S. Samuel Siegel, for a six year term all of the terms on the Planni Commission beginning January 1, 1962. Alderman Burgin moved to accept the recommendation of the Mayor and make the appointments to the various Boards and Commission as outlined above. Bldg. The motion was seconded by Alderman Wheeler and passed unanimously. Permit referred Fees The City Building Inspector appeared before the Council with the problem of "Building to Permit Fees" for Building Permits on Public Schools, Government Buildings, etc., including B1dg.Cdrtn. buildings of the University of Arkansas. . After a long discussion, Alderman Thomas moved to refer this to the Building, Insurance, and Ordinance Committee for study and report. The motion was seconded by Alderman Wheeler and passed unanimously. W Ordinance Alderman Burgin moved to amend the proposed amending Zoning Ordinance which was left on No. 1282 the first reading at the regular meeting on Monday, December 18, 1961, by deleting all references to the REGULATIONS PROVIDING FOR A PROPOSED 0-1 OPEN LAND DISTRICT FOR NEWLY Amending ANNEXED AREA TO THE CITY, both in the Title and the Body of the proposed ordinance and Zoning I to place the proposed ordinance on the second reading as amended. Ordinances The motion was seconded by Alderman Christie and passed unanimously. No. 1239 & The City Clerk then read the proposed ordinance in its entirety for the second time 1276o as amended. Alderman Burgin then moved that the rules be suspended and that the ordinance be placed on the third and final reading. The motion was seconded by Alderman Christie and upon roll call the following vote was recorded: "Aye" Faucette, .Burgin, Wheeler, Goff, Christie, and Heflin. "Nay" Thomas. There being six "Ayes"nd only one "Nay",with a two-thirds majority of all Council members voting in the Affirmative, the Mayor declared the rules suspended and the ordinance placed on the third and final reading. The City Clerk then read the ordinance for the third and last time. The Mayor then declared the ordinance open for discussion. After a long discussion, the Mayor asked the question, "Shall the Ordinance pass?". Upon roll call the following vote was recorded: "Aye" Faucette, Burgin, Wheeler, Goff, Christie, and Heflin. "Nay" Thomas. There being six "Ayes" and only one "Nay", the Mayor declared the Ordinance passed. Alderman Burgin then moved the emergency clause be adopted. The motion was seconded by Alderman Christie ani passed unanimously, whereupon the Mayor declared the emergency clause adopted. ORDINANCE NO, 1282 AN ORDINANCE AMENDING ZONING ORDINANCE N0, 12392 PASSED AND APPROVED JUNE 13, 19601iA$ND MORE SPECIFICALLY AMENDING PARAGRAPH 1, SECTION 5 OF ARTICLE 5 OF ORDINANCE NO, 1239 AS AMENDED BY ORDINANCE N0, 1276, PASSED AND APPROVED SEPTEMBER 25, 19615 TO ALLOW COMMERC= IAL PARKING IN R-4 MULTI -FAMILY RESIDENTIAL AND DORMITORY DISTRICT; AMENDING ARTICLE 6 OF ZONING ORDINANCE NO. 1239, AS AMENDED BY SECTION 14 OF ORDINANCE NO. 1276, TO PER04IT RESIDENTIAL USE IN THE C-1 NEIGHBORHOOD AND C-3 CENTRAL COMMERCIAL DISTRICTS AND AP'ART- iENTS AND ROOMING HOUSES IN THE C-2 THOROUGHFARE COMMERCIAL DISTRICT; AND FOR OTHER URPOSES; AS AMENDED. WHEREAS, a public hearing was held before the Planning Commission of the City of Ilayetteville, Arkansas on November 28, 1961 for the purpose of discussing certain amend- ments and changes to the Zoning Ordinance -No. 1239; passed and approved June 13, 1960, �as amended by Ordinance No. 1276, passed and approved September 25, 1961, and WHEREAS', notice of said public hearing, setting forth the date, time, place, and ,urpose of said hearing and location of property was published in the Northwest Arkansas imes, a newspaper of general circulation in said City, more than 15 days prior to said ublic hearing, and WHEREAS, following said public hearing, said Planning Commission certified to the City Council of the City of Fayetteville, Arkansas, its recommendation that an ordinance be adopted making the changes and amendmeirts as hereinafter set out. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, SAS: SECTION 1. That paragraph 1, Uses Permitted of Section 5, R-4 Multi-famil Residen- and Dormitory District,of Article 5 of Ord nance No. 1239 da ed une 3, 960, be he same 3s erh- e�y amended to read as follows: 1. Uses Permitted a. Residential uses --all uses permitted in Section 1, R-lA, and Section 2, R -1B, Single-family Residential District, Section 3, R-2 Two-family Residential Dis- trict, and Section 4, R-3 Multi -family Residential District. b. Dormitory uses-- fraternity or sorority houses, rooming houses and lodging houses. c. Commercial parking lots --such commercial parking lots may include a small shelter for parking lot attendant. Alderman Christie reported that a request for a street light at the intersection of Street lite Sang Avenue and Cleveland Street had been received but there were no City residenbes at refused at that