Edd Connell appeared before the Council with an option to purchase a tract of land e new lake area known as the Eastman-Stokenbury Tract for $1800.00. ter a brief discussion, Alderman McClelland moved to exercise the option and purchase tract of land at the new lakesite known as the Eastman-Stokenbury Tract, shown on the p as Tract E-1, containing 9 acres, more or less, for the total sum of Eighteen Hundr 1800.00) Dollars, with no reservations whatsoever.(from Russell Crose and Emma L. Cro e motion was seconded by Alderman Barnhart and passed unanimously. I- The City Attorney then read a proposed Anti -Noise Ordinance entitled,"AN ORDINANCE PROHIE e ITING THE USE OF LOUD SPEAKERS, AMPLIFIERS, OR OTHER DEVICES FOR PRODUCING OR REPRODUCINC finance. SOUNDS FOR THE PURPOSE OF COMMERCIAL ADVERTISING OR ATTRACTING ATTENTION; PROVIDING PEN- ALTIES THEREFOR; AND FOR OTHER PURPOSES" After a lengthy discussion, Alderman McClelland moved that the ordinance be passed. The motion was seconded by Alderman Smith and passed unanimously, whereupon the Mayor declared the Ordinance passed. Alderman Lunsford then moved that the emergency clause be adopted. Holway & Associates for plans paid for and specifications for the Mt. Sequoyah Chemical Building as per contract. plans & motion was seconded by Alderman Walker and passed unanimously. City Mr. Webb Williams and others appeared before the Council in regard to the City's taking library over the operation of the City Library, at once, and requested that the Mayor make taken immediate appointments of Library Trustees as outlined by Arkansas Statutes, and that the over. The motion was seconded by Alderman Barnhart and passed unanimously. The Mayor then recommended that:the'.fbllowing five men be appointed as Library Trustees for the Fayetteville City Library: Mr. Ted Wylie, Mr. Webb Williams, Mr. E. Leighton Rudolph, Mr. Ellis Shelton, and Mr. 0. W. McMillan. Alderman Smith moved to accept the recommendation of the Mayor and appoint the five men I entioned above as Library Trustees of the Fayetteville City Library, effective immediate The motion was seconded by Alderman Kent and passed unanimously. T Ord. No. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: 12111 Section 1. That the following acts, are hereby declared to be loud, disturbing and unnecessary noises and in violation of this ordinance, to -wit: A. Loud�Speakers, Amplifiers for Advertising. The using, operating or permitting to be played'; Ased, or operated, of any radio receiving set, musical instrument, phonograph loudspeaker,"sound amplifier, or other machine or device for the producing or reproducin of sound which is cast from a point of origin located on private property upon the public streets for the purpose of commercial advertising or attracting the attention of the public to any building or structure. ' Section 2. That any person, firm or corporation violating the provisions of this ordinance shall be deemed guilty of a misdemeanor and uponconviction thereof shall be fined in any sum not less than $1.00 nor more than $25.00 and each day that such violati continues shall constitute a separate offense and shall be punishable in an amount not less than $1.00 nor exceeding $15.00 per day. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby rep -1 Baled and it appearing that the making, creation or maintenance of such loud, unnecessary, unnatural or unusual noises which are prolonged, unusual and unnatural in their time, plice and use affect and are a detriment to the public health; comfort, convenience, safety, welfare and prosperity of the resident citizens of the City of Fayetteville, Arkansas, emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval. HammondlSt. & Alderman Smith moved to authorize the Mayor to have a street light installed at the Viewpoint intersection of Hammond Street and Viewpoint Drive; also one at the intersection of Dr. Garland Avenue and Pettigrew Street. ( This light had been authorized on Dec.222 1958) Pettigrew St. The motion was seconded by Alderman Burgin and passed unanimously. & Garland Ave. Alderman McClelland read a proposed resolution whereby the City could furnish water to suburban water districts. Resolu ion Alderman Lunsford moved that the resolution be adopted. Water Distj RESOLUTION 11-59 WHEREAS, on January 239 19562 the City Council foreseeing a possible water shortage for the city water system unless adequate measures were undertaken to remedy the supply, treatment and distribution of said system, passed a resolution which prohibited any additional water mains being extended outside the corporate limits of Fayetteville, and WHEREAS, since January 23, 1956, definite and adequate measures have been instituted to improve said deficiencies in the water system, which measures will be completed about January 1, 1960. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: That beginning January 12 1960, legally organized suburban water districts or municipalities may be furnished water from the Fayetteville Water Supply on terms and under contracts acceptable to the City of Fayetteville, Arkansas. That said Resolution passed and approved on January 23, 1956, is hereby rescinded. PASSED AND APPROVED_THIS 27th day of July, 1959.
