City Engineer present the application of Roy Brumfield for a Building Permit at 29
t Mountain Street, Alderman Pratt made a motion that The Permit No. 613 be approved,
s motion wasesecomded by Alderman Kent and was passed unanimously by the Council.
The City Attorney introduced an Ordinance, entitled, "AN ORDINANCE TO AMEND
NANCE N0.414 ENTITLED, AN ORDINANCE REGULATING THE LOCATIOE OF TELEPHONE, TELEGRAPH,
ELECTRIC LIGHT POLES WITHIN THE CORPORATE LIMITS OF THE C1T.Y OF FAYET'TEVILLE, ARKANSA all
The Ordinance was read in its entirety by the City Attorney, Alderman McGoodwin
e a motion that the rules be suspended and the Ordinance placed on its second reading,
s motion was seconded by Alderman Kent,<which was passdd unanimously by the Council.
The Clerk then read the Ordinance the second time and after discussion, it was
o leave it on its second reading and the City Engineer was instructed to send a copy
rdinance to : The Telephone Co.,Telegraph and the Light Co. and notify them that the
ould be up for consideration at the next regular meeting of the Council.
The Ordinance fixing the rates for the use of the sanitary sewer system, which
ad been left on its second reading at the regular meeting of the Council on December 3rd

Ordinance passed, as there were 7 Ayes and no Nays.

ITY OF FAYETTEVILLE, ARKANSAS; DEFINING CERTAIN TERMS; PROVIDING FOR DETERMINING THE A
HE MANNER OD BILLING AND COLLECTING; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
ECLARING THE PROVISIONS HEREOF SEVERABLE; AND DECLARING AN EMERGENCY.

WHEREAS, it is necessary to provide for an equitable method of payment for the
se of the city sewage system by the various users according to the amount of sewage del

And, whereas, additional revenues are required for the maintenance, operation,

NOW THEREFORE* BE IT ORDAINED by the City Council of the City of Fayetteville,

SECTION 13Definitions: For the purpose of this Ordinance the following terms

(A) SanitarySeweage System is hereby defined to include all sanitary sevier tri
ines, main lines, submain lines, lateral lines and sewage treatment plants, and all sew(
ines connected to the City's sewer lines or treatment plants whether owned by the City (
ot. `
(B) Sanitary Sewage is hereby defined as the liquid waste which may or may not
ontain solids, originating in the sanit,ary'conveniences for personnel of a dwelling,
usiness building, factory or instmtution; originating as a result of operations of pro-
essing, manufacturing, or industrial plants.
(C) User of sanitary sewage system shall mean the person,firm or corporation
aving a contract for water service at a particular location, if the location has a sani�,
ary sewer connection with the City's system, or in case there is no water contract on f'le,
hen the person, firm or corporation which is charged with water bmlls for the location;

SECTION 2. Sewage Service Charges; There is hereby fixed and established charge
or the use of the sanitary system, said charges to be based upon the amount of water used

(A) All users shall be classed aseither domestic or commercial,depending upon whethe
Tr not the water consumption of the individual user is used for domestic or commercial
urposes, For"the purpose of definition, all users other than residences shall be classed
's commercial.
(B) Where a user has hoth residential and commercial users on the same meter, the
sage shall be classed as commercial usage for the purpose of computing bills.
(C) In the case of domestic users,"the monthly sewage service incurred for any mont
hall be based upon the average water usage -for the previous months of November,December,
anuary, February, March and April. Said charges shall be computed for a twelve-monthst
period beginning with the billing for the month of June, said uniform rate shall be charg
for'the following twelve months''period, at the end of which time new rates shall be com-
uted,Where reaidential users have established a monthly sewage service rate as set out

Sewage service rates for -new residential users shall be based upon monthly water
sage until such times as their rates have been established by the usage of water for the

(D) In the case of commercial users, the monthly sewage service charge shall be -
etermined by applying the rate schedule to each monthly water bill throughout the year.
(E) Where a user of the Sanitary Sewage System utilizes water other than residen-
tial use so that such water does not enter the Sanitary Sewage System, rates as herein fi
ed shall be charged only on sewage entering the system.
(F) In the case of users of the Sanitary Sewage System where water is obtained frc
sourcesxother than -the City Water Department,The City will determine the amount of water'

