Residential Uses in Industrial and Commercial Districts a. In I-lA and I -1B Light Industrial Districts, I-2 Heavy Industrial Districts and in -C-2 Thoroughfare Commercial Districts single-family and duplex -family dwelli. may be constructed on lots that front on open and improved dedicated streets provided such construction conforms to the area and set -back requirements of th R-3 Multi -family Residential District. b. To permit upon review and approval by the Board of Adjustment any type of resi- dential use in C-1 Neighborhood Commercial District and in C-3 Central Commerci Cistrict and also, any multi -family or rooming house use in C-2 Thoroughfare Commercial District provided that such uses conform to the area and setback requirements of the R-4 Multi -family Residential and Dormitory District. SECTION 3. All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed, and this Ordinance being necessary for the preservation of the public peace, health, comfort, convenience, morals, safety, and welfare of the City of Fayetteville, Arkansas, andemergency is hereby declared to exist and this Ordinance shall be in full force and effect from and after its passage, approval, and publication. Topurchase Alderman Heflin reported that a different or better pickup truck was needed for the Dog pickup Catcher and that Lewis Ford Sales Co. had a used pickup which could be bought by the for Dog City for $650.00 less a, trade-in of $100.00 for the old pickup making.a. net cost of Catcher. 0550.00 to the City for the used p8ckup. After a long discussion, during which the Mayor stated that the Water & Sewer Departmen would be purchasing some new pickups soon and the City might save money by keeping one their old trucks and trading the one now used by the Dog,Catcher on a new truck for the Water & Sewer Departments Alderman Christie moved to refer this to the Sanitation Commi for study and to Make the action they believed best. The motion was seconded by Alderman Faucette and passed unanimously. Bldg. The City Building Inspector reported that the Fayetteville School District No. 1 had Permits 11 for requested a Building Permit to construct a new music (Band) building and make some Band Bldg, additions at the Fayetteville High School which would be in conflict with the provisions & of Zoning Ordinance No.'1239 as amended by Ordinances No. 1276 and 1282. AN ORDINANCE ACCEPTING THE DEDICATION OF CERTAIN LANDS TO THE CITY OF FAYETTEVILLE, ARKANSAS, FOR STREET PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the following described territory, to -wit: Part of the Southwest Quarter of the Northwest Quarter of Section Nine(9) in Township Sixteen (16) North, Range Thirty(30) West of the 5th Prinhipal Meridian described as follows; to -wit: Beginning at a point which is one hundred seventy and four -tenths (170.4) feet East and Twenty (20) feet North of the Southwest corner of said forty acre tract, and running, thence East two hundred four and six -tenths (204.6) feet, thence North ten (10) feet; thence West Two Hundred Four and six -tenths (204.6) feet; thence South ten (10) feet to the point of beginning. After a brief discussion, the City Attorney read in its entirety a proposed resolution referring this to the Planning Commission. Alderman Goff moved the Resolution be adopted. The motion was seconded by Alderman Wheeler and passed unanimously, whereupon the Mayor declared the Resolution adopted. -RESOLUTION 1-62 WHEREAS, it is necessary that a more precise procedure be enacted whereby the Planning Commission of the City of Fayetteville, Arkansas, can initiate proposed amend- ments to the Fayetteville Zoning Ordinances, and WHEREAS, the present regulations governing the size of signs required by the Zonin Ordinance for rezoning procedure and the regulations concerning appeal to the Board of Adjustment are in need of certain changes and amendments, and WHEREAS, a problem has arisen concerning school construction and the present Zonin Regulations pertaining thereto, and it is the opinion of the Council that certain revisions are in order. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. DISTRICT MAP OF FAYETTEVILLE# ARKANSAS, PASSED AND APPROVED JUNE 139 1960, PROVIDING REGULATIONS FOR A PROPOSED 0-1 OPEN LAND DISTRICT FOR NEWLY ANNEXED AREAS TO THE CITY, DIVIDING THE NEWLY ANNEXED AREAS INTO DISTRICTS AND PROVIDING REGULATIONS FOR A PROPOSE R -P PROFESSIONAL OFFICE RESIDENTIAL DISTRICT; AND AMENDING THE ZONING DISTRICT MAP SO AS TO DESIGNATE THE BOUNDARY OF THE 0-1 OPEN LAND DISTRICT; AND FOR.OTHER PURPOSES". N ORDINANCE AMENDING ZONING ORDINANCE:.NO. 1239 AND ZONING DISTRICT MAP OF FAYETTEVILLE, RKANSAS, PASSED AND APPROVED JUNE 13, 1960, PROVIDING REGULATIONS FOR A PROPOSED 0-1 PEN LAND DISTRICT FOR NEWLY ANNEXED AREAS TO THE CITY; DIVIDING THE NEWLY ANNEXED AREAS NTO DISTRICTS AND PROVIDING REGULATIONS FOR A PROPOSED R -P PROFESSIONAL OFFICE RESIDENT, AL DISTRICT; AMENDING THE ZONING DISTRICT MAP'SO AS TO DESIGNATE THE BOUNDARY OF THE -1 OPEN LAND DISTRICT; AND FOR OTHER PURPOSES. 