County Court Addition to the City of Fayetteville, Arkansas, described as beginnin
at a point two hundred (200) feet North of the Southwest corner of Lot Numbered 15
in Block Numbered 9 in said Addition, and running, thence North eighty-five and on
half (852) feet; thence East one hundred sixty (160) feet; thence South eighty-fiv
and one-half (852) feet; thence West one hundred sixty (160) feet to the place of
beginning.
Being also described as the North 85 1/2 feet of the following described real e
to -wit: '
The West 131' of the South 200' of Lot 15, the North 11' of the West 160' of Lot 1;

WHEREAS, following said public hearing, said Planning Commission certified to the
City Council of the City of Fayetteville, Arkansas, its recommendation that an ordinance
be adopted rezoning said above described real estate from R-4 Multi -Family Residential
and Dormitory District to C-3 Central Commercial District.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
SAS:
Section 1. That said above described real estate be and the same is hereby rezoned
from R-4 Multi -Family Residential and Dormitory District to C-3 Central Commercial
District,
Section 2. That all ordinances or parts of ordinances in conflict herewith are her
repealed, and this action being necessary for the public health, peace, safety, order,
comfort, and convenience within the City of Fayetteville, Arkansas, an emergency is her
declared to exist and this ordinance shall be in full force and effect from and after i
passage, approval, and publication.

Alderman Walker moved that the Ordinance be passed.
The motion was seconded by Alderman Short and passed unanimously, whereupon the Mayor

Alderman Walker then moved that the emergency clause be adopted. The motion was seconded
by Alderman Hatfield and passed unanimously, whereupon the Mayor declared the emergency
clause adopted.

AN ORDINANCE AMENDING ZONING ORDINANCE N0. 1239 AND ZONING DISTRICT MAP OF FAYETTEVILLE,

WHEREAS, a public hearing was held before the Planning Commission of the City of

Fayetteville, Arkansas, on April 4, 1961, on the petition of Collier Rexall Drug Store,
Inc., requesting that said Planning Commission recommend to the City Council of the City
of Fayetteville, Arkansas, that said City Council enact an ordinance to rezone from R-4
Multi -Family Residential and Dormitory District to C-3 Central Commercial District all o
the following described real estate, to -wit:

City The City Engineer presented a Master Plan of the Municipal Airport showing the locations
con- of the proposed private hangars at Drake Field.
After a long discussion, Alderman Burgin moved that the Mayor and City Engineer be
authorized to consult the FAA for their approval of the site as presented in the Master
of Plan.
The motion was seconded by Alderman Walker and passed unanimously.
The City Attorney reported that he had amended a proposed ordinance, as requested by the
Council, entitled "AN ORDINANCE ESTABLISHING A LICENSE FOR AIRPORT RENT -A -CAR SERVICE;
REQUIRING INSURANCE AND/OR A BOND; AND FOR OTHER PURPOSES" which had been left on the
first reading at a regular meeting of the City Council on September 26, 1960.
He than read the ordinance in its entirety as amended.
Alderman Smith then moved the ordinance, as amended, be placed on its second reading.

recorded: "Aye" Walker, Christie, McClelland, Thomas, Burgin, Smith, and Short.
"Nay" None. Abstaining: Alderman Hatfield.

motion passed.
The ordinance was then read for the second time.
Alderman Burgin then moved that the rules be suspended and the ordinance be placed on th
third and final reading.
The motion was seconded by Alderman McClelland and upon roll call the following vote was
recorded, "Aye" Walker, Christie, McClelland, Thomas, Burgin, Smith, and Short.
Nay, "None" Abstaining: Hatfield.
There being seven "Ayes" and no "Nays" with only one abstaining, the Mayor declared the
motion passed.
The nr.dinance was then read for the third and last time.
The Mayor then declared the ordinance open for discussion. There being no further discus
sion, the Mayor asked the question, "Shall the Ordinance pass?" Upon roll call the
following vote was recorded, "Aye" Walker, Christie, McClelland, Thomas, Burgin, Smith,
and Short. "Nay" None."Abstaining" Hatfield.
There being seven "Ayes" and no Nays" with only one abstaining, the Mayor declared the
Ordinance passed.
ORDINANCE N0, 1261
ORDINANCE ESTABLISHING A LICENSE FOR RENT -A -CAR SERVICE; REQUIRING INSURANCE AND/OR
BOND; AND FOR OTHER PURPOSES; AS AMENDED.
IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. "Rent-A-Car Service" is hereby defined to be the furnishing of rent -a -c
service in the City of Fayetteville, Arkansas, whereby an automobile is rented for the
exclusive use of a person, firm or corporation for an indefinite period of time at a
rate established by both the mileage traveled and length of time said automobile is so
rented.
Section 2. It is hereby declared to be a privilege for any person, firm or corpora-
tion to furnish rent -a -car service in the City of Fayetteville, Arkansas, and no person,
firm, or corporation shall engage in such undertaking without first paying to the City
Clerk an annual license fee of 1$100.00 per year.
Section 3. No person, firm, or corporation shall furnish rent -a -car service unless
and until such person, firm or corporation shall have furnished and shall have filed wi
the City Clerk of the City of Fayetteville, Arkansas, an insurance policy written by an
insurance company approved by the City Clerk, which policy shall bind the insurance
company writing same to indemnify up to the amount of Twenty Thousand ($20,000.00)Dolla
any person, firm or corporation suffering any personal injury or property damage from
the negligent or otherwise faulty operation of such rent -a -car service.
Provided, however, that in lieu of furnishing said policy, a person, firm, or
corporation operating rent -a -car service may give to the City Clerk a statement or othe
satisfactory assurance that there has been deposited in any Fayetteville Bank the sum o
Twenty Thousand ($20,000.00) Dollars in cash which shall be available at all times for
the payment of any damage lawfully assessed against any such person, firm, or corporati
from the operation of such rent -a -car service.
Section 4. It is hereby declared to be a misdemeanor for any person, firm, or cor-
poaratin to violate any of the provisions of this ordinance and such violations shall,
upon conviction, be punishable by a fine of not less than Five ($5.00) Dollars and not
more than Two Hundred FiBty($250.00) Dollars or imprisonment for not less than one (1)
day and not more than thirty(30) days or both fine and imprisonment.
Section 5. That if any of this ordinance shall be declared to be unconstitutional
that the remaining sections of this ordinance shall be deemed valid and in full force
and effect.
Section 6. All ordinances or parts of ordinances in conflict herewith are hereby
repealed and this ordinance shall be in full force and effect from and after its pass
approval, and publication.

Licens The City Attorney read a proposed License Agreement between the City of Feyatteville
Agreement and Herbert Hatfield d/b/a Hatfield Rent-A-Car for office rental space in the Terminal
with Building at the Municipal Airport (Drake Field).
Herbert After a long discussion, Alderman Burgin moved to approve the License Agreement on a
Hatfield. five year basis and that the Mayor and City Clerk be and they are hereby authorized to
execute same.
The motion was seconded by Alderman Christie and upon roll call the following Vote was
recorded, "Aye" Christie, McClelland, Thomas, Burgin, and Smith. "Nay" Walker and Short
"Abstaining" Hatfield.
(There being five "Ayes" and only two "Nays" with one abstaining, the Mayor declared the
motion passed.
