'lderman Williams moved that the Ordinance be passed. The motion was seconded by
Alderman Lunsford and passed unanimously,, whereupon the Mayor declared the Ordinance

Engineer I he City Engineer reported that he had investigated the flooded conditions near the
recommended intersection of Holly Street and Oakland Avenue and found that the drainage area of the
2 30"tile (Bitch in question is approximately 50 acres and that the natural drainage over the area
on Oakland, has never been materially changed.
e recommended that the ditch be cleaned of all obstructions and that all culverts on
Oakland Avenue have -the minimum capacity and sine of two 30" culvert tiles. He further
stated that he believed that when these conditions were met, flood probabilities will
be greatly lessened.
The City Clerk then presented a prat from Mr. & Mrs. A. B&. McConnell, approved by the ity Planning Commission of Fayetteville, which was a replat of Lot 9, Crestwood Beres, ddition to the City of Fayetteville, Arkansas.
WHEREAS, there is duly filed in the office of the City Clerk of the City of Fayette
ille, Arkansas, a replat of Lot 9 of Crestwood Acres Addition to the City of Fayettevil

WHEREAS, said replat was duly approved by the City Planning Commission of the City

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
RKANSAS:
SECTION 1: That the City of Fayetteville, Arkansas, hereby accepts and confirms the
dedication of all streets, alleys and easements dedicated in the replat of Lot 9 in
Crestwood Acres Addition to the City of Fayetteville, Arkansas, being part of the
Northeast Quarter (NE 1/'4) of the Southeast Quarter (SE 1/,4) of Sectio 10, Township 16
North of Range 30 West of the 5th Principal Meridian, and hereby declares said streets,
alleys and easements to be public streets, alleys and easements; and the said City
Council hereby assumes the care, control and jurisdiction of same.
SECTION 2: That this ordinance shall take effect and be in force and effect from
after its passage, approval and publication.
PASSED AND APPROVED this 28th day of July, 1958.

AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT.BETWEEN THE ST, LOUIS -SAN FRANCISCO
RAILWAY COMPANY AND THE CITY OF FAYETTEVILLE,.ARKANSAS, COVERING THE EXCAVATING FOR,
LAYING, CONSTRUCTION,. MAINTAINING, OPERATION AND REPAIRING OF A TWELVE INCH SEWER PIPE
LINE CROSSING UNDER THE RIGHT OF WAY AND TRACKS OF SAID RAILWAY COMPANY,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1:. That the Mayor, J. Austin Parish, and City Clerk George J. Davis, be and
they are hereby authorized to execute an agreement with the St. Louis -San Francisco Rail,
Company covering the excavating for, laying, constructing, maintaining, operating, and
repairing of•a twelve inch sewer p1pe line crossing under the right of way and tracks of
said railway company, said crossing to be at the following described location:
Commencing at the northeast corner of southeast quarter(SEt) of southeast quarter
(SE -10 of Section 20, Township 16 North, Range 30 West, Washington County, Arkansas;
thence south measured along the east line of said quarter -Section a distance of 31.5
feet for a point of beginning,said point being in the easterly right of way of
Railway; thence Southwesterly under said right of way with an angle to the right of
lastdescribed course 83 degrees and 09 minutes a distance of 350 feet to a manhole;
thence northwesterly with an angle to the right of last described course 20 degrees
and 14 minutes a distance of 315feet to a point in the northerly right of way line
of Railway; thence continuing on last described course crossing under private property
in the northeast quarter(NE h) of southeast quarter (SE 4) of Section 20 aforesaid
a distance of137 feet to a manhole; thence westerly under said private property -with
an angle to the left of last described course 10 degrees and 00 minutes a distance
of 510 feet to a point in the easterly right of way line of Railway; thence continua

to revise this letter proposal into a formal contract incorporating therein the matters
recommended by the City Attorney so as to have substantially the same terms and provisions
in the Mahaffey-MCGoodwin Contract as are found in the Crist and Holway Contracts and
that the Mayor and City Clerk be and they are hereby authorized to execute said contract
as finally drawn with Messrs. John E. Mahaffey and L. M. McGoodwin to perform the profess-
ional engineering services in connection with the Water Distribution System of the 1958
Water & Sewer Improvement Project.
The motion was seconded by Alderman Kent and upon roll call the following vote was recorded,