SECTION 3. Non- 'Resident Users: All users of the City's Sanitary Sewage System
connections without the corporate limits of Fayetteville, shall be charged one anc

,o furnish sanitary sewer service to any persons whomsoever.
SECTION 4. Billing and Payment: Billings for the monthly sewage service charge shs

SECTION 5. Users having private water service: Where a user of the Sanitary Sewage
System does not use City water, but depends wholly or in part.bn wells or other private i
dater supplies, the City shall determine the amount of water used for the purpose of com-
�uting'the sewage service charge;'or such user may install a meter acceptable to the City
and readings thereof shall govern.
Bho'se users, who"are not users of City water, who fail to pay the sewage service
harge within ten (10) days from the date the charge becomes due shall be charged one
ollar($1.00) additional to the regmlar bill.
SECTION 6; Water Deposits. All deposits made by users of City water as required
ly the City ordinances to guarantee payment of water bills may be also applied'to pay de-
linquent or defaulting sewage service charges of the user who made the deposit.
SECTION 7. Repeal. All ordinances of the City of Fayetteville, or parts thereof,
n conflict herewith are hereby repealed.
SECTION 80 Severability Clause: If any section, part thereof; or any provisions c
this Ordinance shall be held voids ineffective, or unconstitutional by a court of compe-
ent jurisdiction, such -holding as'to any section, part or provision, shall be in no way
he validity of the remaining parts of this Ordinance, but the same shall remain in full
Force and effect.
SECTION 9. Emergency: Whereas, it being immediately necessary for the preservat:
f the peace, health and safety of the City of Fayetteville and the Inhabitants thereof;
khat the provisions of this Ordinance be put into full force and effect, an emergency is
hereby declared to exist, by reason whereof this Ordinance shall take effect and be in
dill force from and after its passage, as provided by law.

SND INSPECTION OF PLUMBING AND DRAINAGE, ADOPTED JULY 26,1951, AND_KNOWN AS THE ARKANSAS

1. The Ordinance was read in its entirety by the City Engineer, Alderman Kent made a

given an extra day's pay since they would have to work, this motion was seconded by Alde

AN ORDINANCE ADOPTING BY REFERENCE THE ARKANSAS STATE PLUMBING CODE RELATING TO T
�ONSTRUCTION,INSTALL.ATION AND INSPECTION OF PLUMBING AND DRAINING.
WHEREAS, the City Council of the City of Fayetteville, Arkansas, cauded a notice
o be published that it had under consideration the adoption of an ordinance relating to
he construction, installation and inspection of plumbing and drainage as set forth in.the
Arkansas"State Plumbing Code adopted by the Arkansas State Board of Health on the 26th day, of
,July, 19512 pursuant to Arkansas Act 200 of 1951, and
WHEREAS, the requisite number of copies of said code were kept on file as provied
by Act 267 of the Acts of Arkansas for the year 1949, and there have been no protests or
uggestions or requests for discussions,and
WHEREAS, the City Council of the City of Fayetteville, Arkansas, finds that it is
to -the best-intersests of the City of Fayetteville that the above code of the Arkansas State
Board of Health gevernir_g the construction, installation and inspection of plumbing and drain -

age be substantially adopted except for those Amendments hereinafter set forth:
NOW,THEREFOREp be it ordained by the City Counciloof the City of Fayetteville,
Arkansas:
SECTION 1. That the rules and regulations of the State Board of Health governing

Sate Plumbing Code be, and the same is hereby adopted for the City of Fayetteville, Arkansas,
except as hereinafter provided:
SECTION 2. That Section 1.2.1 shall be added to the Arkansas State Plumbing Code
and adopts y e City of Fayetteville, as follows:
Sec.1.2.1 DEFINITIONS. Plumbing for the purposes of this ordinance is
h[rebv defined as follows:
.(A) All pipings fixtures, appliances and appurtenances in connection with the wate
apply and drainage system within a building and to a point from three to five feet outsi
' the building.
(B) The constructi(in and connection of any drain or waste pipe carrying domestic
'wage from a point within three to five feet outside of the "foundation walls of any buil
ig with the sewer service lateral or other disposal terminal, including private domestic
:wage treatment and disposal systems and the•.alteration of any such system, drain or
