F2he minutes of the regular meeting on Monday, November 25, 1957, were reed and approved. The Mayor then stated that the "Green River Ordinance" was open for discussion and asked Green River the City Attorney to explain the legal status of this ordinance, which he did and also Ordinance. the court dispositions of similar ordinances in other cities. Passed. After a lengthy discussion, k1derman Williams moved that the Ordinance pass. The motion was seconded by Alderman Lunsford and passed unanimously, whereupon the Mayor declared the Ordinance passed. Alderman Richardson moved that the emergency clause be adopted. The motion was seconded by Alderman Lunsford and passed unanimously, whereupon the Mayor declared the emergency clause adopted. Copy of Ordinance No. 1153. AN ORDINANCE REGULATING SOLICITORS, PEDDLERS, HAWKERS, ITINERANT MERCHANTS OR TRANSIENT VENDORS OF MERCHANDISE IDI THE CITY OF FAYETTEVILLE, ARKANSAS; DECLARING IT TO 'BE A NUISANCE FOR THOSE ENGAGING IN SUCH PURSUITS TO GO IN OR UPON PRIVATE RESIDENCES WITH- Green River OUT HAVING BEEN REQUESTED OR INVITED TO DO S0; PROVIDING PENALTIES FOR THE VIOLATTON Ordinance. THEREOF; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. The practice of going -in and upon private residences in the city of Fayette- ville,Arkansas, by solicitors, peddlers, hawkers, itinerant merchants or transient vendors of merchandise not having been requested or invited to do so by the owner or owners, occupant or occupants of said private residences for the purpose of soliciting orders for the sale of goods, wares and merchandise and/or disposing of and/or peddling or hawking the same is declared to be a nuisance and punishable as such nuisance as a misdemeanor. Section 2. Any person convicted of perpetrating a nuisance as described and prohibited the First Section of this ordinance, shall be fined in a sum of not less than Ten Dolls. ($10.00), nor more than Twenty Five Dollars ($25.00), together with the costs of the proceeding. ection 3. SGQTT, h1AYGR he City Attorney then presented several deeds from the property owners for the right of ay for widening the alley into a street between Fairview Street and Williams Street. fter a brief discussion, during which there was some question concerning a well mention( n one of the deeds, Alderman Bissett moved that the City Engineer be instructed to nvestigate the viell mentioned in the Hollingsworth Deed and make recommendations to the ouncil at the next meeting. he motion was seconded by Alderman Alexander and passed unanimously. lderman Richardson moved to pay the bills as approved by the Finance Committee. he motion was seconded by Alderman Alexander and passed unanimously. lderman Richardson then explained that each year since he had been on the Council they ad appropriated sufficient funds to pay all full-time employees who had been with the ity since the first of the year a $10.00 Xmas Check. He moved that sufficient funds to ay the Xmas Checks be appropriated. he motion was seconded by Alderman Alexander and passed unanimously. Alderman Richardson moved to transfer $2000.00 from the General Fund to the Sanitation Fund. The motion was seconded by Alderman Holland and passed unanimously. ;lderman Alexander moved to purchase 3'i radios from the Smith Two -Way Radio Co. according o the alternate bid taken on January 8, 1957, which was at the cost of $437.00 for each rchase adio unit installed. of Two of these radios to be for the new police cars and one for Change -outs in the dios.Tater Department. the motion was seconded by Alderman Bissett and passed unanimously. The City Engineer recommended that the parking on Block Avenue between Mountain Street and Rock Street be changed from "Angular parking on the west side only" to "Parallel Ponking parking on both sides,with.one Loading Zone on the east side". }lderman Bissett moved to change the parking on Block Avenue as recommended by the City SBAth 4 ingineer. The motion was seconded by Alderman Williams and.passed unanimously. �he Mayor presented a letter from the CAA in which they stated that $57000.00 had been Letter tentatively allocated as the U. S. share for the Municipal Airport Project, of which tolMr• 23,000.00 is to be used for the building of an Airport Terminal Building. Yo ng after a lengthy discussion, Alderman Williams moved that the Mayor be authorized to send apout Mr. Paul Young a copy of the letter from the CAA; also to stipulate in a letter to cost of Mr. Young that the cost of the Airport Terminal Administration Building is not to exceed Airport 46,000.00, including the Architect's fee. Green's term had expired as a member of the spital Board and Mr. Green feels that he can't serve another term. derman Lunsford moved that Alderman Alsey Holland be appointed. to the Hospital Board, cceeding Mr. Green, for a term of ten years to become effective January 1, 1958, en Mr. Holland's term of office as Alderman expires, e motion was seconded by Alderman Bissett and passed unanimously except Alderman lland, who did not vote. he City Building Inspector appeared before the Council with a problem concerning a uilding permit for remodeling a building located on Buchanan Avenue. fter a brief discussion of the fire hazards and the provisions of the City Zoning rdinances; Alderman Lunsford moved to refer this to the Building Committee for study nd report.' he motion was seconded by Alderman Richardson and passed unanimously. lderman Richardson then moved that the Building Inspedtor be instructed to not issue a uilding permit for the proposed remodeling until the Building Committee makes their eport. he motion was seconded by Alderman Lunsford and passed unanimously, lderman Richardson reported that he would be unable to attend the regular meeting on ecember 23,-1957;therefore this would be his last meeting as a member of the Council. lderman Williams moved to commend Alderman Richardson for his long and faithful servi s a member of the Fayetteville,City Council, he motion was seconded by Alderman Holland and passed unanimously except Alderman ichardson, who did not vote, here being no further business, Alderman Alexander moved to adjourn. The motion was econded by Alderman Bissett and passed unanimously, whereupon the Mayor declared the eeting adjourned. Bissett, Kent, and lexander. bsent: Fire Chief Burl Skelton and Alderman Richardson. minutes of the regular meeting on Monday, December 9, 1957, were read and approved. he City'Engineer reported that he had investigated the well mentioned in the ollingsworth Deed and that the 15 feet allowed in the deed for right of way :for a treet would not place the street too close to the well to affect the water, fter a brief discussion, Alderman Holland moved to accept all the deeds for right of ay for a street between Williams Street and Fairview Street and for the City Clerk o have these deeds recorded, he motion was seconded by Alderman Parish and passed unanimously, The Mayor then read a letter from Mr. W. R. Holway and Associates, ih regard to making investigations and studies for use in issuing bonds for water and sewer projects. Since this letter was written in the form of an agreement, Alderman Bissett moved that the Mayor and City Clerk be authorized to sign the letter and return one copy to Mr. Holway to constitute the agreement. The motion was seconded by Alderman Williams and passed unanimously. A copy of the letter was also inserted in the minutes. You are to furnish us all necessary records and the clerical help for classifying the customers into various groups under our supervision. We will do this work for a lump sum of ?x1,000..00 to be psaid when the report is file< Your signing of this letter and returning a copy to us will constitute our agreement..
