HomeMy WebLinkAbout1953-03-23 MinutesCOPY OF ORDINANCE N0. 1044 AN ORDINANCE AUTOHORIZING THE APPROPRIATION OF $4,062,27 z0 BE USED FOR PURCHASING TWO TRUCKS FOR THE STREET DEPARTMENT AT A COST OF $2,271.41 FOR THE TWO-TON TRUCK AND AT A COST OF $1,790.86 FOR THE ONE AND ONE-HALF TON TRUCK* WHEREAS,the Street Department of the City of Fayetteville, Arkansas, is in need of one two ton truck and.one one and one-half ton truck by reason of the fact that the presi ent equipmwnt is worn beyond repair and the functions of the Street Department of the City of Fayetteville cannot be maintained without the purchase of said vehicles, NOW,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYEPTEVILLE, ARKANSAS: SECTIONi„1. That the following sums are hereby appropriated for the purpose of purchasing two trucks; Street Fund 2,271.41 for One 2-ton truck Street Fund 1,790.86 for one 12 ton truck SECTION 2. The Board of Public Affairs is hereby directed to advertise for bids for said ve c es as set forth in their recommendation and to proceed with the awarding of a con- tract and the purchase of said vehicles as provided by Section 19-1022 et seq and to arrange for delivefy of said vehicles at the earliest possible time. The Ordinance was then read the third and final time. COPY 0R ORDINANCE NO. 1046 AN ORDINANCE AMENDING ORDINANCE N0. 1013 OF THE CITY OF FAYETTEVILLE,ARKANSAS,AND DECLARING AN EPIIERGENCY. WHEREAS, the City of Fayetteville, Arkansas, acting by and through its City Coun- cil, has considered and determined that there is need for improvdment and extension to the municipal sewer system, and this reg1ires the issuance of additional revenue bonds,and in order to pay the principal and interest of the proposed bond issue of approximately $25,000.00 it is necessary for the Council to establish minimum rates to be charged for services to be rendered by the suer; NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: SECTION 1.That Section 2 of Ordinance No.1013@ passed and approved on the 17th day of December, 1951 be and the same is hereby amended to read as follows: "SECTION 2; Sewage Service Charges: There is hereby fixed and established chabges for the use of the Sanitary Sewage System,said charges to be based' upon the 'amount of wate usied permonth,with necessary adjustments as hereinafter provided for. The monthly rates sh be as follows: "FOR the.first 3,000 gallons or less, a minimum charge of $0,.75 For the next 20000 gallons 0.22 per M For the next 20,000 gallons 0.16 per M For the Next 75,000 gallons 0.12 per M For the next 400,000 gallons ................ 0.08 per M And all over 500,000 gallons 0:06 per M "PROVIDED,that those properties which are tobe(.'served by the extension of the sewer system to be financed by the issuance of bonds as hereinabove set forth will pay $KOO per m6nth in addition to the schedule of charges herinabove set forth, so that the miinimum monthly charge for each user of the system to be served by the exVensions herein contemplated shall be $$1.75 per month, ci el RIM L RV rol "(A) All users shall be classed as either domestic or cpmmercial;•depending upon ather or not the water consumption of the individual user is msed for domestic or commer• it purposes. For the purpose of definiti6n, all users:•bther than residences shall be tssed as commercial. "(B) Where a user has both residential and commercial users on the same meter, i usage shall be classed as commercial usage for the purpose of computing bills. "(C) In the case of domestic users, the monthly sewage service incurred forany .th shall be based upon the average water usage for the previous mon#hs of November, ember, January,February, March and April. Said charges shall be computed for twelve- .ths' period beginning with the billing for the month of June, said uniform rate shall be rged for the following twelve months' period,at the end of which time new rates shall be puted. Where residential users have established a monthly sewage service rate as set above and moves to a new location the same sewage service rate as established shall ap- at the new location in case the general household conditions are the same. age service rates for the new residential users shall be based upon monthly water usage it such times as their rates have been established by the usage of water for the months etofore specified. "(D) In the case of Commercial users, the monthlysewage service charge shall be ermined by applying the rate schedule to each monthly water bill throughout the year. I "(E) Where a user of the Sanitary Sewage System utilizes water other than residen• tial use so that such water does not enter the Sanitary Sewage System,rates as fixed shall beIcharged d)nly on sewage entering the system; 9'7 'I(F) In the case of users of the Sanitary Sewage System where water is obtained from sources other than the City Water Department,the City will determine the amount of water entering the Sanitrary Sewage System, which shall be subject to the rate -as set out above. SECTION 2. In all other respects Ordinance No. 1013 shall remain in full force and effect. SECTION 3. It is hereby ascertained and declared that the urgent need for addition sewer lines and outfall sewers endangers the health and safety of thB inhabitants of the City of Fayetteville,and therefore an emergency exists and this ordinance, being necessar tor the immediate preservation of the public peace, health and safety,shall take effect and be in force from and after its passage. COPY OF ORDINANCE N0. 1047 AN ORDINANCE AMENDING UNN[IMBERED PARAGRAPH SEVENTEEN (17) OF SECTION SEVEN(7) 'IF ORDINANCE ISO. 577 OF THE ORDINANCES OF THE CITY OF FAYETTEVILLE, ARKANSAS AND FOR OTH PURPOSES: WHEREAS,'the City of Fayetteville, Arkansas does not now have a standard unifor luilding Code, and 11 1 WHEREAS, existing building ordinances of the City of Fayetteville; Arkansas, do not permit the use of cettain materials and methods of construction which are approved a allowed by the Arkansas Inspection and Rating Bureau, and WHEREAS, The Arkansas Inspection and Hating Bureau uses the National Building Code for inspection and rating of construction°within the fire limits the provisions as set forth in Article IV,Section 401 of the 1949 Edition of said Code, and WHEREAS, it is desirable that the building ordinances for construction within the fire limits be amended, NOW,TIiEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILhE, ARKANSAS SECTION 1.
