AN ORDINANCE ADOPTING BY REFERENCE THE ARKANSAS STATE PLUMBING CODE RELATING TO T
OONSTRUCTION, INSTALLATION AND INSPECTION OF PLUMBING AND DRAINING.
WHEREAS, the City Council of the City of Fayetteville, Arkansas, caudad a notice
to be published that it had under consideration the adoption of an ordinance relating to
the construction, installation and inspection of plumbing and drainage as set forth in,tha
ArkansascState Plumbing Code adopted by the Arkansas State Board of Health on the 26th day of
July, 1951, pursuant to Arkansas Act 200 of 19515 and
WHEREAS, the requisite number of copies:of said code ware kept on file as provi ed
by Act 267 of the Acts of Arkansas for the year 19492 and there have been no protests or
uggestions or requests for discussions,and
WHEREAS, the City Council of the City of Fayetteville, Arkansas, finds that it is
to the best"intersests of the City of Fayetteville that the above code of the Arkansas Sta e
Board of Health gevernirg the construction, installation and inspection of plumbing and drain=

NOW,THEREFORE, be it ordained by the City Counciloof the City of Fayetteville,

SECTION 1. That the rules and regulations of the State Board of Health governing
the cons truc'lo' nnst all at ion and inspection of plumbing and drainage known as the Arkansas
State Plumbing Code be, and the same is hereby adopted for the City of Fayetteville, Arkaxisas,
except as hereinafter provided:
SECTION 2. That Section 1.2.1 shall be added to the Arkansas State Plumbing Code
and adopted by the City of Fayetteville, as follows:
Sec.1.2.1 DEFINITIONS. Plumbing for the purposes of this ordinance is
h reby defined as follows:
I(A) All piping,fixtures, appliances and appurtenances in connection with the wate
supply and drainage system within a building and to a point from three to five feet outsi
of the building.
(B) The construction and connection of any drain or waste pipe carrying domestic
slewage from a point within three to five feet outside of the foundation walls of any buil
ipg with the sewer service lateral or other disposal terminal, including private domestic
slewage treatment and disposal systems and thealteration'of any such system, drain or
haste pipe, except minor repairs to faucets, valves, pipes, appliances and removing of
st opp ages.

(C). The water service piping from a point within three to five feet uotside of the
oundation walls of any building to the water meter or other water utility, property or
Tther terminal and the connecting of domestic hot water storage_tanks, water softeners,
and water heaters with the water supply syatem.
(D), water pressure systems other than public utility systems.
(E). A plumbing and drainage system so designed and vent piping so installed,as to keep
he air within the -system in free circulation and movement, and to prevent with a margin
f safety unequal air pressures of such force as might blow,siphon or affect trap seals o
etard the discharge from plumbing fixtures, or permit sewer air to escape into the build
ng.
SECTION 3. That Section 2.1.2 shall be added to the Arkansas State Plumbing Code and
dopted by the City of Fayettevilleas follows:
Sec. 2.1.2 Inspection and Supervision.
(A). There is hereby created the position or
Plumbing Inspector who shall be apoi
@d by the Mayor, subject to the confirmation of the City Council.
(B). The Plumbing Inspector shall receive as full compensation for his services}:
uch salary as the City Council may direct.
(C). The Plumbing Inspector shall have experience in the business of plumbing to
the extent that enables him to know when plumbing is installed in accordance with the pr
visions of the Code. He shall not be connected in any way with any person, f(brm or corpo
ation directly or indirectly engaged in the business of plumbing, or plumbing supplies.
(D)'. It "shall be the duty of the Plumbing Inspector to enforce all provisions of
his ordinance and the Plumbing Inspector is hereby granted the authority to enter all
uildings in the City bf Favetteville, in the performance of his duties between the
ours of 8:00 A.M. and 5:00 P.M. daily.T he Plumbing Inspector shall issue permits for
plumbing work as herein provided and shall prepare suitable forms for applications, perm
nd other reports.
(E) It shall be the duty of the Plumbing Inspector to inspect and test all plumbi

