 118. The Traffic Clerk's annual salary is hereby fixed at Thirty Six Hundred ($3,600.00) Dollars. The Traffic Clerk before entering upon the duties of said office, shall make and file with the City Clerk a good and sufficient bond for the faithful performance of his duties as traffic clerk and as Clerk of the Fayetteville Municipal Court in the sum of $7,500.00, said bond to be approved by the City Council and the premium therefor, if a surety bond be approved, to be charged as an expense of operating said municipal court." That this ordinance shall become effective January 1, 1963. Alderman Burgin moved that the Ordinance be passed. WHEREAS, there has been duly presented to the City Council of the City of Fayetteville, Arkansas, a dated July 25, 1960, known as Pittman's Northwest Subdivision to the City of Fayetteville, Arkansas, being part of the Southwest Quarter (SW4) of the Northeast Quarter (NE�) of Section 8, Township 16: h, Range 30 West of the 5th Principal Meridian, by which the owners of the platted real estate have cated for the public use the streets, alleys, and easements shown upon said plat; and WHEREAS, the City Planning Commission of the City of Fayetteville, Arkansas, has recommended the )tance of said plat. ORDINANCE AMENDING ZONING ORDINANCE N0. 1239 AND ZONING DISTRICT MAP OF FAYETTEVILLE, ARKANSAS, E 13, 1960, TO REZONE CERTAIN REAL ESTATE FROM ZONE R-3 MULTI -FAMILY RESIDENTIAL DISTRICT TO C-2 ROUGHFARE COMMERCIAL,DISTRICT. WHEREAS, a public hearing was held before the Planning Commission of the City of Fayetteville, Arks Mauch 30, 1962, on the petition of Mary Bessie Blake and Mr. and Mrs. E. E. Osburn, Husband and Wife, uesting that said Planning Commission recommend to the City Council of the City of Fayetteville, Arks t said City Council enact an ordinance rezoning the property located on the southwest corner of the ersection of South Street and Church Avenue, known as Lots 1, 2, 3, and 4 of Block 25 of Jenning's Ad the City of Fayetteville, Arkansas, from R-3 Mtlti-Family Residential District to C-2 Thoroughfare mercial District, and WHEREAS, notice of said public hearing, setting forth the date, time, place, purposes of hearing, an ion of property was published in the Northwest Arkansas Times, a newspaper of general circulation in City, more than 15 days prior to said public hearing, and WHEREAS, FOLLOWING said public hearing, said Planning Commission certified to the City Council of tB ty of Fayetteville, Arkansas, its recommendation that an ordinance be adopted rezoning the property cated on the southwest corner of the intersection of South Street and Church Avenue known as Lots 1, 2, d 4 of Block 25 of Jenning's Addition to the City of Fayetteville, Arkansas, from R-3 Multi'=Family sidential District to C-2 Thoroughfare Commercial District. , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: ction 1.
