Adjourned Present: Mayor Roy A Scott,City Clerk J.W.McGe ee,City Attorney A.D.McAllister, City g I Engineer W.C.Smith, City Auditor Albert Joned,City Bldg Inspector Harold Lieberenz,Chief Meof Police Pearl Watts, and Aldermen: Richardson, Burge, Hunt, Pratt, Williams, McAllister leflin and Alexalder, minutes of the regular meeting of December 6th, were read and approved. Wor cast The Mayer stated that this was a meeting adjourned from the regular meeting of December 6th, 19542 at which time AN ORDINCE TO AMEND THE PRESENT ZONING ORDINANCES TO REZONE CER - Deciding TAIN REAL ESTATE FROM ZONE "A" RESIDENCE DISTRICT TO ZONE "D" MULTIPLE FAMILY RESIDENCE Vote DIST RICT, AND TO -REZONE CERTAIN REAK ESTATE FROM ZONE "B" TWO FAMILY RESIDENCE DISTRICT T�0 ZONE "D" MULTItL.E FAMILY RESIDENCE DISTRICT which came up for passage, and on the roll call by the Clerk, resulted in 4 voting for passage of the Ordinance and 4 voting again; passage of the Ordinance, and the Mayor declared it to be a tie vote, the City Attorney then told the Mayor that it woyld be his duty to cast the deciding vote, whereupon the Mayor stated that he would like to have some time for study and investigationy fat matter before casting his ballot, and the Council voted to have an adjourned ecem er 0th, so, that the Mayor would have plenty of time ->for consideration. The Mayor stated that after a thorough study and investigation of the matter, that he -was ready to cast his vote against passage of the Ordinance, which of course mesa that the Ordinance had failed to pass, as there were 5 votes against the passage, and 4 for pass,61of the Ordinance. Alderman Alexander then made a motion to adjourn, this motion was seconded,by _ Alderman Richardson, which was passed unanimously by the Council, and the Mayor declared Council adjourned. 11 Approved : Att est : t. Alderman Williams made a motion that the City pay not to exceed $450.00 toward T o pay the expense of the labor for installimg and taking down the Christmas Decorations, this 150.00 motion was secomded by Alderman Pratt, and was passed unanimously by the Council. -- I r ,# 5 tion ed. The Contract of SUBURBAN WATER DISTRICT NO.5 was presented, and Alderman Williams ado a motion that it be approved, subject o tTieapproval of the Water Superintendent nd the City Attorney,`•aind thatc.theaMayortand:lCity:,CTerkahe authorized to execute the ontaact, this motion was seconded by Alderman Burge, and was passed unanimously by the ouncil REPO RP OF THE PLANNING COn'MISSION on petition of Hugh Kincaid, El In the matter of the petition of Hugh,Kincaid, Virgil Fielder, Etal for the acation of a certain alley in Block 11 City Park Addition, more particularly described n the petition hereto attached. At a meeting of the Planning Commission held December 14th, with a quorum presen he Commission reversed its former position as by report to you.dated December 6th,and now ecommends that the petition be denied. At the time the former report was nada, it was represented that an alley runi ig south along the east line of Mr Kincaid's property and the property to the south thereo nd extending south to Prospect Street, would be available for owners of properties adjacon o the alley for which vacation was asked. This representation was erroneous, as the strip entioned was a private alley available only to owners of abutting lots, and could not be sed as a public alley. Mr Glen Wing, who has his home and an apartment immediately east f said alley has objected to its closing,as he is very desirous of having access to his roperty through this alley from Highland Avenue. A private sewer is now in said alley and s used by Dr.Fount Richardson and he also has objected to the Closing. While this alley has never been used for ingress and egress, and the contour is ather steep,there are many streets and alleys now in use in Fayetteville that have steeler rades. 4N. H. P RYOR Chairman, City Planning CommEs lderman Richardson made a motion that the recommendation of the Planning Commission be pproved, and the petition be denied, this motion was seconded by Alderman Alexander,whi as passed unanimously by the Council. publish The City Attorney introduced a RESOLUTION to authorize the City Clerk to publish a notice of a hearing to be held on January 3rd, 1955,on the petition of G.M.Clarli,:,Etall ice of to rezone a block Bounded on the North by West Dickson St., on the West by Buchanan Avenue, ring on the South by Williams St., and on the East by Duncan Avenue from "B" Zone to "ll" Zone, Alderman Burge made a motion that the Resolution be adopted, this motion was seconded by lderman Richardson, which was passed unanimously by the Council. The Report of the Planning Commission was presented as follows: ON ACE'S ACRES' ie Planning Commission, to whom the plat of ACE'S ACRES SUBDIVISION was referred by the .ty Council for study and recommendation, after due consideration the Commission has )proved said plat and recommends that it be accepted by the City Council. This plat consists of a tract 350 feet wide,east and weats and 660 feet lon, )rth and south and was platted by W.G.Shipley and Grace Cotton Shipley. It was recently brought into the corijorate limits of the City of Fayettevi r decree of the Chancery Court. All lots contain more than the minimum of 7000 square feet required by the >ning Ordinance for residential lots,and the streets provide adequate access to all lots id are at least 45 feet in width. Yours very truly, (S) W.H.PRYOR j Chairman, City Planning Comm ssi e, Lle rman Richardson made a motion that the report of the Planning Commission be approved the matter be referred to the Cit y,Attorney to prepare an Ordinance accepting the Plat, motion was seconded -by Alderman Alexander, and was passed unanimously by the Gouncil; Contract Mr. E.H.Evans, Superintendent of Sta#ions of Central Airlines appeared before the Council with a proposed contract, which would pay the City $50.00 per month for the building wherecCentral has its offices and lobby at Drake Field and two percent of gross revenue on business originating in Fayetteville, after a lengthy discussion, it was agree, to refer the matter to the City Attorney and Airport Committee, Alderman Richardson reported that the bills had been approved by the Auditing Committee,.and made a motion that they be allowed as approved, this motion was seconded by Alderman Alexander, and was passed unanimously by the Council. E OF At this time Mayor Scott proposed that " A rising vote of Thanks be given to NKS the three retiring members -Laverne Heflin, Leonard Pratt and Jack Burge -for their untir- ing and loyal service during the time they have served the City as Aldermen", which propo sial was unanAmously complied with. There being no further business, Alderman Heflin moved to adjpurn, seconded Alexander, which was passed unanimousy by the Council, and the Mayor declared t adjourned.
