ARKANSAS, THAT DRAINAGE IN A PORTION OF THE CITY BE IMPROVED, WHEREAS, Arkansas Western Gas Company, among others, owns land in a block of the City of Fayetteville bounded by East Maple Street on the North, East Lafayette Street on the South, Mission Boulevard on the West and Tanglewood Drive on the East, and WHEREAS, a stream draining approximately eighty acres crosses the aforesaid block and has from time to time during the past caused flooding in this area after heavy rains, said flooding being aided and abetted by the clogged condition of the natural stream, and , WHEREAS, the City Council Mr. Arnold Christie, representing the Arkansas Western Gas Company, appeared before Gas Co for the protection the Council with a proposed resolution which would give the Gas Company the authorized of its citizens deems authority to construct a drainage tunnel on their property near their present ware - to _ house. constrILCt provided,. After a lengthy discussion, the City Attorney read the proposed resolution in its culvert entirety. Alderman Smith moved the resolution be adopted. The motion was sedonded by Resolution by Alderman Lunsford and passed unanimously, whereupon the Mayor declared the 13-60 to resolution adonted. 1 close that Willow Avenue be closed to through traffic between Lafayette Street and Sutton WillowlAve. Alderman Lunsford then moved to adopt the emergency clause. The motion was seconded between by Alderman Smith and passed unanimously, whereupon the Mayor declared the emergency Lafayette & :.clause adopted. The Arkansas Western Gas Company is requested, authorized and directed to construct a tunnel S feet elide and 4 feet high under its property in said lands for the handling and disposal of surplus water normally travelling in the aforesaid creek as shown on the attached plat marked Exhibit "A". Section 2. The health, welfare and property of the citizens.of the City of Fayetteville, Arkansas, require that an improved drainage system be installed as soon as possible and that, therefore, an emergency is hereby found and declared to exist and this resolution being necessary for the immediate preservation of the public peace, health and safety, shall take effect and be in force from the date of its passage and approval. The minutes of the regular meeting on Monday, September 12, 1960, were read and approved Petition to The City Clerk read a petition signed by several residents on Willow Avenue requesting close that Willow Avenue be closed to through traffic between Lafayette Street and Sutton WillowlAve. Street between the hours of 12;00 o'clock noon and 1:00 o'clock P.M. during school days. between After a lengthy discus§ion, this was referred to the Street Committee. Lafayette & Sutton. Alderman Kent read a letter from the Firemen's Pension & Relief Fund Board of Trustees in which they requested that z mill tax be appropriated for the year of 1961 as was Letter from done in 1960. WHEREAS, THE RESIDENTS of the contiguous areas are without the benefit of police a protection and are being penalized on insurance rates by reason of the lack of uate fire protection; and WHEREAS, such contiguous areas are needed for the extension of streets, sewer, gas water systems; to supply places for abode and business and for the extension of nee ce regulations; and WHEREAS, such contiguous areas# if annexed, will unite with the presently esta ity limits to make up a homogenous city which will afford.to its several parts the rdinary benefits of local government; and WHEREAS, the City Council of the City of Fayetteville, Arkansas, is of the opinion t the question of annexing the territories hereinafter described should be submitted qualified electors of the City of -Fayetteville, Arkansas, at its next annual electi be held on Tuesday, November B, 1960. MLLE, ARKANSAS, THE QUESTION OF ANNEXATION OF CERTAIN TERRITORY ADJACENT.AND CONTIGUOUS 246. TO THE PRESENT CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURPOSES". Alderman Hatfield moved that the rules be suspended and the ordinance placed on the second reading. The motion was seconded by Alderman Smith and upon roll call the following vote was recorded: "Aye" Barnhart, Smith, Burgin, Lunsford, McClelland, Hatfield, and Kent. Nay" Walker. There being seven "Ayes" and only one "Nay", the Mayor declared the motion passed. The ordinance was then read for the second time. Alderman Burgin then moved that the rules be further suspended and the ordinance placed the third and final reading. The motion was seconded by Alderman Smith and passed unanimously. The ordinance was then read for the third and last time. The Mayor then declared the ordinance open for discussion. There being no further discussion, the Mayor asked the question, "Shall the ordinance pass"? Upon roll call the following vote was recorded,_"Aye" Barnhart, Smith, Burgin, Lunsford, McClelland, and Hatfield. "Nay" Kent and Walker.. There being six "Ayes" and only two "Nays", the Mayor declared the ordinance passed. ORDINANCE N0. 1246 AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, THE QUEST OF ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CORPORATE LIMI F THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURPOSES. Highway.No. 71 South Area) After a brief discussion, Alderman Smith moved to authorize the City Engineer to make a For Annexation, Against Annexation" SECTION 3. That in the event of the approval of said annexation by the.qualified electors of the City of Fayetteville, Arkansas, as hereinabove provided for, that such steps be taken as are necessary to comply with the will of the people as expressed in said election. L4\V..1\, Alderman Burgin then moved that the matter of the annexation of the territory described in Ordinance No. 1246 be submitted to the electors of Fayetteville, Arkansas, in the General Election on Tuesday, November B. 1960. The motion was seconded by Alderman Smith and upon roll call the following vote was recorded, "Aye" Barnhart, Smith, Burgin, Lunsford, MoClelland, Hatfield, and Walker. "Nay" Kent. There being seven "Ayes" and only One "Nay", the Mayor declared the motion passed. Annexation Alderman Burgin then moved that all maps pertaining to annexation be referred to the maps referred