The City Council of Fayetteville, Arkansas, met in regular session on Monday, October
1959, at 7: 30 P. M.
Present: Mayor J. Austin Parish, City Clerk George J. Davis, City Controller Albert J.
Jones, City Attorney A. D. McAllister Jr., City Engineer W. C..Smith, Chief of Police
Pearl Watts, Fire Chief Burl Skelton, and Aldermbn: Barnhart, Smith, Lunsford, McClell
Hatfield, Kent, and Walker.
Absent: Alderman Ellis Burgin.
Mr. J. K. Gregory appeared before the Council with a proposal to lease a lot, located
Parking on the Northeast corner of the intersection of Highway 62 West and Gregg Avenue, to the
otlfor City for a parking lot for City Employees, for a period of five years, rent free, begin:
Shop January 1, 1960, provided the City would do the grading and other necessary improvemen
Employees, for a parking lot.
Alderman Walker moved to accept the proposal of Mr. Gregory and lease the lot at the
Northeast corner of the intersection of Highway 62 West and Gregg Avenue, rent free for
a period of five years, beginning January 1, 1960, and that the City make the improveme:
as outlined by Mr. Gregory.
The motion was seconded by Alderman Smith and passed unanimously.
Ordinance The City Engineer introduced and read in its entirety a proposed ordinance entitled,
No. 1219 AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE ST. LOUIS -SAN FRANCIS
RAILWAY COMPANY AND THE CITY OF FAYETTEVILLE, ARKANSAS, COVERING THE EXCAVATING FOR LAYI
CONSTRUCTION, MAINTAINING, OPERATION AND REPAIRING OF CERTAIN WATER MAINS AND/OR WATER
LINES CROSSING UNDER THE RIGHT OF. WAY AND TRACKS OF SAID RAILWAY COMPANY" ,
Alderman Kent moved that the rules be suspended and the ordinance placed on the second
Reading. The motion was seconded by Alderman Lunsford and passed unanimously.
The ordinance was then read for the second time.
Alderman Smith moved that the rules be further suspended and the ordinance placed on its
third and final reading.
The motion was seconded by Alderman Kent and passed unan imouslyv
The ordinance was then read for the third and last time.
The Mayor then declared the ordinance open for discussion. There being no discussion, th
Mayor asked the question, "Shall the Ordinance pass"?
Upon roll call the following vote was recorded, "Aye". Barnhart, Smith, Lunsford, McClell
Hatfield, Kent, and Walker. "Nay" None.
There being seven "Ayes" and No "Nays", the Mayor declared the ordinance passed.
Alderman Kent then moved that the emergency clause be ado*ted. The motion was seconded b
Alderman McClelland and passed unanimously, whereupon the Mayor declared the emergency
clause adopted.
ORDINANCE NO. 1219
AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE ST. LOUIS = SAN FRAN-
CISCO RAILWAY COMPANY AND THE CITY OF FAYETTEVILLE, ARKANSAS, COVERING THE EXCAVATING FO
LAYING, CONSTRUCTION, MAINTAINING, OPERATION AND REPAIRING OF CERTAIN WATER MAINS AND/O
WATER LINES CROSSING UNDER THE RIGHT OF WAY AND TRACKS OF SAID RAILWAY COMPANY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVIDLE, ARKANSAS:
SECTION 1. That the Mayor, J. Austin Pariah, and City Clerk, George J. Davis, be ar
they are hereby authorized to execute agreements with the St. Louis -San Francisco Railws
Company dated October 15, 1959 and October 169 1959 covering the excavating for, laying,
construction, maintaining, operating, and repairing of water mains and/or water lines
crossing under the right of way and tracks of said railway company, said crossings to be
at the following described locations:
An eight (8) inch water main crossing of the St. Louis -San Francisco 'Railway Compa
right of way at Sycamore Street in the City of Fayetteville, Arkansas, said crossi
being also described by St. Louis -San Francisco Railway Company as Milepost 351 pl
9 poles plus 91 feet.
A six (6) inch water main crossing of the St. Louis -San Francisco Railway Company
right of way at Cato Springs Road in the City of Fayetteville, Arkansas, said cross
being also described by St. Louis -San Francisco"Railway Company as Milepost 353
plus 24 poles.
A one (1) inch water line crossing of the St. Louis -San Francisco Railway Company
right of way near the Fayetteville Municipal Airport (located approximately four
miles South of the present corporate limits of the City of Fayetteville, Arkansas)
said crossing being also described by St. Louis -San Francisco"Railway Company as
Milepost 357 plus 10 3/4 poles.
SECTION 2. That all ordinances and parts of ordinances in conflict with this ordin
are hereby repealed and this action being necessary for the public health, safety, orde
comfort and convenience within the City of Fayetteville, Arkansas, anAemergency is here
declared to exist and this ordinance shall be in full force and effect from and after i
passage and approval.

