The motion was seconded by Alderman Lunsford and passed unanimously by the Council.

Alderman Williams then moved to approve plans and specifications on Contracts 1 (White
River. Dam) and 2 (Mt. Sequoyah Plant Additions) as presented by Engineer Holway and to
Plans & set November 20, 1958, at 3:30 P. M. as the date for Council Meeting to receive bids
Spec. approved for these two contracts.
The motion was seconded by Alderman Smith and passed unanimously, tt

Power for new Engineer We N. Holway reported that power to operate the machinery at the new dam could

S.W. EleIc. Southwestern Electric Power'Co., or Arkansas Western Gas Co., all of Fayetteville, Ark.
He recommended that the power be purchased -from the Southwestern Electric Power Co. of
Power Co. Fayetteville, Arkansas, as it would be cheapest to o erate"over a 30

the rates offered by them.
Alderman Hatfield then moved to accept the recommendation of Engineer W. N. Holway and
negotiate with the Southwestern Electric Power Co. of Fayetteville to purchase the powe

IThe minutes of the regular meeting on Monday, October 27, 1958, were read and approved.
Coffey / The City Clerk reported that he had received an oral report from the Sgcretary of the
Petition City,Planning Commission stating that the Planning Commission had rejected the petition
Rejected of Mr. J. G. Coffey for re3oning his property on Douglas Street between Lindell Avenue
and Garland Avenue.
Alderman Lunsford moved to table this petition until a written report was received from
Ithe Planning Commission.
The motion was seconded by Alderman Kent and passed unanimously.
The City Clerk then read a letter from the City Planning Commission in which they
recommended that the elevated water storage in the west part of the City be placed where
Elevated it will cause the least damage to the fewest people and that future aesthetic values and
Water I •future land use problems be given careful consideration.
•Storage A group of citizens,living in the -area of the proposed elevated water storage,;;appeared
discus ed.' before the Council and requested the Council to seriously consider building the elevated
!water storage at the second proposed site which is approximately 1700 feet west and
( 200 feet south of the first proposed site at the intersection of Center Street and Sang
Avenue. They stated that all necessary easement would be available to this point.
The City Clerk then read a letter from Mrs. Evangeline Archer in which she stated that
the original firstpproposed site was available.

Ws had hoped that the standpipe which the City needs could be located elsewhere
on the hill west of town. Since it seems this location is necessary, we are in
of the original site as being less detrimental to us.'
Mrs. Pratt, Mr. Archer, Mrs. Markham, Julian Archer, and Mr. Pennington share this
oint of view:. The original site will affect land immediately adjacent, but the alternat
ocation, farther west, would affect approximately sixty acres as to visibility,
he easement, although it would not be on our property, would destroy a buffer strip whi

Alderman Smith moved that the rules be suspended and that the ordinance be placed on its
second reading. The motion,was seconded by AldermanWilliams and passed unanimously.
The ordinance was then read for the second time.
}llderman Kent then moved that the rules be further suspended and the ordinance placed on
its third and final reading. The motion was seconded by Alderman Smith and passed unani-
mously, whereupon the ordinance was read for the third and last time.
The Mayor then declared the ordinance open for discussion.
There being no discussion,,.the Mayor asked the question,"Shall the Ordinance pass"?
Upon roll call the following vote was recorded, "Aye" Barnhart, Smith, Burgin, Lunsford,
Williams, Hatfield, and Kent. "Nay" None.
There being seven "Ayes" and no "Nays", the Mayor declared.the ordinance passed.
Aderman Kent moved that the emergency clause be adopted. The motion was seconded by
Alderman Williams and upon roll call the following vote was recorded, 'Aye" Barnhart, .
Smith, Burgin, Lunsford, Williams, Hatfield, and Kent. "Nay" None.
There being seven "Ayes" and No "Nays", the Mayor declared the emetgency clause adopted.

CERTAIN PUBLIC STREETS AND HIGHWAYS IN THE CITY OF FAYETTEVILLE, ARKANSAS, PRESCRIBING
REGULATIONS RELATIVE TO THE PARKING OF VEHICLES UPON SUCH PUBLIC STREETS AND HIGHWAYS;
PROVIDING FOR THE INSTALLATION, OPERATION, MAINTENANCE, SUPERVAO IRTAULALISNN AND OF
CONTROL FOR THE USE OF PARKING METERS; DEFINING AND PROVIDING _

N WHITE ADDITION TO THE CITY.OF FAYETTEVILLE, ARKANSAS.
WHEREAS, there is duly filed in the.office of the City Clerk of the City of Fayette
Ville, Arkansas, a plat of White Addition to the City of Fayetteville, Arkansas, being a
part of the Southwest Quarter of the Southwest Quarter., Section Eleven, and part of the
Southeast Quarter of the Southeast Quarter, Section 10, all in Township 16 North of Rang
30.West of the 5th Principal Meridian, in which plat the streets,.alleys and easements
shown thereon have been dedicated for public use as streets, alleys, and easements; and
WHEREAS, the City Planning Commission of the City of Fayetteville, Arkansas, has
recommended the acceptance of said plat.
NOW, THEREFORE, BE IT ORDAINED BY THE,CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
RKANSAS:
SECTION 1. That the City of Fayetteville, Arkansas, hereby accepts and confirms the
dedication of all streets, alleys and easements dedicated in White Addition.to.the City
of Fayetteville, Arkansas, and hereby declares said streets, alleys and easements, to be
public.streets, alleys, and easements, and the said City Council hereby assumes the care
control and jurisdiction of the same.
SECTION 2. That this ordinance shall take effect and be in force and effect from
and after its passage, approval and publication.

North Hiway The Ci=ty=Attorney reported that the appeal to the Arkansas Supreme Court in the case of
71 Water North Highway 71 Water Association and North Highway 71 Water Line vs The Uity of
Line Suit Fayetteville and Dr. Nolon Helstern had been dismissed and a stipulation of compromise .
settledand settlement had been approved by the attorneys of record for the parties to the suit
by the.. Washington Chancery Court and made apart of the record in the lower court.
The City Attorney explained that there were some procedural changes.in the final settlem
ent as authorized by the City Council at the last regular meeting but that the final

ettlement encompassed the essential matters set forth in the Council's prior motion
authorizing settlement.
The Mayor reported that the next regular Council Meeting would be held on Thursday,
November 20, 1958, at 3:30 P. M.
Mayor to Alderman Kent moved that the Mayor, City Attorney, and all Aldermen who wished to go,
attendl be authorized to attend.the Municipal League Meeting in Hot Springs, Arkansas, on
