McAllister, Jr., City Attorney A. D. McAllister, Jr., City Engineer W. C. Smith, City Auditor Albert Jones, City Building Inspector Harold Lieberenz, Police Chief Pearl Watts, Fire Chief Burl Skelton, and Aldermen: Richardson, Parish, Holland, Lunsford, Williams, Bissett, Bronson, and Alexander. In absence of City Clerk, J. W. McGehee, City Attorney A. D. McAllister, Jr. was designated to act as City Clerk. Minutes of the regular meeting -of April 16,, 1956 were read and approved. Alderman Parish moved that "AN ORDINANCE ACCEPTING TERRITORY ANNEXED TO THE CITY OF FAYETTEVILLE, ARKANSAS, ASSIGNING SAID TERRITORY TO WARDS AND FOR OTHERPURPOSES," be passed. Motion was seconded by Alderman Richardson and upon roll call by the Clerk the following vote was recorded: Ayes: Alderman: Richardson, Parish, Holland Lunsford, Williams, Bissett, Bronson, and Alexander. Nayes: None. Whereupon the Mayor declared the Ordinance Passed there being eight ayes and no nayes. i ll� ORDINANCE NO. 1107 ORDINANCE ACCEPTING TERRITORY ANNEXED TO THE CITY OF FAYETTEVILLE, ARKANSAS, ASSIGNING SAID TERRITORY TO WARDS, AND FOR OTHER PURPOSES: [amu WHEREAS, the County Court of Washington County, Arkansas, did on March 21, 1956, make an order annexing the following described territory to the City of Fayetteville, Arkansas, to -wit: A part of the Northeast quarter of the Northwest quarter of Section 17, in Township 16 North, Range 30 West of the 5th P.M., and being more particularly described as beginning at the Northeast corner of said forty acre tract and thence running South 640 feet to the point of beginning; thence -West 175 feet, thence North 180 feet, thence West 60. feet; thence North 115 feet, thence East 235 feet; thence South 295 feet to the point of beginning, and, WHEREAS, the County Clerk of Washington County, Arkansas, has forwarded transcripts of said annexation proceedings to the Secretary of State and to the City Council of the City of Fayetteville, Arkansas, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE'CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1: That the Annexation of the Above described territory tb the corporate limits of the City of Fayetteville, Arkansas, be and the same is hereby accepted. SECTION 2: That all of the above described territory is hereby assigned to and made a part of Ward 4 of the City of Fayetteville, Arkansas. PASSED AND APPROVED this 7th day of May 1956. P'v ORDINANCE NO. 1108 llo� AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL STREETS, ALLEYS AND EASE- MENTS IN THE REPLAT OF LOTS 3-14 INCLUSIVE, BLOCK 3, AND LOTS 1, 2, 9 AND 10, BLOCK 60 IN MOUNTAIN VIEW ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, there is duly filed in the office of the City Clerk of the City of Fayetteville,Arkansas a replat dated March 1956, of Lots 3-14, inclusive, Block 3, and Lots 1, 2, 9 and 109 Block 6, of Mountain View Addition to the City of Fayette- ville, Arkansas in which replat the streets, alleys and easements shown thereon have been dedicated for public use as streets, alleys, and easements; and WHEREAS, said replat was duly approved by the City Planning Commission of the City of Fayetteville, Arkansas, on April 16, 1956. 'NI 170 IJ NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1: That the City of Fayetteville, Arkansas,'hereby accepts and confirms the dedication of all streets, alleys and easements dedicated in the,replat of Lots 3-14, inclusive, Block 3, and Lots 1, 22 9 and 10, Block 6, in Mountain View Addition to the City of Fayetteville, Arkansas, and hereby declares said streets, alleys and.. easements to be public streets, alleys and easements; and the said City Council hereby assumes the care, control and jurisdiction of same. ATTEST: A NG CITY CLF�F K —" C T ,MAY R The City Attorney read the draft of a proposed Ordinance prepared by the City Engineer and City Attorney entitled "AN ORDINANCE TO PROTECT THE PUBLIC HEALTH BY REGULATING, LICENSING AND CONTROLLING THE CLEANING OF SEPTIC TANKS, CESS POOLS, PIT PRIVIES, AND OTHER SIMIIAR'WASTE DISPOSAL SYSTEM: PROVIDING FOR ENFORCEMENT OF THIS ORDINANCE; PRESCRIBING PENALTIES FOR ITS VIOLATION; AND FOR OTHER PURPOSES. Alderman Williams moved that the Ordinance be referred to the Sanitation Committee for recommendation and report. The motion was seconded by Alderman Richardson and passed unanimously. Alderman Richardson moved that "AN ORDINANCE PROHIBITING THE OPERATION OF MOTOR VEHICL BY PERSONS UNDER THE.INFLUENCE OF INTOXICATING LIQJOR OR NARCOTIC DRUGS WITHIN THE CITY OF FAYETTEVILLE, ARKANSAS,PROVIDING PENALTIES FOR VIOLATIONS M D OTHER PURPOSES, be passed. Motion was seconded by Alderman Holland and upon roll call by the Clerk the following vote was recorded: Ayes: Alderman* Richardson$ Parish, Holland, Lunsford, Williams, Bissett, Bronson, and Alexander. Nayes: None. Whereupon the Mayor declared the Ordinance passed there being eight ayes and no nayes. ORDINANCE N0, 1109 AN ORDINANCE PROHIBITING THE OPERATION OF MOTOR VEHICLES BY PERSONS UNDER THE IN- FLUENCE OF INTOXICATING LIQUOR OR'NARCOTIC,DRUGS WITHIN THE CITY OF FAYETTEVILLE, ARKANSAS, PROVIDING PENALTIES FOR VIOLA'IIIONS AND OTHER^PURPOSES, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: