Present: Mayor Roy A. Scott, Acting City Clerk A. D. McAllister, Jr., City Attorney A.'D.
McAllister, Jr., City Engineer W. C. Smith, City Auditor Albert Jones, City Building
Inspector Harold Lieberenz, Police Chief Pearl Watts, Fire Chief Burl Skelton, and
Aldermen: Richardson, Parish, Holland, Lunsford, Williams, Bissett, Bronson, and
Alexander.
In absence of City Clerk, J. W. McGehee, City Attorney A. D. McAllister, Jr. was de-
signated to act as City Clerk.
Minutes of the regular meeting of 'April 2, 1956 were read and approved.
QALxZ-tu The Acting City Clerk read the petition of twenty property owners living in a close
proximity.' r.to the property occupied by EllisCCarr and Roberta Carr on East Center Street
requesting the City to abate as a public nuisance a septic tank maintained by the Carr's
which constantly overflows and drains upon the surface of the ground. Alderman Bissett
moved that the City Attorney be directed to file appropriate legal action seeking to
e� abate maintainence of the above mentioned septic tank as a public nuisance.
Alderman Bronson t;oved that the re -plat of lots 3, 4, 5, 62 7, 8, 90 10, 11, 12, 13, and
14, block 3 and lots 12 2, 9, 10, block 6, Mountain View, •Fayetteville, Arkansas, dated
March, 1956, and approved by the City Planning Commission on April 16, 1956, be received
and the City Attorney by instructed to prepare an ordinance accepting said re -plat.
Alderman Richardson moved that the bills presented by the finance committee be allowed
and approved. Motion was duly seconded by Alderman Alexander and passed unanimously.
Alderman Richardson moved that the letter received from the Retail Merchants Committee
of the Chamber of Commerce pertaining to theschtio:n of the downtown traffic problem be
referred to the street committee for recommendation and report. Motion was duly seconded
by Alderman Alexander and passed unanimously.
Alderman Williamsmoved that the Mayor be authorized to ad3ertise for bids in accordance
with specifications to be furnished by the City Engineer for air conditioning for three
c�1 wards and three rooms at the City Hospital. Motion was seconded by Alderman Richardson
and passed unanimously.
Alderman Richardson moved that "ADI ORDINANCE TO AMEND SECTION 3 OF ORDINANCE N0, 958 AS
AMENDED BY ORDINANCE N0. 1021 OF THE, ORDINANCES OF THE CITY OF FAYETTEVILLE, ARKANSAS
AND FOR OTHER PURPOSES,"be passed. Motion was seconded by Alderman Alexander and roll
call by the clerk recorded the following vote: Ayes: Alderman: Richardson, Parish, Holland
Lunsofrd, Williams, Bissett, Bronson, and Alexander. Nayes: None. Whereupon the Mayor
declared the Ordinance passed there being eight Ayes and no Nayes.

B-- AN ORDINANCE TO AMEND SECTION 3 OF ORDINANCE N0. 958 AS AMENDED BY ORDINANCE N0. 1021
(9..9 of the ORDINANCE OF THE CITY OF FAYETTEVILLE, ARKANSAS AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION I. Section 3 of Ordinance No. 958 of the Ordinancesof the City of Fayetteville,
Arkansas, as amended by Ordinance No. 1021 be the same is hereby amended to
110 read as follows:

"Section 3. No sheet metal, corrugated metal or metal covered buildings
or sheds, shall be erected in the first fire zone except when such
buildings shall be used for industrial, storage, or warehouse, purposes
and are located within 300 feet of a railroad track and south of Spring
Street or north of Douglas Street, and with the further exception that
movable metal buildings-.4ith metal frame and covering may be moved or
built in this area for cafe purposes.
SECTION 2. All Ordinances of parts of Ordinances in conflict herewith are hereby repealed
and this Ordinance being necessary for the preservation of the public health;
peace and safety, an emergency is hereby declared to exist and this Or-
dinance shall be in full force and effect from and after its passage, and
approval.

Alderman'Bissett moved that the application of Doctor R. E. Lingelbaughfor building
permit # 2002 be approved. Motion was seconded by Alderman Alexander and passed
unanimously.
Alderman Williams moved that the application of Robert H..Mayes for.building permit
# 2008 be approved. Motion was seconded by Alderman Lunsford and passed unanimously.
Alderman Alexander moved that the application of Mr. Garland Wheeler for building permit
2019 be approved, on condition that the North all -metal umbrella on the North section
be held three feet from the existing wooden structure. Motion was duly seconded by
Alderman Bissett and passed unanimously.
Alderman Richardson moved that the application for Mr. Bird for building permit # 2020.b
Motion was duly seconded bydAldermandLunsford and passed unanimously.
City Building Inspector, Harold E. Lieberenz introduced a proposed news gn ordinance.
Alderman Alexander moved that the proposed ordinance be referred to the ordinance commit
for study, recommendation, and report. Motion was duly seconded by Bissett and passed
unanimously.

Alderman Williams moved that the Mayor -and Acting City Clerk be authorized to execute th
(� necessary contract to purchase two trucks.in keeping with the recommendations of the Boa
u �of Public Affairs addressed to the Mayor and Members of the City Council dated April 10,
�\ 1956 as follows: These trucks were to be purchased from Whitfield Motor Company.

d Alderman Bissett moved that the City Street Department purchase crushed stone for street
d construction purposes from the crusher near Johnson, Arkansas at a price not exceeding
1.30 per ton loaded at the crusher or at a price not to exceed $ 1.75 in the event the
street department elects to have the crushed stone delivered. Motion was duly seconded
by Alderman Williams and passed unanimously.

Alderman Bronson moved that the City Engineer be authorized to install a hydrant with
estop and waste valves near the bleachers for sprinkling purposes and to install the
li.& necessary drainage facilities to properly drain the ball field, all in the Fayetteville
City Park. Motion was seconded by Alderman Lunsford and passed unanimously.
There being no further business Alderman Williams moved to adjourn. The motion was
seconded by Alderman Richardson and passed•unanimously, and the Mayor declared the
meeting adjourned.
