BOHLEN SUB DIVISION TO TIE CITY OF FAYETTEVILLE, ARKANSAS". lderman Kent moved that the ordinance be placed on its second reading. he motion was seconded by Alderman Hatfield and upon roll call the following vote was ecorded: "Aye" Burgin, Hatfield, and Kent. "Nay" Barnhart, Smith, Lunsford, and cClelland. here being Three "Ayes" and four "Nays", the motion to place the ordinance on the econd reading was defeated and the ordinance was left on its first reading. ague Several representatives of the Little League Baseball appeared before the Council in regard to the construction of 3 Little League Baseball Parks in Walker Park, They requested permission to construct 3 parks and that the City furnish some financial assistance in the construction of these baseball parks, After a long discussion, Alderman Smith moved to refer this to the Park and Finance Committees to meet with a committee from the Little League Baseball and make a study and recommendation at the next regular Council meeting on Monday, September 12, 1960. This motion was seconded by Alderman Lunsford andpassed unanimously, e The City Attorney introduced and read a proposed. ordinance in its entirety for the first 3 time entitled,."AN ORDINANCE VACATING THAT PORTION OF VINSON STREET BETWEEN NORTH EQUOYAH DRIVE AND MAPLE STREET IN EAST MOUNTAIN ADDITION TO THE CITY OF FAYETTEVILLE, RKANSAS"e est, Alderman Burgin moved that the rules be suspended and the ordinance placed on the second reading, The motion was seconded by Alderman Lunsford and passed unanimously. he ordinance was then read for the second time. Alderman Smith them moved that the rules be further suspended and the ordinance placed o the third and final reading. The motion was seconded by Alderman Lunsford and passed unanimously. The ordinance was then read for the third and last time. The Mayor then declared the ordinance open for discussion. There being no discussion, th Mayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Barnhart, Smith, Burgin, Lunsford, McClelland, Hatfield, and Kent. "Nay" None. There being seven "Ayes" and No "Nays", the Mayor declared the Ordinance passed. ORDINANCE N0, 1243. N ORDINANCE VACATING THAT PORTION OF VINSON STREET BETWEEN NORTH SEQUOYAH DRIVE AND APLE STREET IN EAST MOUNTAIN ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS. 0 WHEREAS, a petition was duly filed with the City Council of the City of Fayettevill , rkansas, on the 14th day of June, 1960, asking the City Council to vacate and abandon 11 that portion of Vinson Street designated on,the plat of the East Mountain Addition o the said city, in the office of the Circuit Clerk and Ex -Officio Recorder for ashington County, Arkansas, and WHEREAS, after due notices as required by law, the council has at the time and plac mentioned in the notices, heard all persons desiring to be heard on the question and has ascertained that the street hereinbefore described has heretofore been dedicated to the public use as a street herein described; has not been actually used by the public gerer- ally for a period of at least five years subsequent to the filing of the plat; and that all owners of the property abutting upon the portion of the street to be vacated have filed with the City Council their written consent to such abandonment and that public interest and welfare will not be adversely affected by the abandonment of such street. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, RKANSAS: Section 1. The City of Fayetteville, Arkansas, hereby releases, vacates, and aband- ons all rights, together with the rights of the public generally, in and to Vinson Street designated as follows: Commencing where Vinson Street intersects with North Sequoyah Drive on its West sid thence Northwest to where said Vinson Street intersects with Maple Street, all of which being located in the East -Mountain Addition to the City. of Fayetteville. Section 2.A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded on the deed records of the County. Section 3. This ordinance shall take effect and be in force from and after its passage. Five small ex ensions on sewer 1 nes, n gotia- t the pt rchase 9f s9wer line on Ea4t Maple r.Raymond Nelson from the University of Arkansas Planning Board explained some amendment to the proposed Subdivision Regulations and after a long discussion, Alderman Barnhart moved to place the proposed ordinance for'Subdivision Regulations on its first reading. The motion was seconded by Alderman Lunsford and upon roll call the following vote was recorded: "Aye" Barnhart, Smith, Burgin, Lunsford, McClelland, and Kent. "Nay" Hatfield. There being six "Ayes" and only one 'Nay", the Mayor declared the motion passed. The ordinance was then read for the first time but no further action was taken and the Ordinance was left on its first reading. Mr. Charles H. Withey appeared before the Council and outlined some of the functions anc expenses of the Civil Defense Program but no definite action was taken at this time. The Mayor reported that Mr. W. B. Putnam had resigned from the Planning Commission and he recommended that the Council appoint Mrs. Samuel Siegel to this vacancy. Alderman Kent moved to accept the resignation of W. B. Putnam from the City Planning Commission and to appoint Mrs. Samuel Siegel to fill this vacancy, her term expiring January 1, 1962. The motion was seconded by Alderman Burgin and passed unanimously. The Cit Engineer reported that fiveLsmal]_Csewer'�extensions were needed. in various part of the ity and that he and the Sewer Committee recommended thgt these extensions be me After a lengthy discussion, Alderman Burgin moved to authorize the Engineer to prepare plans and specifications and to take bids on four (4) small sewer extensions and alternate bids on the fifth and the sewer work proposed by Harry Jackson in Jackson's First Addition, to be included as an alternate item with this work. The motion was seconded by Alderman Lunsford and passed unanimously. Alderman McClelland then moved to negotiate to purchase the remaining equity of a priva owned sewer main on East Maple Street between Fallin Avenue and Sequoyah Drive at a cos not to exceed Nine Hundred ($900.00) Dollars. The motion was seconded by Alderman Lunsford and passed unanimously. There being no further business, Alderman Lunsford moved to adjourn. S. Mail and by telephone except Aldermen Barnhart and Walker who were out of the City and could not be notified in time for the meeting; However they waived notice of the meeting. T. Kellog, Chief Sanitary Engineer with the Arkansas State Board ofl nspect. Health, in which he requested that the City of Fayetteville make regular plumbing inspec - ol all ions of the County, State, and Federal Buildings or run the risk of his ordering the County, removal of the"State Board of Health Water Approved" signs now being displayed by the State, City. &Federal A long discussion was had during which the City Attorney stated he questioned the legali y Bldgs. of the City inspecting the Federal, County, and State Buildings. ,• The Water Superintendent suggested that the City adopt a set of rules requiring plumbing inspection of all buildings using city water.