SECTION"1: That Act. No. 208 of the 1953 Acts of the General Assembly of Arkansas lb. -hereby adopted in its entirety as the law controlling such violations committed withil corporate limits of the City of Fayetteville, Arkansas. SECTION 2: Whereas, it is imperative for the safety of pedestrians and other users of the highways, streets, roadways and.alleys of the City of Fayetteville to maintain strict enforcement of all the traffic and criminal laws designed to protect the public; and whereas at the present time our Ordinances do not provide adequate punishment for v'. lators of such Ordinancesnpertaining to drunken driving, the City Council finds thatthi: Ordinance is necessary for the immediate preservation of the public peace, health and safety, and hereby declare that an emergency exists, and that this Ordinance shall be it full force and effect from and after its passage and approval. PASSED AND APPROVED THIS 7th day of May, 1956. ATTEST Alderman Richardson moved that the emergency clause be adopted, the motion was seconded by Alderman Parish, and upon roll call by the Clerk, the following vote was recorded: Ayes: Richardson, Parish, Holland, Lunsford, Williams, Bissett, Bronson and Alexander. Nayes: None. The Mayor declared the emergency clause adopted, there being 8 ayes and no naves. The City Attorney read a proposed ordinance entitled AN ORDINANCE TO AUTHORIZE LEVYING OF ADDITIONAL COSTS IDI CONVICTIONS FOR PUBLIC DRUNKENNESS AND DRIVING UNDER THE IN- FLUENCE OF INTOXICANTS, AND FOR OTHER PURPOSES. Alderman -Richardson moved that the Or- dinance be referred to the Police Committee for recommendation and report, the motion was seconded by Alderman Bronson and passed unanimously. x • • 171 1 Alderman Parish read a letter from the City Engineer concerning the application of J. H. Ray for a building permit to be referred to the Aviation Committee for recommendation and report. The motion was seconded by Alderman Williams and passed _ unanimously. Mr. H. W. Younkin appeared before:the Council and advised the Council that due to increased operating costs and decreased revenues the local bus line may have to suspend operations at the close of the spring term of school. There being no further business Alderman Williams moved to adjourn. The motion was seconded by Alderman Richardson end.)passed unanimously and the Mayor declared the meeting adjourned. MEETING Pursuant to due and proper actual notice by telephone call to all members of the Fayetteville City Council and waiver of notice of the special meeting duly executed by Davis P. Richardson, J. Austin Parish, Webb Williams, J. R. Bissett, B. B. Bronson, and Alsey Holland. Present: Mayor Roy A. Scott, Acting City Clerk A. D. McAllister, Jr., City Attorney A. D. The Mayor announced that a special meeting was called for the purpose of discussing acquisition of additional real estate for airport purposes. CLCuis ,+ Upon motion by Alderman Richardson and seconded by Alderman Bronson the following �pp,�rT.es'a) resolution was unanimously adopted. e rate Resolved, that the Mayor and Acting City Clerk be authorized to purchase approximately ,e, sixteen and one-tenth (16 1/10) acres real estate lying in the South one-half (1/2) f�tedpo4 of the Southeast one-fourth (1/4) of the Southwest one-fourth (1/4); of Section thirty-three (33), Township 16 North of Range Thirty (30) West of the 5th P.M. owned by John and Alta Schaffer, husband and wife,at a price not to exceed $500 an acre together with lots 2 & 3 of Schaffer's Sub -Division to Fayetteville, Arkansas at a price not to exceed $800 a lot and that the City Attorney be instructed to file condemnation proceedings if necessary to acquire Lots 1, 4, 5, and 6 of Sbhaffer's Sub -Division to the City of Fayetteville, Arkansas. There being no further business seconded by Alderman Richardson ,the meeting adjourned. The motion was seconded by.Alderman Williams and passed unanimously. Alderman Richardson moved that the bills presented by the.finance committee be allowed and approved. Motion was duly seconded by Alderman Alexander and passed SL unanimously. Alderman Bissett moved the application of Roy Brumfield for Building Permit#2009 be approved on condition that plans satisfactory to the Building Inspector be furnished. Motion was seconded by Alderman Lunsford and passed unanimously. Alderman Bronson moved that the application of Leota Bird for Building Permit # 2034 be approved. Motion was seconded by Alderman Parish and Passed unanimously. Alderman Williams moved that the application of K. L. Davenport for Building Permit # 2038 be approved. Motion was seconded by Alderman Lunsford and passed unanimously. Alderman Richardson moved that the application of the 9841st Air Reserve Squadron for Building Permit # 2040 be approved. Motion was seconded by Alderman Bissett and passed unanimously. The Acting City Clerk read a letter from Dickson & Putman, Attorneys concerning the North Highway No. 71 Water Assocation. No action was'taken. QAlderman Alexander moved that the bid of Fayetteville Sheet Metal Company for 6'airf'cor nit the City Hospital in the amount of $1308.54 be accepted and paid out of the tax Ia fund received for hospital purposes.
