HomeMy WebLinkAbout1960-12-02 MinutesResoultion RESOLUTION 16-60 16-60 WHEREAS, on'May 11, 1959, the Qity Council of the City of Fayetteville, Arkansas, adopted Resolution No. 8-59 approving a master street plan together with maps and regu- lations relating thereto for the City of Fayetteville, Arkansas,. which plan now appears of record in the office of the Circuit Clerk and Ex-Officio'Recorder for Washington County, Arkansas, and WHEREAS, on May 29 19600 the City Council adopted -Resolution No. 6-60 approving a Land Use Plan together with maps;and regulations relating thereto for the City of Fayetteville, Arkansas, and WHEREAS, on June 13, 1960, the City Council of the City of Fayetteville, Arkansas, adopted Ordinance No. 1239 entitled AN ORDINANCE RELATING TO THE ZONING LAWS OF THE CITY OF FAYETTEVILLE, ARKANSAS$ REPEALING ZONING ORDINANCE NO. 1002 ADOPTED SEPTEMBER 10, 1951, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEVERABILITY OF THE PROVISION HEREOF, And WHEREAS, on September 12, 1960, the City Council of the City of Fayetteville, Arkansas, adopted Ordinance No. 1245 entitled SUBDIVISION 'REGULATIONS, Fayetteville, Arkansas, and WHEREAS, the aforesaid resolution No. 6-60 provided that the City Clerk would not record any additional resolutions, maps and/or ordinances pertaining to the overall cit planning program until such time as study and•action on all'phases of the City Planning Proposals were complete in order that all recording may be done simultaneously, and WHEREAS, the Community Facilities Plan is the last in the various planning p to be submitted by the City Planning Commission for adoption by the City Council. NOW, THEREFORE, BE.IT.ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Clerk be and he is hereby directed to place of record in the office. of the Circuit Clerk and Ex- o OfficiRecorder for Washington County, Arkansas the above mentioned resolution No. 6-60 together with any maps and/or regulations per- taining thereto,.Ordinance No. 1239, and Ordinance No. 1245, all heretofore adopted by the Citgo Council of the City of Fayetteville, Arkansas. The City Council of Fayetteville, Arkansas met in special session on Friday, December 2, 1960, at 12:00 Noon, CST. Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney A. D. McAllister Jr., City Engineer W.C. Smith, and Aldermen: Barnhart, Smith, Lunsford, Hatfield, Kent, and Walker. Absent: Aldermen J. E. McClelland and Ellis Burgin. ( Special Attorney W. B. Putman and City Attorney Elect Charles Bass Trumbo were also present -at this meeting) Purpose of The Mayor reported that the purpose of the meeting was to discuss annexation problems meeting. concerning the territory set forth in City Ordinances No. 1244 and 1246 approved by the Electorate of the City of Fayetteville at the General Election on Tuesday, November B. 1960, and that all members of the Council had been notified by U. S. Mail but Aldermen Ellis Burgin and J. E. McClelland were out of the City and could not attend, but had waived notice of the meeting. D. McAllister, Jr., and Greenland W. B. M, Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones City Attorney A. D. McAllister Jr., City Engineer W. C. Smith, Chief of Police Pearl Watts, Fire Chief Burl Skelton, and Aldermen: Barnhart, Smith, Burgin, Lunsford, McClelland, Hatfield, Kent, and Walker. Absent: None. The minutes of the regular meeting on Monday, November 28, 1960, and of the special session on Friday, December 20 1960, were read and approved. City Attorney The City Attorney reported that the Washington County Judge , on December 3, 1960, enter Recommendation an order consolidating for hearing on January 70 1961, at 9:00 o'clock A. M. The City Attorney and City Attorney -Elect both recommended that the Agents author- ized to represent the City Council in connection with the current annexation proceedings be authorized to enter into settlement;,negotiations with representatives of the City of Springdale and with those seeking to incorporate the Town of Johnson, prior to the date set for hearing in the Washington County Court. Subdivision Regulationse referred back Alderman Smith then moved to refer thisplat back to the Planning Commission and the to Planning Special Committee for further study and report. Commission. Alderman McClelland introduced and read a proposed ordinance in its entirety, entitled: "AN ORDINANCE AUTHORIZING DUCK AND GOOSE HUNTING ON THE CITY WATER SUPPLY RESERVOIRS AND Ordinance OR LAKES; PROVIDING FOR THE PROMULGATION OF RULES AND REGULATIONS; AND FOR OTHER No. 12531 PURPOSES" Duck Hunting After abrief discussion, Alderman McClelland moved that the ordinance pass. The motion on Lakes. was seconded by Alderman Lunsford and passed unanimously, whereupon -the Mayor declared the ordinance passed. ORDINANCE N0. 1253 AN ORDINANCE AUTHORIZING DUCK AND GOOSE HUNTING ON THE CITY WATER SUPPLY RESERVOIRS AND/OR LAKES; PROVIDING FOR THE PROMULGATION OF RULES AND REGULATIONS; AND FOR OTHER BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. Subject to the rules and regulations to be adopted in the manner here- inafterer seii orth, it shall be lawful to hunt ducks and geese in the City reservoirs us for water supply in Washington County, Arkansas, Section 2. Hunting for ducks and geese on said Lakes, shall be permitted at the ti 1. and in the manner hereafter authorized by motion of+.resolution of the City Council of the City of Fayetteville, Arkansas, having due regard for the rules and regulations of Board of Health of the State of Arkansas and of the recommendations of the Arkansas Sta Game and Fish Commission, the Federal and State Game Laws. Section 3. The City of Fayetteville from time to time shall by resolution or motioi promulgate all necessary rules and regulations in connection with the use of said Lakes for hunting ducks and geese and all necessary rules and regulations with respect to the time hunting may be permitted and the methods which hunting may be permitted on said Lakes, and to provide such other rules and regulations in connection with hunting activ• ities on said Lakes as may from time to time be desirable, including the fixing of per- mit fees and such other matters and things as the City of Fayetteville may deem advisab: and proper.
