Absent: Chief of Pol&ce Pearl Watts, and Fire Chief Burl Skelton. derman Barnhart introduced and read an ordinance entitled,"AN ORDINANCE CREATING THE Traffic OFFICE OF TRAFFIC CLERK OF THE CITY OF FAYETTEVILLE, ARKANSAS, PRESCRIBING DUTIES, FIXING Clerk §ALARY, AND FOR OTHER PURPOSES". Ordinance No. After a brief discussion, Alderman Burgin moved to amend the first section of the ordinance 1207 to read,"1. That there is hereby created the office of traffic clerk whose salary shall be fixed by the City Council". The motion was seconded by Alderman Walker and passed unanimously. Alderman Walker then moved that the ordinance be passed. The motion was seconded by Alderman Burgin and passed unanimously, where{dpon the Mayor declared the ordinance passed. ORDINANCE NO. 1207- �N ORDINANCE CREATING THE OFFICE OT TRAFFIC CLERK OF THE CITY OF FAYETTEVILLE, ARKANSAS, PRESCRIBING DUTIES, FIXING SALARY, AND FOR OTHER PURPOSES; AS AMENDED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS 1. That there is hereby created the office of traffic clerk whose salary shall be fixed by the City Council. . That the traffic clerk shall be appointed by the Mayor subject,however, to the consent and approval of the Fayetteville City Council. That the traffic clerk shall exer- cise the powers and duties as provided in this ordinance and in addition thereto shall perform the duties of municipal court clerk as is now or shall hereafter be prescribed y law. 3. The traffic clerk shall assist the Judge of the Fayetteville Municipal Court with the clerical work of traffic cases. The office of the traffic clerk shall be open from 9: o'clock A.M. until 12:00 Noon and from 1:00 o'clock P.M. until 5:00 o'clock P.M. on Monde through Fridays and from 9:00 o'clock A.M. until 12:00 o'clock Noon on Saturday each weed except upon legal holidays. 4. The Judge of the Fayetteville Municipal Court shall designate the specified Offent nder the traffic ordinances of this city and the state traffic laws in respect to which syments of fines may be accepted by the traffic clerk in satisfaction thereof, and shal] pecify by suitable schedules the amount of such fines for first, second, and subsequent ffenses, provided such fines are within the limits declared by law or ordinance, and she urther specify what number of such offenses shall require appearance before the Municipe udRe and the required amount of bail for such offenses. 5. Any person charged with an offense for which payment of a fine may be made to the raffic clerk shall have the option of paying such fine within the time specified in the otice of arrest to the traffic clerk upon entering a plea of Fuilty and upon waiving ppearance in court; or may have the option of depositing required lawful bail and upon C 2 x • • 4091 plea of not guilty shall be entitled to a trial as authorized by law. The payment of a • fine to the traffic clerk shall be deemed an acknowledgment of conviction of the al]e ged I ffense, and the traffic clerk,, shall.issue a receipt to the violator acknowledging pavment thereof. 6. The following duties are hereby imposed upon the traffic clerk in reference to traffic offenses (a) He shall accept designated fines, issue receipts, and represent in court such violators as are permitted and desire to plead guilty and waive court appearances. (b)He shall receive and issue receipts for cash bail from the persons who must or wish to be heard in court, enter the time of their appearance on the court dicket, a notify the arresting officer and witnesses, if any, to be present. (c) He shall keep an easily accessible record of all violations of which each per son has been guilty during the preceding 12 months, whether such guilt was establish in the court or by plea of guilty, waiver of appearance and payment of fine to the traffie'clerk. (d) He shall keep records and submit summarized monthly reports to the Judge of t Fayetteville Municipal Court of all notices issued and arrests made for violations of Ithe traffic laws and ordinances of this city and of all the fines collected by him, a f the final disposition or present status of every case of violation of the provisions said laws and ordinances. Such records shall b)e so maintained as to show all types of violations and the totals of each. Said records shall be public records. 7. The traffic clerk shall exercise the powers and duties as provided in this ordinance nd in addition thereto shall perform the duties of Clerk of the Fayetteville Municipal ourt as same are now prescribed by Sections 22:-713 and 22-719 of Arkansas Statutes of 947, Annotated, or as shall hereafter be prescribed by laws. 8. The traffic clerk,. before entering upon the duties of said office, shall make and le with the City Clerk a good and sufficient bond for the faithful performance of his ties as traffic clerk and as 81erk of the Fayetteville Municipal Court in the sum of ,500.00; said bond to be approved by the City Council and the premium therefor, if a rety bond be approved, to be charged as an expense of operating said municipal court. 9. That Ordinance No. 1134 is hereby repealed as well as all other ordinances or parts of ordinances in conflict herewith. DATED THIS 23rd day of Oune, 1959. Austin Parish, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney A. D. McAllister Jr., City Engineer W. C. Smith, and Aldermen: Barnhart, Smith, Burgin, Lunsford, McClelland, Hatfield, Kent, and Walker. Absent: None. The Mayor reported that the purpose of the meeting was to receive and open bids for the purpose of second and last section of Water Main Extensions of the 1958 Water and Sewer Expansion meeting. Project and that all members had been notified by U. S. Mail and by oral announcement at the regular council meeting on Monday, June 22, 1959. The bids were opened by the City Clerk and read by Consulting Engineer L. M. McGoodwin, Bids opened. The Mayor then declared the meeting in recess while Consulting Engineers John Mahaffey • and L. M. McGoodwin made a complete tabulation of the bids. Upon reconvening, Engineer McGoodwin reported they had not completed a tabulation of al 'the bids but a tabulation of the bid of Danco Construction Co., North Little Rock, Arkansas, for the sup pf $216,912.25 was complete and was the low bid according to the quotations from the other bidders.
