A iCITY CR The City Council of Fayetteville, Arkansas, met in regular session on Monday, July 11, ular 19602 at 7:30 P.M. ing. Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney A. -D. McAllister Jr., City Engineer W. C. Smith, Chief of Police Pearl Watts, and Aldermen: Barnhart, Smith, Burgin, Lunsford, McClelland, Hatfield, and Kent. Absent: Fire Chief Burl Skelton and Alderman Bryan Walker. The minutes of the regular meeting on Monday, June 27, 1960, were read and approved. Discussion A long discussion was had concerning the repairing of the streets which had been cut an on torn up by the Sewer Contractors (Forsgren Brothers) during the construction of the sew S rest lines in the City. 1. Rk air. Forsgren Bros. had included the cost of repairing the streets in their contract and to repair them in such a manner as"to leave them in as good shape as before being cut or broken for the sewer lines. The Mayor reported that Forsgren Bros. had agreed to pay the City the amount allowed in their contract which was $3.70 and $4.00 per cubic yard for the repair work and that th City could do the necessary repair work with this money. No action was taken at this time but Alderman McClelland reported that he wished to go Objections record as being opposed to the action being taken by the City on repairing city streets of and the City's Street Program (both of which are being done without City Council approv Alderman as follows: 1� McClelland 1. Taking over the repair of street cuts made.by the sewer contractor, which may, in on Street effect, release the contractor from maintaining streets for one year as required by the pr gram contract. 2. The paving of any and all City Streets for 60¢ per property foot without first establishing "Truck prohibited"areas. 3. The proposal by the City to furnish concrete curb and gutter for $1.00 per proper foot with no thought being given to first establishing a design standard and at least minimum plans and specifications to insure installations of good quality. Also objected to is the proposed use of a steel wheel, self -powered roller, belonging to the City, fo compacting fills prior to installation of curb and gutter. Such a machine is not design for, and will be abused by such usage, in addition to the fact that compaction in deep fills can never be obtained with it. 4. The use of City forces and equipment to surface private driveways and parking lot This places a Municipal Government in direct competition with private enterprise, and i objected to on this basis. 41 1 Petitio Vera Nol and Resolutio pertainin theret Resolu 12-60 he City Clerk again presented the petition of Vera Noll Lewis to close that part of of Finson Street between Maple Street and North Sequoyah Drive which had been approved by Lewin he Planning Commission. e City Attorney read a proposed resolution setting a date, time, and place for a publi caring on this petition and instructing the City Clerk to cause notice to be published f this hearing and to obtain an abstractor's Certificate of Title. lderman Smith moved the Resolution be adopted. he motion was seconded by Alderman Kent and passed unsn imously, whereupon the Mayor eclared the Resolution adopted. RESOLUTION 12-60 on WHEREAS, it appears that the petition of Vera Noll Lewis, to vacate and abandon a portion of Vinson Street as described below; Commencing where Vinson Street intersects North Sequoyah Drive on its Westside thence Northwest to where said Vinson Street intersects with Maple-Strect, all of which being located in the East Mountain Addition to the City of Fayetteville. as filed with the City Clerk on the 14th day of June, 1960, and WHEREAS, it appears that said petition was duly approved by the City Planning Com- ission of the City of Fayetteville, Arkansas, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, RKANSAS: Ardhibald�Yell Subdivision Plat. Ordinanc No. 1240 1. That the 25th day of July, 1960, be and the same is hereby fixed as the day set r hearing upon said petition. 2. ' fter a brief "discussion, the City Attorney introduced and read a proposed ordinance in is entirety entitled, "AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL STREETS LLEYS AND EASEMENTS IN.ARCHIBALD YELL SUBDIVISION TO THE CITY OF FAYETTEVILLE, ARKANSAS lderman Smith moved that the rules be suspended and the ordinance placed on its second. eading. he motion was seconded by Alderman Burgin and passed unanimously. he ordinance was then read for the second time. lderman Smith than moved that the rules be further suspended and the ordinance placed n its third and final reading. he motion was seconded by Alderman Lunsford and passed unanimously. he ordinance was then read for the third and last time. he Mayor then dec]a red the ordinance open for discussion. There being no discussion, he Mayor asked the question, "Shall the Ordinance pass"? pon roll call the following vote was recorded, "Aye" Barnhart, Smith, Burgin, Lunsford, cClelland, Hatfield, and Kent. "Nay" None. here being seven "Ages" and no "Nays", the Mayor declared the ordinance passed. ORDINANCE NO. 1240 N ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL STREETS, ALLEYS AND EASEMENTS RCHIBALD YELL SUBDIVISION TO THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, there has been duly presented to the City Council of the City of Fayette- ville, Arkansas, a plat dated May, 1960, known as Archibald Yell Subdivision to the City of Fayetteville, Arkansas, and being.a part of the East Half (E2) of the Northeast Quarter (NE 4) of Section 21, Township 16 North; Range 30 West of the Fifth Principal Meridian, by which the owners of the platted real estate have dedicated for the public use the streets, alleys, and easements shown upon said plat; and WHEREAS, the City Planning Commission of the City of Fayetteville, Arkansas, has recommended the acceptance of said plat. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City of Fayetteville, Arkansas, hereby accepts and confirms th dedication of all streets, alleys, and easements, dedicated in Archibald Yell Subdivisi to the City of Fayetteville, Arkansas, and hereby declares said streets, alleys and easements to public streets, alleys, and easements, and the said City Council hereby assumess the care, control and jurisdiction of the same. Dated this 18th day of July, 1960. Consulting Engineer John E. Mahaffey appeared before the Council and reported that the FAA had approved the plans and specifications and that it was necessary for the City to take immediate action in regard to the completion of the improvements at the Municipal Airport in order to obtain Federal Matching Funds. After a brief discussion, Alderman Lunsford moved that the City Clerk be and he is hereb authorized to advertise for bids on July 191and July 26, 1960, and to receive sealed bide at 3:00 P.M. CST. on August 2, 1960, at a special meeting of the City Council of Fayetteville, Arkansas, said bids being for completion of Municipal Airport Improvement Project and contract will be awarded contingent on approval by the:Federal.Aviation Agency for the proposed improvements.