1. WHEREAS, public hearings were held'before the Planning Commission of the City of ayetteville,-Arkansas, on September 12, 1961, December 15, 1961, and December 28, 1961, or the purpose of discussing certain amendments and changes to the Zoning Ordinance b. 1239, passed and approved June 13, 1960, and WHEREAS, notices of said public hearings, setting forth the dates, times, places, urposes of said hearings, and location of property were published in the Northwest Ark imes, a newspaper of general circulation in said City, more than 15 days prior to said ublic hearings, and _ WHEREAS, following said public hearings, said'Planning Commission certified to the ity Council of the City of Fayetteville, Arkansas, its recommendation that an ordinance e adopted making the changes and amendments as hereinafter set out. That Article V, Provisions Governin Zonin District of Ordinance No.1239, assed and approved June 13, 196M e an a same is ere y amended by the addition of lection 149 which reads as follows: Section 14. 0-1 Open Land District This district.is intended to designate land located on the fringe of urban areas which is generally undeveloped or is used primarily for agricultural purposes but where future'urbanization is expected. The regulations which are authorized for the district; therefore, are designed to encourage and protect open land and agricultural uses until such tirm as urbanization is warranted and the appropriate change in district classification is made. 1. Uses Permitted a. Single-family dwellings, two-family dwellings, Multi -family dwellings, and Rooming Houses. b. Public and semi-public uses such as schools, churches, public services and utilities, airports, and landing fields, parks, playgrounds, golf courses ar driving ranges, including customary accessory uses and buildings. c. Agricultural uses', including horticulture, nurseries, orchards, forests and forestry, apiaries, field crops, the breeding and raising of livestock, and riding stables, provided that all stables, barns, animal sheds or shelters shall be located not less than one hundred(100) feet from any property line, Agricultural uses, further, are subject to the following exceptions and conditions: (1) Farms devoted to hatching, raising, breeding and marketing of chickens, turlFeys, or other poultry, fowls, rabbits, fur -bearing animals, fish or frogs shall have a tract, lot or parcel of not less than one (1) acre. (2) Killing, butchering, or dressing of livestock, fowl, fish, or other animals raised on the pr&mises for personal home consumption of the prop owner is permitted provided that such killings, butchering or dressing is done in an accessory building which is located not less than two hundred (200) feet from any property line. (3) Hog raising for other than resident family consumption is permitted on tracts, lots or parcels of more than twenty(20) acres, provided that feeding pens or shelters are -no closer than two hundred (200) feet from the property line of the tract on which they are located. d �41 Trailer courts and mobile trailer homes on individual lots provided they are in compliance with city ordinances regulating such trailer homes or trailer parks. Uses Prohibited Any commercial use, commercial slaughtering or industrial use except as permitt above or as they may be accessory to permitted uses. 3, Area and Bulk Regulations. a. Uses involving residences shall comply with R-4 Multi -Family Residential District regulations. Ii b. Uses involving Subdivision Regulations. Lot sizes and set-back.requirements for residential developments requiring a subdivision plat are governed by the minimum design standards -of the Subdivi .Regulations and the area and set -back regulations of R-4 Multi -Family Reside District. c. Uses involving public or semi-public buildings. Churches, private schools and private clubs Minimum lot areas --------------------------------------- 3 acres. Public schools Minimum lot area -- as determined by the Board of Education. 