Lake Wilson Alderman McClelland reported that since Lake Wilson was no longer a water.supply for the
transferred to City of Fayetteville, the Water Committee had recommended that the operation and mainten
Parks Committee.°nce of Lake Wilson be transferred to the Parks Committee.
Alderman McClelland moved to accept the recommendation of the Water Committee and

ransfer the operation and maintenance of Lake Wilson and the 320 surrounding acres to
the Parka Committee.
The motion was seconded by Alderman Hatfield and passed unanimously.
Alderman Hatfield moved to call a public meeting on Thursday, October 29, 1959, at 7:30
P. M. to discuss the proposed Airpmrt, Library, and Hospital Bond Issue.
The motion was seconded by Alderman Smith and passed unanimously.
Alderman Walker was excused from the meeting at this time.
Rules an Regulations Alderman McClelland moved, seconded by Alderman Barnhart and passed unanimously, that
Governing the Fishing & Boating Rules and Regulations for Lake Fayetteville, be amended to include
Lake Sequoyah and under authority contained in Fayetteville City Ordinances No. 966 and
Fishing &
Fish1218 that the Rules and Regulations governing Fishing and Boating on Lake Fayetteville
City Boating on Lakes and take Sequoyah be adopted to read as follows:

Lake Fayetteville and Lake Sequoyah are Municipal Water Supplys. Fishing and Boating
re permitted providing they are carefully regulated. Your cooperation in this respect

3. FISHING-- All fishing must be done from the Lake Bank or from a boat. No WADING
or SWIMMING SHALL BE PERMITTED at any time.
All persons, including persons under 16 years of age, must sign the daily register
located in the Lake Office before fishing.
I No goldfish or other species of carp shall be used for bait when fishing in Lake
Fayetteville.
Limits and size of fish shall conform to State Laws.
All persons under 16 years of age, even though they are not required to purchase a
hing permit, will comply in all respects to the remainder of the Rules and Regulation
forth herein.
4. BOATING-- All persons MUST SIGN the daily register located at Lake Office before
ng any boat on Lake Fayetteville or Lake Sequoyah.
A boating permit for each boat must be purchased before its use on either Lake.
All boats must be docked at the boat landing at sunset. NO BOATS EXCEPT those used
Lake employees WILL BE DOCKED AT ANY OTHER LOCATION ON THE LAKE.
5. PLACE OF ENTRY-- All persons are warned to enter the lake ONLY through the entr-
e at the Lake Office. Persons entering the Lake Property from any other location shal
considered trespassing and subject to prosecution.
6. USE OF MOTORS ON BOATS.== In the event that motors are used on boats, the boats
be operated in such a manner that they will not endanger other boats or the occup-
thereof and shall not be operated in such a manner as to cause heavy waves causing
erosion of the shoreline.
Speeding and Boat racing is not permitted and each out board motor operator is
autioned to operate his motor in a safe and cautious manner. Failure to abide by this
egulation will cause loss of boating permit. The Lake Caretaker shall revoke the boat
ermit of any boat which in his judgment is not safe for use or which is overloaded.
No boats will be permitted within 500 feet of the spillway on Lake Sequoyah.
No house boats will be permitted on either lake at any time.
Facilities for docking or landing of boats will be provided, however, the City of
tteville will not be responsible for any damage or theft of boats, motors, or any
pment left in boats or at the docks.
All State Laws governing boats must be complied with before using a boat.
7. PICNICKING AND OTHER RECREATIONAL ACTIVITY -- No picnicking or other activity,
xcept boating and fishing, shall be permitted on any part of Lake Fayetteville and Lake
equoyah or the land surrounding the Lakes which is controlled by the City of Fayetteville.
8. COMMITTING NUISANCES-- No person shall commit any nthisance while on Lake Fayett
ille and Lake SegVoyah or any of the lands surrounding the Lakes belonging to the City
f Fayetteville, Arkansas, nor shall any refuse, trash, or other materials be thrown in
he Lakes or left about the shore line or on the premises of either lake.

10. FISHING ON STREAM BELOW DAM. -- State laws governing fishing below dams shall be
pplicable on City Property. Fishing Permits are required to.fish in the stream on City
roperty below the dams.
11. FIREARMS AND HUNTING. -- No firearms or hunting will be permitted on City Owned
roperty at any time.
12. REVOKING PERMITS. -- The City of Fayetteville reserves the right to revoke any
ermit when by action of any person holding a permit in which it is clearly demonstrated
hat said person willfully and purposely violated any of these rules and regulations.
hen a permit is revoked, no refund will be due the holder of the permit.
13. RESCINDING FORMER RULES and REGULATIONS. -- Upon adoption of these Rules and
egulations governing fishing and boating on Lake Fayetteville and Lake Sequoyah and the
roperty owned by the City of Fayetteville surrounding Lake Fayetteville and Lake Sequoy
y the City Council of the City of Fayetteville, Arkansas, all previously adopted rules
or this purpose shall be rescinded.

on this 26th day of October, 1959.

ission regarding the clothing and automobile allowance for the Chief of Police.

Chief of I have been authorized as.chairman of the Civil Service Commission of the City of
Police Fayetteville to inform you that the Civil Service Commission at its last meeting recomme
salary, to the City Council that the allowances for automobile and clothing which are now allowe
the Chief of Police be dis-allowed and that this amount of money be added to his salary.
We feel that this is of the utmost importance and wish that it would be taken care
in the near future.

At this time, we also feel that a complete examinationh,{th the thought in mind.,of
increasing the salaries of all of the uniformed employees of the City of Fayetteville.
