The City Engineer presented Estimate No 3 for work on the Filter Plant by Tun( onstruction Co. City Building Inspector presented the application of Jack Harp for a Permi t 204 South College Avenue, Alderman Pratt made a motion that Permit No.1120 be issued ack Harp) this motion was seconded by Alderman Richardson, and was passed unanimously b he Council The City Attorney introduced " AN ORDINANCE REGULATING THE HANGING OF SIG F THE CITY OF FAYETTEVILLE, ARKANSAS,REPEALING ALL ORDINANCES IPI CONFLICT HEREWITH AND OR OTHER PURPOSES". 41derman Williams made a motion that the rules be suspended and the Ordinance placed cbn is second reading, this motion w"_s seconded by Alderman Burge, and was passed unanimous y the Council. The City Attorney then read the Ordinance the second time, and after discussion lderman Burge made a motion that the rules be further suspended and the Ordinance place n its third and final reading, this motion was seconded by Alderman Richardson and was assed unanimously by the Council. he City Attorney then read the Ordinance the third and final time. he Mayor then put the question "Shall the Ordinance pass"?, and on roll call by the Clerk, he following vote was recorded: Ayes: Richardson, Burge, Hunt, Pratt, Williams, McAllistler nd Heflin. Nays : None. Absent anf not voting: Kent. And the Mayor declared the Ordinance assed, as there were 7 Ayes, and No nays. Alderman Williams made a motion that the emergency clause be adopted, this mot s seconded by Alderman Pratt, and on roll -call by the Clerk, the following vote was corded: Ayes: Richardson, Burge, Hunt, Pratt, Williams, McAllister and Heflin.Nays:Non sent and not voting: Kent. And the Mayor declared the energency clause adopted, as the e 7 Ayes, and No Nays. COPY OF ORDINANCE NO. 1056. AN ORDINANCE R'GULATING THE HANGING OF SIGNS IN THE CITY OF FAYETTEVILLE, DIG ALL ORDINANCES IDT CONFLICT HEREWITH AND FOR OTHER PURPOSES '.iHEREAS, the City of Fayetteville, Arkansas, does not have a standard uniform ilding Code and WHEREAS, existing ordinances of the City of Fayetteville, Arkansas, do not permit he erection of signs which could be erected under the 1949 Edition of the National Buil( ode, and WHEREAS, the City Council of the City of Fayetteville, Arkansas,finds that it i; o the best interests of the City of Fayetteville that the building ordinances for con- truction of signs be amended as hereinafter set forth: NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLEj C z • • I1 \J 25: Section 1. A. No displaysign shall hereafter be erected, or attached to,suspended from or ppotted on a building or structure until a permit for the same has been issued by the ilding Inspectoro B. Any persd)n, firm or corporation who may desire to erect or maintain any sign the City of Fayetteville,"ArkansasI shall submit to the City Building Inspector of th ty of Fayetteville, Arkansas,an application for a permit to erect or maintain such sign th the design and specifications showing the size and construction of such sign and the tter to appear thereon. If the City Building Inspector approves such applivation,design d specifications along with the method of suspending or hanging such sign,he shall issm permit on the condition that the work be done under the supervision and inspection of ty Building Inspector or his duly authorized representative, provided that the applican .all pay for said permit and inspection the sum of Two Dollars and Fifty Cents ($2,50) .ich shall be a prerequisite to the issuance of such permit. However, no permit shall be sued for the erection of any sign unless satisfactory evidence be produced to the City ginee¢ that said sign is to be erected upon applioant's real estate or upon another's al estate by written cohsent of the owner thereof. The provisions of this article,except as to height and safety, shall not apply to a sign not more than 10 square feet in area, announcing,without display or elaboration, only the name of the proprietor and the nature of his business;nor to a wall sign not eeding one square foot of display surface, on a residence building stating merely the name and profession of an occupant; nor to a sign, not exceeding 10 square feet of display surface, on a public building giving the name and nature of the occupancy an4 information as to the conditions of use or admissions, nor to a wall sign not exceeding Q square feet of display surface,nor a ground sign, advertising in either case the sale or rental of the premises upon which it is maintained; nor to street signs erceted by the municipality; nor to temporary signs or banners legally aithorized. No permit shall be issued"to erect a sign which in the opinion of the building inspector will create a traffic hazard by obstructing the view of passing motorist, If a sign is erected and if found to be a hazard to traffic, said owner can be ordered