Present: Mayor Powell M.Rhea, City Clerk J.W.McGehee, City Attorney A.D.McAllister, City Engineer John Mahaffey,Fire Chief Burl Skelton, Aldermeri:Richardson, Burge, Pratt, Williams, McAllister, Heflin and Kent. The City Engineer presented the request of H.W.Younkin for a'building permit n North 71, Alderman Burge made a motion that the request be approved and Building Per Jo.757 be issued to H.W.Younkin, this motion was seconded by Alderman Kent..and was pass nanimously by the Council. Alderman Kent reported that the bills had been audited and signed, and made a ,notion that they be allowed as approved, this motion was seconded by Alderman Richardso and was passed unanimously by the Council. NOW, THEREFORE, BE IT ORDAINED.BY THE CITY COU%CIL OF T,_E CITY OF FA=- TEVILLE; SECTION 1. COPY OF ORDINANCE NO. 1027 AN ORDINANCE AMENDING ORDINANCE NO. 954 REGULATING -THE HANGING OF SITNS EXTENDING OVER TFE SIDEWALKS OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE 01T Y OF FAYETTEVILLE, ARKANSAS* SECTION I.That Section 2 of Oirdinance No.954 is hereby amended to read as follows: —� Section 2.• Any person, firm or corporation who may desire to erect or maintain•any sign extending over or across any sidewalk or street in the City of Fayette Arkansas, extend4ng more than eighteen (18') inches from the building to which it is atta or extending more thaneighteen (18) inches over the side -walk if not attached to the building, shall submit to the City Engineer of the City bf Fayetteville,Arkansas, an app cation for a permit to erect or maintain such sign, together with the.design,and specifi cations showing the size and construction of such signs and the matter to appear thereon If said City Engineer approves such application, ddsien and specifications, he shall iss a permit on the condition that the work be done under the supervision and inspection of the City Engineer or his duly authorized representative; provided that the applicants sh pay for said permit and inspection the sum of x}2.50 which shall be a prerequisite to the issuance of such permit. However, that no permit shall be issued for the'erection of any sign unless satisfactory evidence be produced to the City Engineer that said sign is to be ested upon applicant's real estate or upon another's real estate by written consent of the owner thereof." �y hed i- e f 449 SECTION 2. That Section 3 of Ordinance No.954 is hereby amended to read as follows: "Section 3. All signs provided for under Section 2 of Ordinance No.954 shall e of metal construction or of approved- material of sufficient strength to insure the afety of the public and the method of attachment of said sign, as well as the height romithe sidewalk or street level, as the case -may be; it shall also be of construction uch as to insure the safety of the public; that the City Engineer shall require the app ant to show the method of suspending or Banging of said sign, the height above the side alk or street level and such"other information with reference to said sign as dis necess y to determine that its installatiltn will not endanger -the public. In no event,however, hall a permit be issued for any sign having less than an eight'(8) foot, six (6) inch learance above the sidewalk or street level as the case may be, nor shall a permit be ssued for"any sign designed to project past the outside edge of the curbing and over he street.." SECTION 3. Section 7 shall be added to Ordinance no.954 as follows; "Section 7. That no signs shall be erected pursuant to the t okras of this rdinance on that property owned by the City of Fayetteville, lying between the outside dge"of the sidewalk and,the curb line except that this fection shall not be construed o as to prohibit the er ting of traffic control signs or directional signs erected by hurch and/or eucational institutions. Alderman Hunt made a motion that "NO PARKING" be established on the East side of 'TO PARKh est Avenue from Sprmng Street to Prairie Street, this motion was seconded by Alderman o West Villiams, and was passed unanimously by the Council. The Ordinance was then read by the Clerk the third and final time. Tie Mayor then put the question "Shall the Ordinance pass?", and on roll call by the Clerk, tie following vote was recorded; Ayes: Richardson, Burge, Hunt, Pratt, Williams, PIcAlliste , E flin and Kent. Nays:None. And the W.ayor dellared the Ordinance passed, asthere were 8 Ayes and no Nays. Alderman Williams'made a motion that the emergency clause be adopted, this notion was seonded by Alderman Pratt, and on'roll call by the Clerk, the following vote was re - c rded; Ayes: Richardson, Burge, Hunt, Pratt, Williams, McAllister, Heflin and Kent.
