The City Attorney then read a proposed ordinance entitled,"AN ORDINANCE VACATING AN Ord. 1198 ALLEY RUNNING EAST AND WEST BETWEEN LOTS THIRTEENSN(13) AND FOURTEEN (14) IN BLOCK NUMBEI (Abandon ELEVEN (11) IN MOUNTAIN VIEW ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS" Alley) Alderman Hatfield moved that the Ordinance be passed. The motion was seconded by Alder- man Smith and passed unanimously, whereupon the Mayor declared the Ordinance passed. ORDINANCE NOa 1198 AN ORDINANCE VACATING AN ALLEY RUNNING EAST AND WEST BETWEEN LOTS THIRTEEN(13) AND FOUR- TEEN (14) IN BLOCK NUMBERED ELEVEN (11) IN MOUNTAIN VIEW ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, a petition was duly filed with the City Gbuncil of the City of Fayetteville, Arkansas, on the 16th day of February, 19590 asking the City Council to vacate and abandon an alley running East and West between Lots Thirteen(13) and Fourteen (14) in Block Numbered Eleven (11) in Mountain View Addition to the City of Fayetteville, Arkansas, and WHEREAS, after due notices as required by law, the City Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the portion of the alley hereinavove described has heretofore been dedicated to the public use as an alleys has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting on the portion of said alley sought to be vacated have filed with the City Council their written consent to said abandonment; and that public interest and welfare will not be adversely affected by the abandonment of said alley. NOVI, THEREFORE,. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vacates, and abandon; all its right, together with the rights of the public generally, in and to the alley running East and West between Lots Thirteen (13) and Fourteen (14) in Block Numbered Eleven (11) in Mountain View. -Addition of the City of Fayetteville, Arkansas. SECTION 2. A copy of the Ordinance duly certified by the City Clerk shall be filed it the office of the Recorder of the County,, and recorded in the Deed Records of the jCounty. SECTION 3. Engineer W. N. Holway appeared before the Council and presented plans and specification for the power line and substation for the new dam andpump station, on White River nort. of Baldwin, Arkansas. (This is known as contract No. 4) e After discussion, Alderman Kent moved to approve and accept the plans, specifications, and recommendations of Engineer W. N. Holway and to authorize the City Clerk to publish notice in the Northwest Arkansas Times Newspaper of F9yetteville, Arkansas, a notice to bidders that sealed bids for the construction of a 32 mile power line and the erection of a substation,will be received by the City Clerk of Fayetteville, Arkansas, up to 3:00 o!clock P; M. CST, May 263 1959, then opened and publicly read at a meeting of the City Council of Fayetteville, Arkansas, at which time the contract will be let accordin to plans and specifications furnished by Engineer W. N. Holway. The motion was seconded by Alderman Walker and passed unanimously, The Mayor reported that the plans and specifications for the Sewage Disposal Plant and roved Sewer Pump Stations have been approved by the U. S. Health Dept., and that Engineer Marion L. Crist requests approval of setting the receiving and opening of bids for Tuesday, May 26, 1959, at 3:00 O'clock P. M. Alderman Smith moved to approve the recommendations of Engineer Marion L. Crist and to d authorize the City Clerk to publish notice in the Northwest Arkansas Times Newspaper of P Fayetteville, Arkansas, a notice to bidders that sealed bids for the construction of Lift Stations and Sewage Tpeatment Facilities will be received by the City Clerk of Fayetteville, Arkansas, up to 3:00 O'clock P. M. CST., May 26, 1959, then opened and 392 z licly read at a meeting of the City Council of Fayetteville, Arkansas, at which time contract will be let according to plans and specifications furnished by Engineer ion L. Crist. motion was seconded by Alderman Walker and passed unanimously. Engineer W. K. Holway reported that a first class storage building and laboratory could ge Ibe bdtilt at the Mt. Sequoyah Filter Plant for approximately $709000.009 and he recommend the construction of this building. After a long discussion, Alderman Hatfield moved to authorize Engineer Holway to prepare story.'lans and specifications for a building to be erected at the Mt. Sequoyah Filter Plant t provide storage for car load and truck load shipments of chemicals and to have chemical feeders and chlorinators and a laboratory for water testing purposes,.at an estimated cost of approximately $700000.00. The motion was seconded by Alderman Barnhart and passed unanimously. Engs. Engineers J. E. Mehaffey and L. M. McGoodwin appeared before the Council and presented a to'proceedeport, in the form of a map and letter, outlining the remainder of the work originally with proposed for the Prater Distribution Program. They pointed out that total outstanding prepe obligations against this portion of the work is 0825,000.00 and that work remaining to b( plans to one is estimated at a cost of $233,000.00. This makes a total estimated construction co; complete of $1,058,000.00, which is $42,000.00 less than the original estimate of $1,100,000.00 w ter Ifor which funds were provided. dist. After a long discussion, Alderman Hatfield moved that the engineers be authorized and instructed to proceed with preparation of plans and specifications for the remainder of the work and that the plans provide for dividing the work into three sections. That revenues from all parking lots, both now in existence and future planned to be collected under the Business Office control in order to insure accurate accounting records on each lot. This is especially important in view of the fact that many of the lease contracts and other agreements are dependent upon such revenues. 2-. That an electric driven coin sorter and an electric driven coin counter and packager be purchased for use of the Business Office in carryingout the above work. These two machines can be purchased for approximately 69®'.00 total cost. 3. That the revenues from the street meters continue to be sorted and counted by the Iank as has previously been done. 4. That the meter repairman be given a monthly car allowance of $25.00 for use of his personal car in connection with the proper maintenance of the meters. IHe mak8s many trips daily to the Dickson Street area in order to repair and remove bad coins. . That all street meter coin box reventes be collected each week for accurate accounts ecords. 6. That all keys to the coin box compartments be placed in a metal box and kept in the Business Office safe, and that a key register be maintained showing the disposition of each key when checked out, or the destruction of any worn out keys. That no such keys be kept out of the safe for more than 10 hours ari any one time. There being no further business, Alderman Burgin moved to adjourn. Whitfield, to be used as a arking lot for the City of Fayetteville, Arkansas, e further stilted that the Merchants Parking Association would endorse an agreement simi ar to the ones it has already made with the City on the lots on Rock Street and East venue, and that the understanding was that this lot is 117 feet x 104 feet, would park 6 cars, and that the owner would raze the building to the foundation and tease the roperty for a period of 25 years beginning March 1 1960p for the sum of $2400.00 per ear plus taxes (which now amount to $410.70 , wit)¢ an option to purchase for the sum of 35,000.00* fter a long discussion, Alderman Hatfield moved that the City accept the proposal of he Parking Lot Committee to acquire the Whitfield property located at the Northwest orner of the intersection of East Avenue and Meadow Street and to ask the Committee to xplore the possibility of acquiring the Mays Property on the North to be included in he proposal, he motion was seconded by Alderman Lunsford..and upon roll call the following vote was ecordeds "Aye" Barnhart, Smith, Lunsford, McClelland, Hatfield, and Kent.
