Fayetteville City Council met in regulkar session,,Monday, Julie 22, 1953.

i4esent: Mayor Powell M.Rhea, City Clerk J.W.McGehee, City Attorney A.D.McAllister, City
Engineer John Mahaffey, City Auditor Harold Zick, City Building"Inspector Harold Lieberenz,
Fere-Chief Burl Skelton, and Aldermen:.Richardson, Burge, Williams, IvIcAllister,Heflin and
Kent. Absent: Aldermen Hunt and Pratt.

At this time the bids wereopened for LiAYINg WATER MAIN, FITTINGS, AND VALVES for
the RESERVOIR TIE-IN PROGRAM, which showed that followig had submitted bids:

Tune Construction Co. 2,688.25 (30 day completion date)
Alderman"Richardson made a motion that the lowest and best bid of Tune Consiructioh Co.be
accepted, and the Mayor and City Clerk be authorized to execute the contract, this motion
was seconded by Alderman McAllister, and was passed unanimously by the Council
Est No.2 I The City Engineer presented Estimate No. 2 for contruction work on the Wat
Line from Lake Fayetteville to the Filter Plant on Mt.Sequoyah by Culver & IdlcGuire, amoun
43319, to $64,319.222 Alderman Williams made a motion that the estimate be approved, this motion

the Council.
The City Engineer reported that he had received two bids on a Centrifmgal pump
to replace an old worn out pump on Mt.Sequoyah, the bids bees follows:.

Williams, and was passed unanimously by the Council.1.
The City Attorney introduced a RESOLUTUON directing the City Clerk to publish notice
of a hearing to be held July 13th, on the petition of -Rachel Oliver Etal.,,to vacate and close
a 15 foot alley running north from Maple Street to an unnamed road ( now known as either
West Doglas's-Street or Cardwell LaneQ,Ald'erman Williams made a motion that the resolution be'
adopted, this motion was seconded by Alderman Kent and was passed unanimously by the Council.

WHEREAS' it appears that the petition of Rachel Oliver; Kathryn Oli'oer,Bess 01
Chester Neudling,Kaaeen Neudling,S.C.Dellinger, Elsie A Dellinger,Thorgny C.Carleson,
Rosemary Carleson, Henry W.Jinske and Laura Jane Jirske to vacate a fifteen (15) foot alle,
running north from Maple Street to an unnamed F.ort.y'Foot Road (now known as either West Do�
lass Street or Cardwell Lane ),as designated on the revised Plat of Oliver Addition to Fay
ville, Arkansas,now appearing of record in Plat Book at Page 230 thereof in the office of
the Recorder of Washington County,Arkansas.
WHEREAS, it appears that this is the Fifth regular meeting of the City Council
following the filing of saidPetition
NOW, THEREFORE,BE IT RESOLVED:
1. that the 13th day of July,1953, be and the same is hereby -fixed as the day
set for hearing upon said Petition:
2. That the City Clerk of the City of Fayetteville, Arkansas, be and he is here
directed to give notice -of such hearing by publication thereof once a week for two (2) cor
secutive weeks in the -Northwest Arkansas Times, a Newspaper published in Washington County,
Arkansas, and having a general circulation in the City of Fayetteville, Arkansas.

The City Attorney reported that he had been unable to reach an agreement with
MdKinney George McKinney for an ease ment across his property, and that the Construction Co.was abou
ready to lay the Water line across said property,Alderman Richardson made a motion that the
Easement City Attorney be authorized to proceed with condemnation of a 5 foot strip across said pro
unless a satisfactory agreement for an easement can be worked outs, and that the Mayor and C
be authorized to execute a contract for the easement if one can be agreed upon, or to post
a bond in case the condemnation proceedings are necessary, this motion was seconded by Alde
mann Heflin, and was passed unanimously by the Council.
Bird Ease ent The City Attorney said that it had just been ascertained -that it wogTld be necessa
olsecure an easement across the property of H.D.Bird, and that Mr.Bird had submitted a pro
osition to give the"City an easement at an approximate cost of $75.00,(Said easement being
necessary for the laying of the Water Line to the new Filter Plant on Mt.Sequoyah).,Alderma

wasl seconded by Alderman Tient, and was passed unanimously by the Council.

Aty.:he City Attorney reported that Otho Tackett had reported that he would not be able to pay
alt hor-ze or the Sidewalk that had been constructed in front of his place on West 6th Street before

suitile Aderman Williams made a motion that the City Attorney be authorized to proceed with suit
bo collect unless Mr.Tackett agrees to live upto his agreement to pay by December 31,1953,
his motion was seconded by Alderman Richardson, and was passed unanimously.by the Council.

The City Building Inspector presented the application of M.F.Stanford for a Bldg

ermit at'his Tourist Court on Highway 71, North,Alderman Heflin made a motion that Bldg
plermit No.1037 be issued to M.F.Stanford, this motion was seconded by Alderman Burge,and
glassed unanimously by the Council.
The City Building Inspector presented the application of C.P.Carrington for a
Bldg permit on Highway 62 West, Alderman Heflin made a motion that Bldg Permit No(y39 be
lissued to C.P.Carriugton, this motion was seconded by.Alderman Kent; and was passed unank

There being no further business, Alderman Heflin made a motion to adjourn, thi
motion was seconded by Alderman Kent, and was passed unanimously by the Council, and the
Mayor declared the meeting adjourned, and stated that,the next meeting wou d be July 13,
1953.

At this time the bids for installing the air conditioning in the operating and delivery
rooms at the City Hospital were -opened, which showed that the following had submitted

The City Building Inspe4tor presented the application of Rosco B.Kuhn for a building
ermit at 207 W.Dickson: Alderman Burge made a motion that Building Permit No 1052 be
slued to Rosco B.Kuhn', this motion was seconded by Alderman Pratt and was passed unan-
mously by the Council.
The City Building Inspector presented the application'of E.C.Aumick fol a Bldg Perini

his motion was seconded by Alderman Pratt, "and was passed unaftimously by the Council.

Bldg Permit on North Block Ave., Alderman Williams made amotion that Permit No. 1057 be
issued to the Yellow Cab Co., this motion was seconded by Alderman Burge, and was passed
unanimously by the Council.
Orille Hall The Mayor reported that there were two vacacies on the Beard of Assessors of Paving
& (District No 562 caused by the death of J.E.Parker\,and the resignation of S.J.Campbell on
C6C.Sullivanaccount of ill health, and stated that the Commissioners of"the District had recommended
the appointment of Orville J.Hall and Claude C.Sullivan to fill the vacancies, Alderman
Appointed Pratt made a motion that the recommendation of the Commissioners be approved , this moti
