The City Engineer presented the"application of Herbert Hatfield for a Building per Hatfield it at 22 East Meadows Alderman Kent made a motion that -Permit No 636 be approved ,this Permit lotion was seconded by Alderman Pratt and was passed unanimoudly by the Council. M..St anfor The -City Engineer presented the request of Dr.M.F.Stanford for a Building permit Permit o construct a Tourist Court'near his residence on Highway 71,North, Alderman Richardson ade a motion that Permit No.637 be approved, this motion was seconded by Alderman Kent and was passed unanimously by the Council. 15 day Alderman Hunt made a motion that C.W.Babcock be given a fifteen day notice to remo no ice to a building from the alley between first and second street, since the City had been serve with a Court Order to clear the A14ey, this motion was seconded by Alderman Kent and was C.YJ.IBabcocic passed unanimously by the Council. The Mayor presented the request of the ESSO STANDARD OIL CO, to lease a strip,•of Request of round lymng between their Bulk Station' and the'Friseb 'Right-of-way, immediately South e Esso Oil Co prairie AyeWie, and stated that there was some question as to the ownership pf said stri to lease 'f land,%`h`'g would like for the Council to take some action, and Alderman Hunt made a mot a strip of that the City Engineer and the City Attorney immediately take steps to determine if the land City was the owner, and for the Mayor to inform the Esso Company of the result of the in yestigationt' this motion was seconded by Alderman Heflin, and was passed unanimously by the Council. Alderman Kent reported that the bills had been approved and signed and made a Totion that they be allowed as approved, this motion was seconded by Aldermah Pratt and was passed unanimously by the Council. 40 1 TUE on 162 Alderman Hunt introduced a RESOLUTION authorizing the Mayor and City Clerk to xecute a contact for construction of a Pedestrian underpass at the Vehicle underpass on ighway, and made a motion that Resolution be approved, this motion was seconded by Alde an Richardson and was passed unanimously by the Council. COPY OF "RESOLUTION, WHEREAS; The City of Fayetteville -has from time to time requested St.Louis-San rancisco Railway Company and the Arkansas State Highway Commission to construct a pedes rian underpass under tracks of the St.Louis-San Francisco Railway Company immediately orthwardly of the vehicle underpass at U.S.Highway 62; and WHEREAS, plans and specifications for the construction of such underpass have been I rawn and submitted to the City Council; and WHEREAS, a proposed three-way contract between the City of Fayetteville, St.Louis= an Francisco Railway Company, -and the Arkansas State Highway Commission has been drawn or execution on the part of said three parties and presented to the City Council, copy f which contract, together with the plans and specifications has been filed with the ity Clerk; and WHEREAS, the City Council finds that said contract would be beneficial to the Ci y' f Fayetteville and to its best interests if same is executed and carried out: NOW, THEREFORE, BE IT RESOLVED by the City Counci-1 of.Fayettevillee Section 1. In consideration of St.Louis-San Fancisco Railway Company, in conjune,1, tion with the Arkansas State Highway Commission through the United States Bureau of Public Roads, constructing said pedestrian underpass as provided in said agreement and the plans and specifications attached thereto,the Mayor and the City Clerk are hereby authorized alid directed to execute said contract in the name and on behalf of the City of Fayetteville, and upon the execution of same it shall be binding upon the City of Fayetteville, and th il City thereby obligated to carry out the terms an a ditions pressed therein.
