Spainhower, ® Pastor of the First Christian Church of Fayetteville. Present: Mayor J. Austin Parish, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney H. D. McAllister Jr., Chief of Police Pearn Watts, Fire Chief Burl Skelton, and Aldermen: Barnhart, Smith, Burgin, Lunsford, Williams, Hatfield, Kent, and IWalker. Absent: City Engineer W. C. Smith. The minutes of the regular meeting on Monday, February 24, 1958, were read and approved. Alderman Kent reported that the Finance Committee had approved the bills and moved they be allowed as approved. The motion was seconded by Alderman Lunsford and passed unanimously. j Alderman Kent introduced a resolution authorizing the City Olerk4to publish notice of Resolution for the City's election to call for redemption of Bond No. 54 of th€3 ewer Bonds of 1954. Redemption of Alderman Kent then moved that the Resolution be adopted. bond ( The motion was seconded by Alderman Williams and passed unanimously, whereupon the Mayo Sewer Bond declared the Resolution adopted. #54. RESOLUTION 3-58 RESOLVED: That the City Clerk be, and he is hereby authorized and directed to publish notice of the City of Fayetteville's election to call for redemption on April 1, 1958, Sewer Revenue Bond Number 54 of the Sewer Revenue Bonds of 1954. The bond in the principal amount of $1,000.00 and maturing October 1, 1969, was issued pursuant to the terms and provisions of Ordinance No. 1072. PASSED AND APPROVED THIS 10th DAY OF MARCH, 1958, APPROVED: ATTEST:-+r+d A IN ARISH, MAYOR GEORGE IS, CITY CLERK Alderman Lunsford reported that the Ordinance Committee had met with the Retail Mercha- Green River nts Committee with reference to --amending Ordinance No. 1153, more commonly called the Ordinance "Green River Ordinance", and thgt both Committees recommended amending the Ordinance to Amended. permit religious, educational, charitable or benevolent organizations to make door to door soliciting of orders for the sale of goods, wares and merchandise. Attorney David Burleson and a number of others appeared before the Council and discusse the amending of this Ordinance. After a lengthy discussion, Alderman Burgin moved to amend Ordinance No. 1153 as recommended by the Ordinance Committee and the Retail Merchants Committee. The motion was seconded by Alderman Walker and upon roll call the following vote was recorded: "Aye" Burgin, Lunsford, Williams, -Hatfield, Kent, and Walker. "Nay" Barnhart -and Smith. There being six (6) "Ayes" and only two (2) "Nays", the Mayor declared the motion passed. After a brief discussion, Alderman Williams moved that the Ordinance pass. The motion was seconded by Aldennan Lunsford and passed unanimously, whereupon the Mayo: declared the Ordinance passed. ORDINANCE N0. 1160 AN ORDINANCE AMENDING ORDINANCE NQ. 1153 PASSED AND APPROVED DECEMBER 9, 19573 AND FOR OTHER PURPOSES. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS': Section 1. That Ordinance No. 1153, passed and approved December 9, 1957, be and the same is hereby amended by adding to said Ordinance the following Section, to -wit: "Section 6. That the provisions of this Ordinance shall not apply to the solicit- ing of orders for the sale of goods, wares and merchandise and/or disposing of and/or peddling or hawking the same by representatives of religious, educational, charitable or benevolent organizations". Section 2. That all ordinances or parts of ordinances in conflict herewith are herewith and hereby repealed and this action being necessary for the preservation of the public health, peace, and prospeeity, safety, order, comfort, and convenience of the citizens of the City of Fayetteville, Arkansas, an 'emergency is hereby declared to exist and this Ordinance shall take effect and be in full force, from and after its passage and approval.. Maintenance, and Replacement Fund for this truck and he also explained the purpose of this particular fund. After a lengthy discussion, Alderman Lunsford moved to refer this to the Police and Shop Committees for study and report. The motion was seconded by Alderman Smith and passed unanimously. Smith, Chief of Police Pearl Watts, Fire Chief Burl Skelton, and Aldermen: Barnhart, Smith, Burgin, Lunsford, Williams, Hatfield, Kent, and Walker. Absent: None. The City Clerk then read a proposed ordinance entitled, "AN ORDINANCE TO ACCEPT AND CON- FIRM THE DEDICATION OF ALL STREETS, ALLEYS AND EASEMENTS, IN TURNER-FAUBUS ADDITION TO d• THE CITY OF FAYETTEVILLE, ARKANSAS". 1161 lAfter a brief discussion, Alderman Smith moved that the Ordinance be passed. The motion was seconded by Alderman Williams and passed unanimously, thereupon the Mayor declared the Ordinance passed. ORDINANCE N0. 1161 ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL STREETS, ALLEYS, AND EASEMENTS, TURNER-FAUBUS ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, there has been duly presented to the City Council of the City of Fayetteville, nsas, a plat known as Turner-Faubus Addition to the City of Fayetteville, Arkansas, and g a part of the Southeast Quarter of the Northwest Quarter, Section Eight, Township 16 h, Range Thirty West, by which the owners of the platted real estate have dedicated for public use the streets, alleys, and easements, shown upon said plat; and WHEREAS, the City Planning Commission of the City of Fayetteville, Arkansas, has commended the acceptance of said plat. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL -OF THE CITY OF FAYETTEVILLE, RKANSAS: Section 1. That the City of Fayetteville, Arkansas, hereby accepts and confirms the ecication of all streets, alleys, and easements, dedicated in Turner-Faubus Addition to ity of Fayetteville, Arkansas, and hereby declares said streets, alleys, and easements, o be public streets, alleys, and easements;, and the said City Council hereby assumes tho are control and jurisdiction of the same. the P •