location, therefore he moved that no street light -be installed at this time. Alderman Christie reported that he had received a request for a Building Permit for a Building trailer house on a lot near Vale and that a trailer househad previously been located perml.t for there but had been moved. trailer He further reported that the owner•of the lot had installed a sewer line as well as all house the other utilities but under the present Zoning Ordinance -there:rwascauquestloheaeiton authorized. whether the Building Inspector could issue a permit or not. After a long discussion, Alderman Christie moved that the -Building Inspector be and he is hereby authorized to issue a Building Permit for a trailer house at that location. The motion was seconded by Alderman Faucette and passed unanimously. Letter Chief of from Police. The City Clerk read a letter from the Chief of Police Pearl Watts' stating his intention 'retiring of on March 1, 1962; also a letter from the Board of Trustees of the Police Pension & Relief Fund of Fayetteville, Arkansas, accepting the application and retiremer of Police Chief Pearl watts effective March 1, 1962, with his pension starting as of that date at one-half of his highest annual base pay while Chief of Police. No action was necessary by the Council. That Article -6, Exceptions and Modifications, of Zoning Ordinance No. passed and approved June 13, 19 , as amended by Section 14 of Zoning Ordinance No. dated September 25, 19619 be and the same is hereby amended to read as follows: Section 7. Residential Uses in Industrial and Commercial Districts a. In I-lA and I -1B Light Industrial Districts, I-2 Heavy Industrial Districts and in -C-2 Thoroughfare Commercial Districts single-family and duplex -family dwelli may be constructed on lots that front on open and improved dedicated streets provided such construction conforms to the area and set -back requirements of th R-3 Multi -family Residential District. b. To permit upon review and approval by the Board of Adjustment any type of resi- dential use in C-1 Neighborhood Commercial District and in C-3 Central Commerci: Cistrict and also, any multi -family or rooming house use in 0-2 Thoroughfare Commercial District provided that such uses conform to the area and setback requirements of the R-4 Multi -family Residential and Dormitory District, SECTION 3. Smith, Chief of Police Pearl Watts, Fire Chief Burl'Skelton, and Aldermen: Short, Faucette, Burgin, Thomas, Wheeler, Goff, Christ and Heflin. " 11 Absent: None. The minutes of the regular meeting on Monday, January 8, 1962, a copy of which had been previously mailed to each of the Aldermen, were approved as written. The City Building Inspector reported that the Fayetteville School District No. 1 had requested a Building -Permit to construct a new music (Band) building and make some additions at the Fayetteville High School which would be in conflict with the provision; of Zoning Ordinance No.'1239 as amended by Ordinances No. 1276 and 1282. After a long discussion, Alderman Christie moved to wgive the requirements of the Zonin€ Ordinances insofar as applicable to the building and additions at the Fayetteville High School,as mentioned above,and that the City Building.Inspector be and he is hereby authorized and directed to issue a Building Permit th Fayetteville S hool District No. 7 to construct a new Band Building and to construct additions at the Fayetteville High Sghool according to the plans and specifications as approved by the Building Inspector acid State Fire Marshal and that the Fayetteville Planning Commission be requested to make a study and recommendation of the zoning problems involved for future construction of public s6hools"in the City. The motion was seconded by Alderman Burgin and passed unanimously. The Mayor reported -that the terms of Messrs Webb Williams and Ted Wylie had expired as of January 1, 1962, asdmembersoo'-fethe Library Board and he recommended they be reappoini for a term of 6 years each, beginning January 1, 1962. Alderman Short moved to accept the recommendation of the Mayor and appoint Webb William; and Ted Wylie for -another term of 6 years as members of the Library Board. The motion was seconded by Alderman Thomas and passed unanimously. Alderman Heflin reported that a different or better pickup truck was needed for the Dog Catcher and that Lewis Ford Sales Co. had a used pickup1which could be bought by the City for $650.00 less a trade-in of $$100.00 for the old pickup making a net cost of $$550.00 to the City for the used pMokup. After a long discussion, during which the Mayor stated that the Water & Sewer Department would be purchasing some new pickups soon and the City might save money by keeping one s their old trucks and trading the one now used by the Dog.Catcher on a new truck for the Water & Sewer Departmento Alderman Christie moved to refer this to the Sanitation Commi' for study and to ;take the action they believed best.
