NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSIS:
• SECTION I. The City of Fayetteville, Arkansas, hereby releases,vacates and abandons
all its rightg, togeher with the rights of the public generally, in and to that portion of
Hotz Drive running West from"the Southwest corner of Lot Fifteen (15) (pas shown on the
plat of Hotz Addition to the City of Fayetteville, Arkansas, recorded in Washington County
Plat Book at page 285,and also shown on the revised plat of Hotz Addition to the City of
Fayetteville, Arkansas, recorded in Washington plat book at page 291 ) to the West Line
of said addition. Said Hotz Drive is shown on the original plat of said Hotz Addition as a
forty (40) foot street being South of Lots 15,16,17, and 18, and being North of a tract
which, according to the original plat -of Hotz Addition was described by metes and bound's
and was not divided into lots on the revised plat of said Hotz Addtion,said Hotz Drive,
as shown on the original plat ends at a point even with the West Line of Lot Fifteen (15),
(which lot is the same In both the original plat and the revised plat) and becomes a divided
Ttreet with the portion originally platted as running due West from that point having been
absorbed in some of the lots shown on the revised plat of said addition,as same is now
platted in the office of the Circuit Clerk and.Ex-Officio Recorder for Washington County,
¢rkansas.
SECTION 2. The City of Fayetteville,Arkansas,.hereby releases vacates and abandons,
all its right, together with the rights of the public generally in and to that portion of
a Thirty'(30) foot public road on the West side of Hotz Addition and running South from
the South -Line of the intersection of said public road with the East-Westublic road run-
ning along the South side of the tier of Lots Numbered One (1) to Eight (8), inclusive,
X11 as shown on the Original plat of said.Hotz Addition, as same is now platted in the
office of the Circuit Clerk and Ex -Officio Recorder for Washington County, Arkanaas;
SECTION 3.A copy of this Ordinance, duly certified by the City Clerk of the City
If Fayetteville, Arkansas, shall be duly filed in the office of the Recorder of the County,
and,recorded in•the deed records of the County,
SECTION 4. This Ordinance shall be'in,.e'ffeet from and after its passage.

There being no further business, Alderman Richardson moved to adjourn, seconded by Alder -
Bronson, which was passed unanimously by the Council, and the Mayor declared the Council

'rhe City Buildibng Inspector presented the application of Wade Barron For a permit to re

odel the building at corner of Church and Mountain Streets, Alderman Richardson made a
motion that Permit No.1567 be issued to Wade Barron, this motion was seconded by Alderm
Alexander and was passed unanimously by the Council.
The City Building Inspector presented the application of Frazier Constructibn Co.
for a permit to build a SUPR-MARKET at Dickson & Gregg Streets ldermam Williams made
amotion that Permit No.1572 be issued to Fraizier Construction G('o. provided the provisions
of the Building Code are complied with, this motion was seconded by Alderman Richardson
and was passed unanimogsly by the Council.
The City Attorney intrd)duced a Resolittmn to authorize the Mayor and City Clerk to
execute and deliver to the Arkansas Fuel Oil Company , a quitelaimyD,without consideration,
;releasing any and all right, title and interest which the City mf Fayetteville may have
in real estate described in the Resolution, Alderman Bronson made a motion that the Resoi
lution be adopted, this motion was seconded by Alderman McAllister, and was passed unanmous
.yby the Council.

seedto Arkansas,by warranty deed recorded in Deed Record Volume 315 at page 277 in the office of
�rk Fuel the Circuit Clerk and Ex-Officio"Recorder for Washington County, Arkansas,and
Oil Co. pJHEzEAS,on September 3, 1937s the grantors in the above mentioned conveyance
to the City of,Fayetteville, Arkansas, had previously conveyed the greater portion of said
above described lots to Arkansas Fuel Oil Company, by warranty deed recosad in Deed Record
Volume 301 at page 521 thereof, in the office of the Circuit Clerk and Ex::Officio Recorder
for Washington County, Arkansas, and
Whereas,the aforesaid conveyance to the City of Fayetteville,Arkansas,consti-
tutes a cloud upon the title of Arkansas Fuel Oil Company to said real estate,and
WHEREAS,the City of Fayetteville, Arkansas,has never had any title,interest,
or claim in and to said lots and recognizes that said lots were erroneously and uninten-
tionally included in the above mentioned deed to the City of Fayetteville,Arkansas,
NOW,THEREFORE,BE IT "RESOLVED;
That the Mayor and City Clerk be and they are hereby authorized to execute and delivee
to Arkansas Fuel Oil Company, a quitclaim deed, without consideration,releasing any and all
the right, title and interest which the City of Fayetteville may have in said above describ-
ed real estate.

or all City Employees,except elected officials be granted the following amo s.
ive (5)cents per hour for those paid on an hourly basis,and Ten [10) Dollars per month
or all paid on a monthly basis,except. The City Sanitarian,who will receive $20200 more,
he Building Inspector,who will receive $15.00 more, the City Auditor,who will receive
25.00 more, and the Assistant City Engineer, who will receive p15.00 more,and the Water
uperintendent & City Engineer, who will receive no increase, Alderman Alexander seconded
his motion, which was passed unanimously by the Council.

Acres Recently this area was annexed to the City of Fayetteville by decree of Court, and there-
after the Council passed an ordinance accepting the streets in the plat. The Planning
Commission had recommended the acceptance of the Plat prior to the action of the Council,
Under provisions of Section 21 of the Zoning Or chance, it is provided that anne)
territory shall be governed by temporary rules until such time as the Planning Commissiox
make its recommendations for the zoning of the annexed territory.

Commission recommends that this tract be zoned as an "A" Residence District. This is tha

15.91; acres, had been declared surplus, and that the City could purchase it for ;11,000.

By vote of the officers of the committee, the most desired site for the "Little
League park is the North-east corner of the City Park. It is the wish of the committee
to have this plot(approximately 300 feet by 300 feet)set aside during the months of June,
July and August for"Little League" play during the hours of 5:00 O'Clock P.M. and 7:30 PI.M.
Permission is also wanted to erect outfield fence (4 feet high),dugout,bleachei
flag pole and equipment shed on this site, This equipment to be in place omly during tl
months of. play. (to be stored during idle months.)
Also, permossion is wished to layout, level and sod the infield according to
Little League specifications.
