Present: Mayor Powell M.Rhea, City Clerk J.W.McGehees City Attorney A.D.McAllister,City Engineer Jo Yin Mahaffey, Citti Auditor Harold'Zick, City Sanitarian Jas, Coe, Fire Chief purl Skelton, and Aldermen ;"Richardson, Burge, Pratt, Williama, Heflin and Kent., bsent ; Aldermen Hunt and McAllister.- MinItes of the regular meeting of JanVary 26th, were read and approved. engineers W.R.Holway and L.M.McGoodwin appeared before the Council and'presented PLANS, PLANS & SPECIFICATIONS and Engineers' ESTIMATE of Cost "of"construction for a part of a proposed SPECIFI- water system expansion program in Fayetteville,-Arksrisas, after discussimn, Alderman cations Richardson made a motion that the P1ans,Speci£ications and Engineers' Estimate of cost of ponstruction of Clear Creek Puimpkhg Station and the laying of a line from Lake Fayetteville to the present Filter Plant on Mt.Sequoyah be approved,'and bhat the Mayor and City Clerk be authorized to advertise for bids to cover obst ofx tais phase of the construction, I upon the receipt of an agreement from -the -Bond Buyer that only so much of the Ponds as are necessary for the completion of -this phase'of the W63rk'will be issued; bids to be received at 1:30;P.M.,Tuesday,Marc1i 3rd, 1953,'this motion was seconded by Alderman Williams; and on roll call by the -Clerk the Tollowing vote was recorded: Ayes: (Richardson, Burge, Pratt, Williams,Hefliri and Kent. Nays *None. Absent and not voting: punt and McAllister.And the Mayor declared the motion passed, as there were 6 Ayes, and no nays. Alderman Williams made a motion that the Plans ec"Specification be referred to the Planning Commission and one set to G.F.Branigan; member of -the Chamber of Commerce Commi1 tee, this motion was seconded by Alddrman Pratt, and was passed unanimously by the Council authorized to (obtain Alderman Heflin made a motion that the City Attorney and City Engineer be authorizes easements to proceed go obtain easements for the water line from Lake Fayetteville to the Filter -for line !Plant on Mt.Sequoyah, this motion was seconded by Alderman Kent, and was passed unanimous- �y by the Council. The Water Superintendent presented RULES and REGULATIONS governitiglthe:.saleand use of Raw Water, Alderman Williams made a motion that they be approved, this motion was :t seconded by Aldderman Pratt, and was passed unanimously by the Council. RULES and REGULATIONS GOVERNING THE SALE AND USE OF "RAW WATER. Rules & WHEREAS, raw water transmission mains crmss public and private property located Regula=i::-outside the City limits of the City of Fayetteville, Arkansas, and tions WHEREAS, there are no existing rules and regulations of the City Water Depart- ment governing the use and sale of raw water -for nondomestic uses, and raw water is pros -1 ently sold, it becomes necessary that rules and regulations be passed governing s1ch uses NOW,THEREFORE, under the authority of Ordinance No.953, the following rules aid regulations are hereby adopted; 1. Before water may be sold to prospective customers,said prospective custome ust-apply for and sign an agreement or contract similar to existing regulations coverin, greements for outside citta users of treated water. 2: Said raw water is sold for nondomestic purposes only and the City of"Fayet ille assumes no responsibility by reason of the use of said water for any purpose. 3. -Such use of raw water shall be governed by the rules and regulations.of th ty Water Department, which may restrict the use of water during times of emergency. 4•'411 such use of raw water must be made with a service-connection,service lin d water meter in the same manner as the sale of treated water, outside the City limits 5. Water meters metering raw water shall "be read at the -end of each.:mointhhand customer shall be billed for same at the rate of 25¢ per thousand gallons,with no mum monthly bill and no discount-, The above rules and regulations shall be in full force and affect after the2r oval by the Fayetteville City Council. Fayetteville City Council By Mayor, The City Engineer presented the application of B.R.Nelsin for a building Permi at 16 E Spring Street, Alderman Pratt made a md)tion that Building Permit No.918 be issue oto B�R.Idelson, this motion was seconded by Alderman Burge, and was passed unanimously by the Council. The City Engineer presented the application of the Fayetteville Glass Co, for a Building Permit at 1735 North College, Alderman Burge made- a motion that Building Perm No. 927 be issued to Fayetteville Glass Co. provided it has2atblock wall next to the gars this motion was seconded by Alderman Richardson, and was passed unanimously by the Counc �rrpa1 ' t Engineer prese% A the application of Mid -Continent Petroleum Corpora tionjtaV Al nd of Archibaldvfoulevard, Alderman Burge made a motion that Building ermit No.928 be issued to Mid -Continent Petroleum Corporation, this motion was seconded LJE Alderman Kent, and was passed unanimously by the Council. The City Attorney introduced !!AN ORDINANCE TO ABANDON A PORTION OF AN UNNAMED AVE NPY (20) FEET IN WIDTH IN THE CITY OF FAYETTEVILLE* ARKANSAS, AND EXTENDING NORTH ENTY=TWO (72) FEET FROM CONNER STREET." The Ordinance was read in its entirety by the City Attorney,Alderman Williams ade a motion that the rules be suspended and the Ordinance placed on its second reading his motion was seconded by Alderman:Kent, and was passed unanimously by the Council. AN ORDINANCE 'TO ABANDON A PORTION OF AN UNNAMED AVENUE TWENTY (20)FEET IN WIDTH IN THE CITY OF FAYETTEVILLE,ARKANSAS,AND EXTENDING NORTH SEVENTY-TWO (72) FEET FROM CON - NOR STREET. WHEREAS, a petition was duly•filed with the City Council of the City of Fay- ett_reville, Arkansas, on the 26th day of 'January,1953,asking that said City Council vacat and abandon all that portion of an unnamed avenue twenty (20) feet in width in the City of Fayetteville,Arkansas,and extending north seventy-two (72) feet from Connor Street, e WHEREAS, the abutting lots affected -are Lot6'5;6, aiid"7-of'Block One -(1) in t Van Hoose -Van Winkle Addition to the City of Fayetteville, Arkansass-and"Lot 5 of Block Three (3) in the -Valley View Additiln to the City of Fayetteville, Arkansas,having been heretofore duly accepted by the Fayetteville City Council, and WHEREAS, after due notice as required"by law, the City Council has,at the tin and place mentioned iri the notice,heard all persons desiring to be heard on -the question and has ascertained that the portion of said unnamed avenue hereinbefore described was heretofore dedicated to the public use as a street; that the described portion of said street or avenue has never been opened and that the publme interest and welfare will not be adversely affected by the abandonment of said street, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE: Section 1. The City of Fayetteville,Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally,in and to tha- portion-•of-said unnamed avenue twenty (20) feet in width in the City of Fayetteville, Arkansas, and extending north seventy-two (72) feet from Connor Street. Section 2. A copy of this ordinance duly certified by the City Clerk shall b filed -in the office of the -Recorder of said County and recorded in the deed records of said county. - Section 3. This Ordinance shall take effeeg and be in force from and after its passage.