4. General Provisions Off-street parking and other general requirements shall be subject to the General Provisions set forth in Article IV, SECTION 2. That Article V. Provisions Governin ZoningDistricts of Ordinance No. 1239, dated June 13, 1960, be and he same s here y amended y adding Section 15, whi reads, to -wit: Section 15. R -P Professional Office Residential District A district, predominantly residential, intended to accommodate professional of uses which conform to standards generally consistent with the residential character of the area. 1. Uses Permitted a. All uses permitted in R-lA and R -1B Single Family Residential District and only residential uses permitted in R-2 Two -Family Residential District. b. Offices of professional persons including only doctors, dentists, musicians, artists, architects, attorneys, real estate brokers, and beauticians; provided that; (1) leo window display or sign is used which is illuminated or more than one(_ square foot in size. (2) No more than two (2) office establishments in addition to necessary assistants and office help occupy any one structure. 2. Uses Permitted on Review by Board of Adjustments a. Any professional uses similar to those permitted above in paragraph "b" under part 1 "Uses Permitted". 3. Usea Prohibited a. All uses prohibited in R-lA and in R -1B, Single Family Residential District, and R-2 Two -Family Residential District. b. Barbers, veterinary surgeons, catering services, and teachers providing instruction to classes or groups of more than two (2) persons at one time. 4. Area and Bulk Regulations a. The area and bulk regulations of R-2 Two -Family Residential District shall apply, except: (1) Minimum lot Brea shall be 81000 square feet for any office structure. (2) Maximum floor space at street level of any office structure shall not exceed 2,000 square feet. (3) Height shall be limited to one story structure. a. Any building erected or structurally altered to accommodate a professional office shall conform in general design and appearance to the residential character of the district. b. Plans for structural alterations of existing buildings and for new structures for professional offices shall be subject to -review and approval by the Building Inspector who may, however, refer questionable problems to the Planning Commission. 6. Off Street Parking a. Any structure constructed or remodeled for professional office use shall pro- vide off-street parking on the side yards. Parking may be permitted in the front yard with a minimum building set -back of twenty-five(25) feet. All off-street parking 'shall be in accordance with the requirements of Article IV, Section 7.,e. However, if the structure accommodates two (2) professional occupants, a minimum of ten (10) off-street parking spaces shall be provided. SECTION 3. The boundary of the 0-1 Open Land District is hereby established as shown on the amended Zoning District Map of Fayetteville, Arkansas, dated January 22, 1962, which is a part of this ordinance and which is on file in the office of the City Clerk. SECTION 4. All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed, and'this ordinance being necessary for the preservation of the public peace, health, comfort, convenience, morals, safety and welfare of the City of Fayetteville, Arkansas, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage, approval, and publication. Alderman Heflin then moved that the rules be further suspended and the ordinance placed on the third and final reading. The motion was seconded by Alderman Wheeler and passed unanimously. The ordinance was then read for the third and last time. The Mayor then declared the ordinance open for discussion. There being no discussion, The Mayor asked the question, "Shall the Ordinance pass"? Upon roll c4ll the following vote was recorded, "Aye" Heflin, Christie, Goff, Wheeler, Thomas, Faucette, and Short. "Nagy" None. There being seven "Ayes" and no 'Nays", the Mayor dedlared the Ordinance passed. ORDINANCE NO, 1285 AN ORDINANCE ACCEPTING TERRITORY ANNEXED TO THE CITY OF FAYETTEVILLE, ARKANSAS; ASSIGNI SAID TERRITORY TO WARDS; AND FOR OTHER PURPOSES. WHEREAS,.the County Court of Washington County, Arkansas, did on February 9, 1962, make an Order annexing the following described territory to the City of Fayetteville, Arkansas, to -wit: All of the North z of the S -z of the NW-1ofSection 8, Township 16 North, Range 30 West of the 5th Principal Meridian, except that area which is already located within t City of Fayetteville, Arkansas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVIDLE, ARKANSAS: Section 1. That the Annexation of the above described territory to the Corporate Limits of the City of Fayetteville, Arkansas, be and the same is hereby accepted. Section 2. That all of the above described territory is hereby assigned to and m a part of Ward 4 of the City of Fayetteville, Arkansas. Section 3. That this Ordinance shall take effect and be in force and effect from after its passage, approval, and publication.