SECTION 4. That Section 2.1.3 shall be added to the Arkansas State Plumbing Code

Sec. 2.1.3 Applications, permits.
(A). Before beginnin any plumbing wor in the (;Iyy of FayettedillB, the person
nstalling same shall apply to the Plumbing Inspector, or other designated official and
btain a permit to do such work. Only those persons authorized to do plumbing may be iss
ermits. A permit may be issued to a property owner to install plumbing in'a single fami
esidence provided the property owner does the work himself and the building is owned an
ccupied by such owner as his homete provided, however, that'such work must be completed
ithin strict compliance with the requirements of this code.
(B) Said plumbing permit shall require a fee payable to the City of Fayetteville,
puted as follows: First fixture "$2.00, next five fixtures .51.00 each, all addition
tures 50¢ each. Plumbing permits or service connection permits shall be granted only
a licensed master plumber or his authorized representative; except as provided above
this ordinance.
SECTION 5. That Section 2.1.4 is hereby added to the Arkansas State Plumbing Coc
adoiTM6 y ie City of Fayetteville as follows:"

(A). Sec.2.1.4 An Examining Board is hereby created to act on all applications for
licenses and other related duties as required by State Law and the Plumbing Code of the
City of Fayetteville. Said Board shall be composed of four(4) members as follows:
(1) A licensed Master Plumber, (2) a Licensed Journeyman Plumber, (3) A representative
of the administrative authority of the City -and-(4-)''A'Licensed Gas -Fitters
Members of the Board shall be appointed for a period of two years by the Mayor of the City
of Fayetteville, with the recommendations of the Plumbers Association of Fayetteville,
given due consideration.
(B) The City of Fayetteville shall secure necessary equipment and supplies'as rei
quired, by the Board from the receipts collected with applications for examinations*
Phe supplussthbreoffshall be disposed of as the Board shall unanimously direct.lThe above
mentioned supplies and equipment shall be in charge of the Cit'y'Engj°neer of the City of
Fayetteville. Board members preseht shall receive per diem in the amount of $2.00 per hour,
with voucher payable to the Secretary -Treasurer of the Board.
SECTION 6. That Section 2.1.5 is hereby added to the Arkansas State Plumbang
Code and adop ed by the City of Fayetteville as follows:
(A) Sec. 2.1.5 Requirements for a City License shall be as follows:
le Hold a State License for the current year and
2. Proof to the examining Board that the applicant has held City license previously,
or arrange with the member of the Board representing the City for examination for
the license desired.,The results of said examination shall be the minimum or above
that required by the examining Board to satisfy this requirement for eligibility.
3. Every master Plumber doing business in the City of FayettevillE shall execute and
deliver to the City a bond with a surety bonding company in the sum of $1,000.00 to in-
demnify the City or any citizen for any damage caused by the failure of such Master Plumb-

er to comply strictly with the provisions of this ordinanceo' No plumbing permit shall be
issued to any Master Plumber unless this bond has been delivered to the City and is in
full force and effect.
4. Payment in advance of the following license and examination fees to the City of
Fayetteville as follows: t•

ion, $10.00 may be deducted from the schedule of fees given in paragraph 4 of Sec.2.1.5
above.
(C) Section 2.1,6 is hereby added to the Arkansas State Plumbing Code and adopted by
he City of Fayetteville as follows:

SECTION 7. That Section 2.4.4 is hereby added to the Arkansas State Plumbing Code

Sec. 2.4.4 The use of lead pipe is restricted to the "Short Branches", unless other
ise specified. Short Branches of lead pipe shall- have wiped joints.
SECTION 8. That- Section 2.5.1 of the Arkansas State Plumbing Code shall be amemnded
nd adop ed o read as follows:
Sec.2.5.1.Existing Buildings, In existing buildings or premises in which plumbing
Installations areae a1�d,repaired,renovated, or have location shanged; said work

