Aldermari'Burge made'a motion that the Mayor and City Clerlf tie authorized to negotiate a contract with Otho Tackett"that would allow him to pay for the construction of asidewalk in front of his property and'for the construction of a retain&ng wall in front of his property, if the City chooses to build the wall, this motion was seconded oy Alderman Williams, and was passed unanimously by the Council.. Alderman Kent reported the bills had been audited and signed, and made a m tion that they be-al:lowedias approved, this motion was seconded by Alderman Richardson, and was passed unanimously by the Council. The City Attorney introduced aan Ordinance entitled " AN ORDINANCE VACATING THAq PORTION OF READ AVENUE BETWEEN COMPANY STREET AND MAPLE STREET IN MOUNTAIN VIEW ADDITION; AND VACATING THAT PORTION OF READ AVENUE BETWEEN MAPLE STREET AND VINSON STREET IN EAST MOUN`>1,.ADD.ITION, ALL IN THE 01TY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURPOSES." The Ordinance was read in its entirety by the City Attorney, Alderman Williams .e a"motion that the Ordinance pass; and on roll call by the Clerk the following vote recorded: Ayes: Richardson, Burge, Hunt, Pratt, Williams, McAllister, Heflin and t. N ORDINANCE VACATING THAT PORTION OF READ AVEINE BETWEEN COMPANY-'ST`REET AND MAPLE ST RE: N MOUNTAIN VIEW ADDITION; AND VACATING THAT PORTION OF READ AVENUE BETWEEN MAPLE STREET ND VINSON STREET IN EAST MOUNT ADDITION, ALL IN THE CITY OF FAYETTEVILLE, ARKANSAS,AND OR OTHER PURPOSES. WHEREAS, A petition was duly filed with the City Council of the City of Fayette rkansas,on the 20th day of April, 1053,asking the City Council to vacate and ahandon al hat portion of Read Avenue between Company Street and Maple Street, as designated on th let of Mountain View Addition to the City of Fayetteville, and all that portion of Read venue between Maple Street and Vinson Street, as designated on the plat of East Mount ddition to the City of Fayetteville, Arkansas, as same appear in the office of the Cir- uit Clerk and Ex -Officio Recorder for Washington County, Arkansas, and 0 t - T Whereas, after due notices as required by law, the City Council has,at the time place mentioned in the notice, heard all persons desiring to be heard on the question has ascertained that the portion of the street hereinabove decribed has heretofore been icated to the public use as a strebt; has not been actually used by the public generally a period of at least five (5) years subsequent to the filing of the plat; that all of t owners of the property abutting on the portion of said street sought to be vacated hove e filed with the City Council their written consent to said abandonment, and thaf�ublic erest and welfare will not be adversely affected bythe abandonment of said street. ,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OR FAYETTEVILLE,ARKANSAS: SECTION 1. And the Mayor declared the motion passed The IJ[ayor reported that he had been informed by the members of the School Board of District No.l, that the Board had loaned the bell belonging to Junior High School to the City of Fayetteville, and that the bell was presently being used at Lake Fayetteville by the Manager for calling in the fishermen , and the Mayor reported that he would writel the Board a letter of thanks for the loan of the Bell,and the Mayor stated that the Boar had requested that loan of the bell be made a matter of record in the minutes of the il City Council. Assistant City Engineer presented the Engineer's estimate No 2(and final)by Tune Construction Co.for construction of SEWER LATERAL NO.307-B, Jackson Hefghts Addition., Alderman Pratt made a motion that the estimate be approved and a check issued to Tune _ Construction Coo. for $805.90, this motion was seconded by Alderman Richardson, and was passed unanimously by the Council.
