He lin and Kent. And the Mayor declared the motion lost, as there were 2 Ayes and 6 Nays.
Easement Alderman Richardson made a motion that the following clause be added to the
for Or finance:"reserving unto said City an easement over and across the above described alley-
utilitiesw for construction and maintenance of public utility lines". This motion was sdconded by
Alderman McAllister, and on roll call by the Clerk, the folloliing vote was -'recorded; Ayes:
Rilchardson, Burge; Hunt, Pratt, Williams, McAllister and Kent. Lays: Heflin. And the Mayor
declared the motion passed, as there were 7 Ayes, and 1 Nay. After the above "RESERVE CLAUS
w inserted and read again, Alderman Pratt made a,motiori that the Ordinance pass, this
motion was seconded by Alderman Hunt, and on roll call by the Clerk, the following vote was

TON COUNTY, ARKANSAS, AS SHOWNFBY THE OFFICIAL PLAT OF SAID ADDITION ON FILE AIDID OF RECORD
ID THE OFFICE OF THE CIRCUIT CLERK, EX OFFICIORECORDERITOF SAID COUNTY.
WHEREAS, all of the persons owning property abutting the alley 20 feet in width
e tending from Johnson Street on the South to Rebecca Street on the North, which alley sep-
arates Block No..22 from Blocks No.23 and No -.24 in Gunter Addition to the City of Fayette -
vi le in Washington County, Arkansas, and is hounded on the East by the"West 50 feet of

WHEREAS, the Council has by resolution directed the City Clerk to give notice as
provided by Section 3 of Act No.17 of the Acts of Arkansas, 1945; Arkansas Statutes, 1947,
Sec.19-3826,of the hearing of said petition and the said Clerk gave notice as provided by
Sid law;
WHEREAS, the afo,%said alley has not -been actually used by the public generally
f r a period of at least five (5) years subsequent to the filing of siad plat of Gunter
Addition to the City mf Fayetteville, Arkansas,
WHEREAS, hearing has been duly had upon said petition before the City Council -a5
provided by law, and it has been determined by the City Council that the property included
within the alley above described should be abandoned as an alley and said alley should be
closed; thaE all abutting property -owners and persons directly interested have consented
t9 the abandonment of said'alleyand no one has appeared to oppose the granting of the
prayer of said petioners.
THEREFO4, it Is ordained and determined by the City Council of the City of

SECTION'_3. It shall be unlawful for any unauthorized person, firm or corporation
o drive any Vehicle -over any"public street and/or alleyway in the corporate limits of ti
ity of Fayetteville, Arkansas, where there is a barrier,or person,or sign warning not to
ross and /or enter said street and /or alleyway.
SECTION 2. It shall be unlavfful-for any person,firm or corporation to'barricade
street anor alleyway in the corporate limits of the City of Fayetteville,Arkansas,
out the prior written approval of the Chief of Police of said City.
SECTION 3. It "shall be unlawful for any unauyhorized person, firm or corporati
o remove any barriers and /or signs.ercted on any of the streegs and /or alleyways wit
he corporate limits of the Ciyy of Fayetteville, Arkansas. ,
SECTION 4. Any person, firm or corporation violating"Section 1,Section 2 or Sect
of thisOrd— i- nan shall be deemed guilty of a misdemeanor, and upon conviction thereof

SECTION 5, It appearing that -serious damage_ is being caused by vehicle traffic

of repair by reason of

past
twenty-five years;
WHEREAS, there is iri the Northwest area of the State materials and equipment
a contractor presently engaged in hot asphalt resurfacing of highways;
WHEREAS,it is believed that College Avenue could not be resurfaced at a consid-
rable saving in cost to the Highway Department;
NOW,THEREFORE,BE IT RESOLVED that the Arkansas Stste Highway Department be and
t is hereby requested to resurface all of that section of College Avenue from Rock Stree
o North Street within the City of Fayettevllle, Arkansas. •