by the City Council to remove or relocate said sign within a reasonable time and if not so removed the owner shall be deemed guilty of violating this ordinance and subject to the penaltic of Section 5 of this ordinance. TION 2. ALTERATIONS, Strudtural- No display sign shall hereafter be altered, rebuilt,enlarged, extended or relocated except in conformity with the provisions of this article. . MOVABLE PARTS - The changing of movable parts of signs that are designed for changes, or the repainting of display matter shall hot.:be..ddemed to be alterations within th meaning of this section. When existing signs become a violation of the provisions of this ordinance in the of widening a street or alley and/or if the curb line of a street is moved back, t owners of the existing sighs must bear the expense of rearranging or telocat3ng: a in order to make said signs comply with the provisions of this ordinance, or to re said sign entirely. 3. CONSTRUCTION !'Wall Signs- Display signs placed against the extermor walls of buildings shall not extend more Phan lb inches outside of the wall surface. Such signs shall not exceed 40 square feet in area, unless made of noncombustible materials, provided that mouldings and cappings may be of wood. Such signs shall not extend beyond the tmp or ends of the wall surface on which the are placed. Wall signs shall be securely attached to the building by means of metal anchors,bol or expansion screws. Signs shall not be fastened by nails or staples to wooden bloc or nailing stripsbuilt into the masonry. PROJECTING SIGN?S- Ido projecting sign shall project from the face of the building or structure over a•street. alley or other public space more than 10 feet, but in nb case shall any such sign project beyond a line.drawn perpendicularly upward from 2 feet inside the curb line. A clear space of not less than 10 feet shall be provided below all parts of such sig s. Projecting signs shall be securely attached to the building or structure by bolts, anchors, chains or guys. All signs shall be of metal constriYetion or of approved material of syfficient stren th to insure the safety of the public. GROUND SIGNS- Ground display signs shall not exceed 30 feet in height above the ground 77 on wRT1c_hETTJy rest. Lighting reflectors may project beyond the face of the sign. An open space at least 3 feet high shall be maintained between the bottom of the sign and the ground; provided that necessary supports extending through such space and the filling of such spacd with lattice or slats leaving at least 50 per cent of the space open shall not be prohibited. Within the fire limits, such signs when m1re than 13 feet high shall be construed of noncombustible materials, except that mouldings and cappings may be made of wood. ROOF SIGNS- Display signs that are placed above or suppo�ed on the top of a buildin or sTruc ure shall be constructed of noncombustible materials, except that mouldings and cappings may be of wood. An open space of not less than 6 feet shall be maintained below the bottom of the si except for necessary vertical supports. Within the fire limits, no roof sign shall be supported by or braced to wooden beams or other wood construction of a building or structure over 40 feet in height. LOCATION- No sign shall -be so placed as to obstruct or interfere with a.required do way or other required means of egress, or so as to prevent free passage from one par of a roof to any other part thereof. SECTION 40 ` Z�hat no signs shall be erected pursuant tl the terms of this ordinance on that property qwned by the City of Fayetteville, lying between the outside edge of the sidewalk and the curb line except that this section Ishall'not be construed'so as to prohibit the erect'ng of traffic control signs or directional signs erected by church and/or educational instit tions. Alderman Williams made a motion that the Fire Chief and 4 Delegates be authorized to attend - the ARKANSAS FIRE&LENS ASSOCIATION CONVENTION at Rogers, Arkansas,September 24-25 &26th, and their Entry Fee and the annual dues for 38 members be paid, this motion was seconded by Alderman Pratt, and was passed unanimously by the Council. Alderman Pratt reported that the bills had been audited and signed, and made a motion that they be allowed as approved, this motion was seconded by Alderman Richardson, and was passed unanimously by the Council. Alderman Hunt made a motion that NO PARKING AREAS BE ESTABLISHEDAT THE FOLLOWIN PLACES: Duncan Avenue- on botli side, from Treadwell to Stone Street 'VEST CENTER- on north side between Schbol Avenue and West Avenue. There being no further business, Alderman Heflin moved to adjourn, seconded by Alde - man McAllister, which was passed unanimously by the Council, and the Mayor declared the Council adjourned, and stated the next regular meeting would be October 12th at 7:30 P.T.4.
