The minutes of the regular meeting on Monday, January 22, 1962, copies of which had be mailed to all the Aldermen, were approved as written. ORDINANCE N0, 1285 AN ORDINANCE ACCEPTING TERRITORY ANNEXED TO THE CITY OF FAYETTEVILLE, ARKANSAS'; ASS SAID TERRITORY TO WARDS; AND FOR OTHER PURPOSES. WHEREAS,.the County Court of Washington County, Arkansas, did on Fe4ruary 9, 1962, make an Order annexing the following described territory to the City of Fayetteville, Arkansas, to -wit: All of the North z of the Sz of the NW4 of Section 8, Township 16 North, Range 30 West of the 5th Principal Meridian, except that area which is already located within thi City of Fayetteville, Arkansas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVIDLE, ARKANSAS: Section 1. That the Annexation of the above described territory to the Corporate Limits of the City of Fayetteville, Arkansas, be and the same is hereby accepted. Sect1ori'2. There being seven "Ayes" and no 'Nays", the Mayor dedlared the Ordinance passed. Alderman Short moved to accept the recommendation of the Civil Service Commission and to appoint Hollis Spencer as Chief of Police, effective March 1, 19629 at the salary as set up in the Budget for the year of 1962. The motion was seconded by Alderman Heflin and passed unanimously. Resolution Consulting Engineer John Mahaffey appeared before the Council in regard to sewer lines authorizing south of the Cato Springs Road. He explained that it would be necessary for the Council contraclt for to pass a resolution authorizing the execution of construction and engineering contract sewer ines. for the sewer improvements and to make an application in order to receive Federal Aid i the construction of the sewer lines. After a lengthy discussion, the City Attorney read a proposed resolution authorizing th contracts and application as recommended by Engineer Mahaffey, Alderman Wheeler moved that the Resolution be adopted. The motion was seconded by Alderman Heflin and passed unanimously, whereupon the Mayor declared the Resolution adopted. Resolut on RESOLUTION 2-62 2-62 WHEREAS, the City of Fayetteville, Arkansas, desires to execute a contract for out fall and interceptor sewer lines and appurtenances, south of the Cato Springs Road, and WHEREAS, Federal Grant-In-Aid'may be obtained if an application and other necessar documents are executed by the City. That the Mayor and City Clerk be and they are hereby authorized to execute constru tion and engineering contracts for the above mentioned sewer improvements, and an appli cation, together with such other necessary documents as may be required, in connection with the securing of Federal Grant -In -Aid for the proposed out -fall and interceptor sewer lines and appurtenances, from the U. S. Department of Health, Education, and. Welfare, Public Health Service, pursuant to the Federal Water Pollution Contro1.Act (33 U.S.C. 4663 et seq). APPROVED: Engineer John Mahaffey reported that the original contract of McClinton Brothers on the Airport'Contract had been completed and that the City owed McClinton Brothers the sum $21,576.46 retainage on their original contract. Mr. Harold (Rip) Lindsey appeared before the Council in regard to the construction of a ze new TV tower on Mt. Sequoyah replacing the old tower now in use at that place. He stated that -he had the consent of most of the property owners (Five of the seven 'ermit property owners. & The Building Inspector'reported that when the old tower was built, the property was not within the City Limits, but has been annexed since and that the Zoning Ordinance would .ing, not permit him to rebuild the tower without Council approval. The motion was seconded by Alderman Short and passed unanimously, t for The Building Inspector presented an old plat for a subdivision by Vernon Pittman which n by had been originally filed with the City Clerk in 1959 and later in 1960 was refiled on tman. a larger revised plat but was withdrawn by Mr. Pittman before being presented to the Council. A long discussion was had concerning a proposed 40 ft. street in the subdivision but Mr. Pittman agreed to dedicate five feet more on each side of the street off the lots he now owns. Alderman Short moved that the original plat, as presented by Mr. Pittman in 1960, be approved provided Mr. Pittman dedicates five feet on each side of the street off the lots he now owns. Alderman Thomas moved that this main be constructed as a Change Order to the contract now in effect with Danco Construction.Co, and providing no difficulties are encountered in obtaining right-of-way. The motion was seconddd by Alderman Wheeler and passed unanimously. There being no further business, Alderman Wheeler moved to adjourn. No. PURPOSES, 1286 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the following described territory, to -wit: Part of the Southwest Quarter of the Northwest Quarter of Section Nine (9) in Township Sixteen (16) North, Range Thirty (30) West of the Fifth Principal Meridina, described as follows, to -wit: Beginning at a point which is three hundred seventy five (375) feet East and twenty (20) feet North the Southwest corner of said forty (40) acre tract,.and running thence East one hundred and fifty- three (153) feet; thence North ten (10) feet; thence West one hundred fifty-three (153) feet; thence South ten (10) feet, to the place of beginning, by Vernon Wilson for street purposes, is hereby accepted by the City of Fayetteville, Arkansas, Section 2. Fayetteville, Arkansas I would appreciate your requesting the City Council for authority to advertise for bids and for the Committee to purchase the following replacement pieces of equipment for the Water and Sewer Departm are scheduled for replacement and funds are available and have been provided in the 1962 Budget. (a) Two 3/4 ton pickups to replace Trucks No. 72 and No. 75. Estimated difference in cost with trade s is $3,500.00 for the two. (b) Two tractor loader -diggers to replace our No. 77A and 77B Case loader -diggers. Estimated cost with trade-in values is $10,000.00 for the two. (c) One towed air compressor to replace our present one, which, to my knowledge, is over 15 years old sted difference in cost with trade-in value is $6,000.00 for the one. I would like to offer for your consideration, the purchase of a four -wheeled towed, 600 Ampere cape Part welding machine for the primary use of thawing pipes during extreme cold weather. This machine is many cities for this purpose. I have data and prices from Hobart and this equipment can be delivered approximately $2,500.00.