City Planning Commission for study, recommendation, and report back to the Council at to Planning a date not later than October 5, 1960. Commission's The motion was seconded by Alderman Lunsford and passed unanimously. Alderman McClelland was excused at this time. Study of Alderman Smith reported that the Street Committee had recommended that a three-way stop Hiway 71 & light should be installed at the intersection of Highways 71 and 62 in the south part of 62 stoplita the city in order to relieve the congested traffic at that point provided the streets to be made, were wide enough at that point to provide for such light. , After a brief discussion, Alderman Smith moved to authorize the City Engineer to make a study of that problem and make recommendation at the next Council meeting. The motion was seconded by Alderman Burgin and passed unanimously. Three Street Alderman Smith reported that he had requests for three street lights and he moved they Utes Ibe installed as follows: authorized. 1 street light at intersection of Green Valley Avenue and Ash Street. 1 " " " it " Green Valley Avenue and Miller Street. 1 Street light on Garland Avenue just south of Sycamore Street to give light for the Trinity Church. The motion was seconded by Alderman Burgin and passed unanimously. Milnieipal The City Clerk read a letter from the ?resident of the Arkansas Municipal League, League I (John Harsh, Mayor) concerning the Municipal League Meeting in Little Rock, Arkansas, Meeting to on October 17-18, 1960* be attended. Alderman Lunsford moved that the City pay the necessary expensed of all the City Officio who wished to attend the Municipal League meeting in Little Rock on October 17-18 including the Aldermen and City Attorney who are to be elected It the General Election in November of this year. ( It will be noted that all candidates for City Offices are unopposed in the coming election) The motion was -seconded by Alderman Walker and passed unanimously. Fence relocated Alderman Lunsford reported that the City Engineer had recommended that the Fence Compan3 at Airport. be requested to relocate the woven wire fence at the old Central Airlines Office and extend it to run straight north to the shop area in order to permit more parking space for planes. This would cost approximately from $300.00 to $400.00. After a brief discussion, Alderman Lunsford moved to have the fence relocated as out- lined above at a cost•not to exceed #400.00. The motion was seconded by Alderman Hatfield andpassed unanimously. Change floodlights at Alderman Lunsford further reported that the. Light Company was removing the two Cid floor Airport. lights at the old ramp and installing two poles outside the fence with 2500 Lumen Street lights, at no cost to the City, which will save the City on their elect*ic bill. This was also -recommended by the City Engineer, Rent-�s,Car Alderman Lunsford introduced and read in its entirety for the first time a proposed ord left on ordinance entitled, "AN ORDINANCE ESTABLISHING A LICENSE FOR AIRPORT RENT -A -CAR first reading. SERVIC191 REQUIRING INSURANCE AND/OR A BOND, AND FOR OTHER PURPOSES". Absent: None, The Mayor reported that the purpose of the meeting was to pass an ordinance for annex- ation of certain territories adjacent to the City of Fayetteville, to submit same to the voters of Fayetteville at the General Election on Tuesday, November 8, 19600 and that all members of the Council had been notified by U. S. Mail and by -telephone, A long discussion was had concerning annexation of certain territories adjacent to the City of Fayetteville. The City Attorney then read a proposed ordinance entitled,' AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, THE QUESTION OF ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURPOSES." The City Clerk read a petition signed by several citizens living in the area of Hendrix isemore Street and Addington Avenue requesting that the Willis Sisemore Garage be requested to arage close at a reasonable hour in order to prevent so much noise in -the late evening. The City Attorney then read a proposed ordinance entitled,' AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, THE QUESTION OF ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURPOSES." After more discussion Alderman Burgin ,,moved that the rules be suspended and that the ordinance be placed on the second ft4d�ing.l The motion was seconded by Alderman Walker and passed unanimously. The ordinance was read -for the second time, Alderman Burgin then moved that the rules be further suspended and that the ordinance be placed on its third and final reading. The motion was seconded by Alderman Lunsford and passed unanimously. The ordinance was then read for the third and last time. The mayorthen declared the ordinance open for discussion, There'being no discussion, the mayor askedthequestion, "Shall the ordinance pass?" Upon roll call the following vote was recorded: "Aye" Barnhart, Smith, Burgin, Lunsford, McClelland, Hatfield, and Walker. WHEREAS, the present•corporate limits of t he.City of Fayetteville, Arkansas, fail .clude thickly populated areas adjacent and contiguous to the City of FW etteville, sas; and WHEREAS, service.is now being rendered to some parts of the territory by the City Fayetteville, Arkansas, graiuitously;.and WHEREAS, 'the residents of the contiguous areas are without the benefit of police and fire protection and are being penalized on insurance rates.by reason of the lack of adequate fire protection; and WHEREAS, such contiguous areas are needed for the.extension of streets, sewer, gas and water systems; to supply places.for abode and business; and for the extension of needed police regulations; and WHEREAS, such contiguous areas, if annexed, will unite with the presently extablished -city limits to make up at homogenous city which will afford to its several parts the ordinary benefits of local government; and WHEREAS, the City Council of the -City of Fayetteville, Arkansas, is of the opinion that the question of annexing the territories hereinafter described should be submitted to :the qualified electors of the City of Fayetteville, Arkansas, of its next annual election to be held on Tuesday, November B. 1960.