SECTION 9. That Section 2.21.1 of the Arkamsas State Rlumbing Code shall be amemd(
nd adop�by�he City of Fayetteville to read as follows:
When public sewer is not available for use within 300 feetof the property desirir

construction"and installation as recommended by the Arkansas State Board of Health in'Bu7

- SECTION 10. That Section 7,20.3 is hereby added to the Arkansas State Plumbing

Sec.7.20.3 Automatic Clothes Washing Machines shall be provided with a 2 -inch draj

SECTION 11. That Section 11.1.2 of the Arkansas State Plumbing Code shall be amen

SEC.11.1.2 Above Ground -Waste Piping Within•Buildings.

SECTION 13. That Section 11.1.4 of the Arkansas State. Plumbing Code shall be
amended and adopted by the City of Fayetteville to read as follows:
Sec. -11.1.4 Fittings. Fittings on drainage systems shall be of an approved drai
age pattern and shall conform to the type of piping used.

SECTION 14. That Section 11.2.1 of the Arkansas State. Plumbing Code shall be ame*d-
ad and adpoted by the City of Fayetteville by having the words "Concrete sewer pipe " omitted.
SECTION 15. That Section 11.1.5 is hereby added to the Arkansas State Plumbing
"ode andadop e�by the City of Fayetteville as follows:
Sec. 11.1.4 Four inch by eight inch cast iroh drumtraps and cast iron stubs wit
closet flange, in accordance with Section 3.2.5 may be used where pipes are encased in
concrete.
SECTION 16. That Section 11.2.5 is hereby added to the Arkansas State Plumbing

Sec. 11.2.5 Cleanouts must be protruding above"the ground at a point a minimum
distance of 3 feet from the foundation of the building.line.
SECTION 17, Section 2.7.4 shall be added to the Arkansas State Plumbing Code
and adop e�by The -dity of Fayetteville as follows:
SEC. 2.7.4 Street Openings.
(A) All water and sewer service lines wa e brought to the property line df property
desiring service, by the respective departments of the City of Fayetteville.
(B) Said connections shall be made upon payment to the City of a set fee,as shall be est
lished from tmme to time by the City Council.
(C) Said service charge shall be computed on a 40 -ft. -average run for concret paving, as
paving and gravel street excavation and repair.On service lines of greater than 80"feet,
a bond shall be required as set by the superintendent of the different departments. Saic
bond shall be used to pay the cost of said service line, and the remainder.shall be rete
to -the bond maker.
SECTION 18. Penalties. Any person, firm, or corporation found guilty of violating
any of- the provisions of his ordinance shall be subject to a fine of not less than
ten dollars ($10.00) nor more than one hundred ($100.00)2 together with the costs of suc
prosecutimn; or imprisonment. Each day during which violation continues shall be a seper
ate offense.
SECTION 19. Conflicting Ordinances Repealed All ordinances or parts ofordinances
conflicting wi any —oyr e prowsionsoi'�nis orainance are hereby repealed.
SECTION 20. The City Council hereby finds that the public has been and will be it
juredhunt U_9 improper plumbing and improper constructionof sewage and drain pipes and
that thisN ordinance is necessary for the public health and safety, and an emergency is
hereby declared to exist and this ordinance shall be in full force and effect from and

AN ORDINANCE AMENDING ORDINANCE N0. 1014 RELATING TO THE CONSTRUCTION, INSTALLATION
AND INSPECTION OF PLUMBING AND DRAINAGE.
NOWITHEREFORE,BE IT ORDAINED by the City Council of the. City of Fayettevmlle
Arkansas:
Section 1. That Item 4, Paragraph 2, Section 6 of Ordinance 1014 be amended to
read as—TolTows:
Payment in advance of a fee as sha.11'be establkished upon the approval of the
Fayetteville City Council and the recommendations of the Examining Board.
