That Severt Rise be, and he is hereby directed to remove all of that part of his 12

5 2, and having extended into the 20 foot street side set back as required by City Ordi-
nance:- within ten (10) days from the date of service of this Resolution upon him.
That Building Permit No.582 be, and the same is hereby revoked until this order sh

The Ordinance was read in' its entirety by Alderman Pratt, Alderman Williams made
a motion that the rules be suspended and the Ordinance placed on its second reading, thi
motion was seconded by Alderman -Kent, which -was passed unanimously by the Council.
The Ordinance was then read the second time by Alderman Pratt, Alderman Burge made
a motion that the rules be further suspended and the Ordinance placed on its third and ftnal
reading'. this motion was seconded by Alderman Hunt, which was passed unanimously by the
Council.
Alderman Pratt then read the Ordinance'the"third and final time.
_he Mayor then put the question "Shall the- Ordinance pass;'P", and'on roll call by the
Clerk, the following vote was recorded': Ayes -:'Richardson ,Burge, Hunt, Pratt, Williams,

AN ORDINANCE ESTABLISHING STREET IMPROVET.TE11T DISTRICT N0.57 OF THE CITY OF FAYETTEVIL ,
V;JrASHINGTON COUNTY, ARKANSAS.
1,11HEREAS, parties claiming to be the owners of two-thirds in assessed value of the
property located within the territory hereinafter described have filed a petition praying
that an improvement district be established for the purpose hereinafter set out.
WHEREAS, after due notice as required by law, the City Council of the City of Fayl
etteville, Arkansas has heard*all parties desiring to be heard, and has ascertained that
said petition was sinned by two-thirds in assessed value of the pwners of real property
within said territory;

be approved for Building Permit N6.668, this motion was seconddd by Alderman Kent, and wa:

The City Engineer presented the application of Louis k.Bromley for a Building
P,rmit on Highway 71, North for an addition to the building known as the Creighton Place
Alderman Kent made a motion that the Appliction be approved and Bmilding Permit No. 669
be granted, this motion was seconded by AldermanHeflin, and was passed unanimoudly by the
Council.
Alderman Pratt introduced the following Resolution with reference to Street
Iprovement District No.57, approving the report of the Commissioners and appointing a
B and of Assessors for the District, Alderman Williams made a motion that the Resolution

WHEREAS, the Board of Improvement of Street Improvement District No.57 of the City
Flyetteville, Arkansas, has filed its report, togetherawith an estimate of cost of the Im-
provement contemplated in said local improvement district, and it appearing therefrom that
t�e estimated cost of said improvement, exclusive of interest on borrowed money, is the
spn of •$3,150.00, being less than sixty percent of the assessed value of the real propert;
in the DistT riFE'as shown by the last County Assessment and not in excess of the limit on
cost as provided by said petition;
NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Fayetteville,
Arkansas, that said report be and the same is hereby approved;" and that the making of the
assessment for said improvement be undertaken; and that -Orville J.Hall, Buster Dunlap and
J.J.Pyeatt, each of whom is an elector of the -City of Fayetteville, Arkansas, be and they
are hereby appointed as assessors for said District to assessthe benefits to be received
by each lot or block or other subdivision of lands,railroads and right of way in said
]district by reason the said proposed local improvement therein.

AN ORDINANCE REGULATING THE. SENDING AND USE OF FIRE APPARATUS"OUTSIDF. THE CORPORAT
LIMITS OF. THE CITY OF FAYETTEVILLE, ARKANSAS, authorizing the Mayor, City Clerk and FIRE
CHIEF, TO EDIPER INTO MUTUAL AID AGREEMENTS WITH OTHER MUNICIPALITIES; AND FOR OTHER
PURPOSES.
WFEREAS, there is agreat loss and destruction by fire of property located outside
the corporate limits of our City, and
WHEREAS, many of these fires endanger propertylrlocated within the corporate limit
of our municipality, and
.• WHEREAS,there will be mutual benefit and protection for the City and its
Cities by enteringinto mutual aid agreements, and
WHEREAS, the General Assembly of the State of Arkansas has authorized sending
fire equipment outdide the -corporate limits by Act No.270 of 19510 and has authorized
mutual aid agreements by Act No.23 of 1949,
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS:
'SECTION 1. No fire department' apparatu's shall be taken beyond the corporate limit
of the City of Fayetteville, Arkansas,to assist at any fire or for any other purpose,-.
except by order of the Mayor or Fire Chief, and subject to the restrictions and conditic
hereinafter set forth.
SECTION 2. The Mayor or Fire Chief are authorized, in their discretion, to aid
in the extinguishing of fires'in another city or town,public institmtions,corporations,
or other property within a reasonable distance from the City of Fayettev&116 or on'prop-
erty immediately adjacent to the city in which there is a possibility of fire spreading
within the corporate limits, under the following conditions:
A% A request from a city or incorporated town for assistance must come from the
Mayor, Fire Chief or such other person as may be designated by mutual agreement.
B. Calls may be responded to only by such apparatus which in the judgment of the
Mayor or Fire Chief can be safely sent without undul impairing the fire protection with,
in the City, and when highways and weather conditions are favorable.
SECPION 3. Unless there exists a mutual: aid agreement, every municipality,insti-
tution, corporation or individual requesting and receiving such service of the Fire De-
partment of the City of Fayetteville, Arkansas, will be informed of the cost to the
City of the services rendered in answering such fire calls. All payments of such cost:;
will be made to the Municipal Treasury.
SECTION 4. All Ordinances or parts of ordinances in conflict herewith are here-
by repealed.
I SECTION 5. This ordinance shall be in full force and effect from and after its
