The minutes of the regular meeting on Monday, July 24, 1961, and of the special session
on Thursday, July 27, 1961, copies of which had been previously mailed to each of the
Aldermen, were approved as written.
Easement The Mayor reported that the University of Arkansas had requested an easement for a
grant to steam heating tunnel under the sidewalk on Garland Avenue at Holcombe Hall Annex.

Alderman Burgin moved that the rules be suspended and the ordinance placed on the second
reading.
The motion was seconded by Alderman Short and passed unanimously,
The ordinance was then read for the second time.
Alderman Burgin then moved that the rules be further suspended and that the ordinance
be placed on the third and final reading.
The motion was seconded by Alderman Hatfield and passed unanimously.
The ordinance was than read for the third and last time.
The Mayor then declared the ordinance open for discussion. There being no discussiom, th
Mayor asked the question, "Shall the Ordinance pass?"
Upon roll call the following 'vote was recorded,"Aye" Walker, Christie, Hatfield, Thomas,
Burgin, Smith, and Short. "Nay" None.
There being seven "Ayes" and no "Nays", the Mayor declared the ordinance passed.

AN ORDINANCE VACATING AN ALLEY RUNNING NORTH AND SOUTH BETWEEN EAGLE AND CLEVELAND ST
IN BLOCK NUIJBERED.THIRTEEN(13) IN ROSE HILL ADDITION TO THE CITY OF FAYETTEVILLE,
ARKANSAS.
WHEREAS, a petition was duly filed with the City Council of the City of Fayettevill ,
ansas, on the 20th day of March, 1961, asking the City Council to vacate and abandon
alley running North and South between Eagle and Cleveland Streets in Block Numbered
rteen(13) in Rose Hill Addition to the City of Fayett8ville, Arkansas, and
WHEREAS, after due notices as required by law, the City Council has, at the time
and place mentioned in the notice, heard all persons desiring to be heard on the questio
and has ascertained that the portion of the alley hereinabove described has heretofore
been dedicated to the public use as an alley; has not been actually used by the public
generally for a period of at least five(5) years subsequent to the filing of the plat;
that all of the owners of the property abutting on the portion of said alley sought to b
vacated have filed with the City Council their written consent to said abandonment; and
that public interest and welfare will not be adversely affected by the abandonment of
said alley.
NOW, THEREFORE, BE IT ORDAINED -BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, A
SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vacates, and abandotis
all its.rights,.together with.the rights^.of the public generally, in'and to the alley
running North and South between Eagle and Cleveland Streets. in Block N4mbered Thirteen(15)
in Rose Hill Addition to the. City of Fayetteville, Arkansas, reserving unto said City
of Fayetteville, Arkansas, its successors and assigns, an easement or right-of-way on,
over, under and across the said alley hereby vacated for the purpose of constructing,
installing, laying, and relaying, relocating and maintaining all public utilities now
located, or which may hereafter be located, upon said vacated alley by said City or any
corporation having a franchise,or right-of-way from said City, without recourse by the
owner, owners, or occupants for damages incurred by the construction or maintenance of
said utilities. .
SECTION 2. A copy of this Ordinance duly certified by the City Clerk shall be file
in the Office of the Recorder of the County and recorded in the Deed Records of the
County.
SECTION 3. This Ordinance shall take effect and be in force from and after its
passage and approval.

Alderman Christie reported that a sewer line was badly needed in the Meadowlark Additi
and along the Cato Springs.Road. After a lengthy discussion, Alderman Christie moved
to authorize the City Engineer to make a survey of this area regarding the laying of a
sewer line and report at the next council meeting on Monday, August 26, 1961.
The motion was seconded by Elderman Short and passed unanimously.
Alderman Smith moved that the Mayor be authorized to write a letter formally requesting
permission from the FAA to install Airport Lighting Control Equipment in the new FAA
building, now being constructed, and a request for their personnel to operate when
installed.
The motion was seconded by Alderman Short and passed unanimously.

q These three requests were as follows: bne on West Dickson Street between Arkansas Avenue
for Bldg." and Gregg Avenue on the North side of Dickson Street.
Permits, One on South School Avenue just south -of the St. Paul Railroad crossing, and one on
East Fifteenth Street and Washington Avenue.
After a long discussion, Alderman Walker moved that a Resolution be passed amending the
Major Street Plan (Resolution 7-60) in order to permit Mr. Emil Sonneman to construct a
building on West Dickson Street.
The motion was seconded by Alderman Short and passed unanimously, whereupon the Mayor
declared the Resolution adopted.

attached thereto, be amended o reduce the projected width of Dickson Street between Ozark
Plan. Avenue and College Avenue from seventy (70) feet to sixty (60) feet except that part
which lies between.Arkansas Avenue and Gregg Avenue on the North side of Dickson Street hnd
that part of Dickson Street which lies between University Avenue and Gregg A4enue on the
South side of.Dickson Street which shall be fifty-five (55) feet and that a certified co)y
of this :Resolution be filed in the Office of the City Clerk and in the Office of the
Circuit Clerk and Ex -Officio Recorder for Washington County, Arkansas,
