Austin Parish, City Clerk George J. Davis, City Attorney A. D. McAllisl ter Jr., City Engineer W. C. Smith, and Aldermen: $drhhart. Smith, Burgin, Lunsford, Williams, Hatfield, Kent, and Walker. Absent: City:Controller Albert J. Jones, The Mayor reported that the purpose of the meeting was to discuss the proposed Water Purpose. and Sewer Ordinance with Mr. Pete Raney and the water and sewer rates with Messrs. Bill Holway and Gene Walker; also to appoint a member to the Civil Service Commission and one member to the Board of Bill urphy The Mayor recommended that Attorney J. W. Murphy be appointed to the vacancy on the appointed to Civil Service Commission made by the resignation of Attorney David Burleson. Civil Alderman Lunsford moved to appoint Mr. Murphy to the vacancy on the Civil Service Service Commission as recommended by the Mayor. Commission. The motion was seconded by Alderman Burgin and passed unanimously. Mr. Pete Raney explained and discussed the proposed Water & Sewer Bond Ordinance and Proposed the method of recalling the present outstanding bonds as well as the advertising and Water,& sale of the proposed bonds for the new water and sewer system. Ordinances Messrs Bill Holway and Gene Walker then explained and discussed their suggested water discsled. and sewer rates with the Council in connection with the proposed Water & Sewer Bond Ordinance. The Mayor then reported that the purpose of the meeting having been accomplished, he declared the meeting adjourned. Watts. Present: Mayor J. Austin Parish, -City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney A. D. McAllister Jr., City Engineer W. C. Smith, Chief of Police Pearl Watts, and Aldermen: Barnhart, Smith, Burgin, Lunsford, Hatfield, Kent, and Walker. Absent: Alderman Webb Williams. 3. To consider and take appropriate action on a proposed Ordinance amending Zoning Ordinance No. 1008 approved October 22, 1951, rezoning and adopted by reference thereto Zoning Ordinance Nop 1002' approved September 10, 1951, as amended by Ordinance No. 1005 approved October 8, 1951, as amended: To.rezone certain real estate from Zone A -Residen- tial District to Zone G -Industrial District, 4. To authorize the necessary publication notice of call of 1953 Isdue of Sewer Revenue Bonds. All members are requested to attend if at all possible. Dated this 3rd day of April, 1958. (S) J. S. Mail on the 3rd day of April, 1958, addressed to each member of the Council at their resident address, postage prepaid; and that I telephoned each member of the Council on the 7th day of April, 1958, and•gave him actual verbal notice of this meeting. 1. V r Alderman Kent outlined the financial condition of the 1953 Sewer Revenue Bond Fiend Rfter which he read a proposed resolution to call for regemption of Sewer Revenue Bonds umbers 29 through 32, on May 1, 1958, to the amount of 10300.00. Alderman Lunsford moved the Resolution be adopted. The motion was seconded by Alderman Burgin and passed unanimously. The Mayor reported that all members of the Council had been notified both by letter and by telephone as to the time and purpose of the meeting but Alderman Webb Williams was unable to attend because he was out of the City. A copy of the written notice together with the certificate of service thereof, by the Mayor's Secretary reads as follows: NOTICE TO ALL MEMBERS OF CITY COUNCIL A special meeting of the City Council of Fayetteville, Arkansas, will be held in the Notice of Council Room on Monday, April 7, 1958, at 7:30 P.M. for the following purposes: Special Meetinf 1. To discuss the proposed Bond and Rate Ordinance in connection with the expandin€ of the Water and Sewer Systems of the City of Fayetteville, Arkansas, and to take such action as Council may consider desirable in connection with said Ordinance. 2. To consider a proposed resolution authorizing the Mayor and City Clerk to execut an application for Federal Grant of funds for sewer treatment and other sewer facilities through the U. S. Dept. of Health Education and Welfare for Public Health Service, pur- suant to the Federal Water Pollution Control Act. 3. Ittorney Leonard Greenhaw appeared before the Council and described the land involved in the rezoning. {►fter a brief discussion, Alderman Burgin introduced a proposed ordinance entitled, I 'AN ORDINANCE AMENDING ZONING ORDINANCE N0.1008 APPROVED OCTOBER 22, 19519 REZONING AND �DOPTING BY REFERENCE THERETO ZONING ORDINANCE N0. 1002 APPROVED SEPTEMBER 10, 1951, AS r(A�MENDED BY ORDINANCE NO. 1005 APPROVED OCTOBER B, 19510 AS AMENDED: TO REZONE CERTAIN EAL ESTATE FROM ZONE A -RESIDENTIAL DISTRICT TO ZONE G -INDUSTRIAL DISTRICT." Alderman Burgin moved to place the ordinance on the first reading. The motion was seconded by Alderman Smith and passed unanimously, whereupon the City Clerk read the ordinance in its entirety for the first time. Aderman Lunsford moved that the rules be suspended and the ordinance be placed on the second reading, but later withdrew the motion for lack of a second. lution�The City Clerk then read a proposed resolution authorizing the Mayor and City Clerk to 8 execute an application for Federal Grant of funds for sewer treatment and other sewer facilities from the U. The motion was seconded by Aderman Kent and was passed unanimously by all members of the Council present, where- upon the Mayor declared the Resolution adopted. These matters were again discussed and hereafter Alderman Burgin introduced an ordinance entitled;"AN ORDINANCE FIXING RATES OR WATER FURNISHED BY THE WATERWORKS SYSTEM OF THE CITY OF FAYETTEVILLE, ARKANSAS AND ATES FOR SERVICES FURNISHED BY THE SEWER SYSTEM OF THE CITY OF FAYETTEVILLE, ARKANSAS, ND PRESCRIBING OTHER MATEERS RELATING THERETO". lderman Lunsford moved that the Ordinance be placed on the first reading. he motion was seconded by Alderman Kent and passed unanimously, whereupon the City lerk read the ordinance in its entirety for the first time. Attention was called to the applicable statute of the State of Arkansas, which rovides that such an ordinance cannot be adopted until after a public hearing concerninj he proposed rates, notice of which must be given by one publication in a newspaper aving a general circulation in the City of Fayetteville at least ten (10) days before he date fixed in the notice for the hearing. Thereupon Alderman Smith moved that the�Council meet in special session at 7:30 P.M n the 18th day of April, 1958 at its usual meeting place, for the public hearing, and hat the Mayor give the required statutory notice. he motion was seconded by Alderman Hatfield and was passed unanimously by all the embers of the Council present, whereupon the Mayor declared the motion passed. here being no further business, the Mayor declared the meeting adjourned until the egular meeting on Monday, April 14, 1958 at 7:30 P.
