Alderman Bohe introduced.an ordinance entitled " AN ORDINANCE TO REGULATE
ALES AT PUBLIC AUCTION OF JEWELRY, INATCHESICLOCKS 2AND SILVERWARE WITIiIN THE CITY OF
AYETTEVILLE; AND FOR OTHER PURPOSES.
The Ordinance was read in its Entirety by the Clerk, Alderman McGoodwin mad
motion that the rules be suspended and the Ordinance placed In its second reading, thi
notion was seconded by Alderman Williams and was passed unanimously by the Council.
The Clerk -then read the Ordinance the secorid,�time,.and after discussion,
lderman Williams made a motion that. the rules be fart -her suspended and the Ordinance
laced on its third and final reading, this motion was seconded by Alderman Kent and was
assed unanimously by the Council.
The Clerk then read the Ordinance the third and final time.

Alderman McGoodwin made a motion that the emergency clause be adoted, this

AN ORDINANCE TO BE ENTITLED: " AN ORDINANCE TO REGULATE SALES.AT PUBLIC AUCTION
JEWELRY, !'iATCHES3CLOCKS, AND SILVERtNARE WITHIN THE CITY OF FAYETTEVILLE; AND FOR OTTITER I. .. _._�S

BE IT ENACTED.BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION I. That hereafter any person, firm or'corporation selling or offering
for sale jewelry, watches, clooks,-arid sblve'rware at public auction withih the corporatre
limits of Fayetteville, Arkansas, shall be required to obtain a permit therefor before
conducting_ such sale.
SECTION 2. Application for said permit shall be made to the City Council of t
City -.of Fayetteville by such person; firm or corporation in person or by their legal rep
sentatives or agents at least ten days prior to the date such sale is to be held.
Said application shall be accompanied by a -fee of $2.50 to cover the cost of the investi
gation hereafter provided for and the issuance of a permit for such sale.
SECTION 3. Upon receipt of such application, the City Council itsel£,or throug
is duly authorized representatives, shall investigate the proposed auction, including t
inancila condition of the person, firm or corporation"proposing to conduct said auction
nd shall file a report thereof wd)th said City Council. Such report shall be open -for
nsp ect ion.
SECTION 4. The City Council.may, as a result of such investigation, issue or
.ecline to issue a permit to such person, firm or corporation to conduct such auction.
SECTION 5. If such permit is granted it shall clearly set forth the date of
such auction on the face thereof, and the application for such permit provided for in Se
tion 1 of this Ordinance shall likewise clearly set forth the date of the proposed sale
at auction.
SECTIONC6.It'is the intent of this Ordinance that the provisions hereof shall
apply t'o public or priV ate autions 'bonducted under the orders of anj court, or administr
or executors sales, or"sales at _locations commonly referred to as "sales barns" or "sale
pavilions". Such Ordinance, however,'is expressly designed to include jewelry stores or
places where jewelry, watches,clocks, and silverware is kept or stored for sale to the p
SECTION 7. The,, conducting of a public Auction in violation of this Ordinance
wi-phout a permit being granted is hereby declared to be a misdemeanor and'shall be punis
able upon conviction by -a fine of not less than $25.00 nor more than $100.00, or by impr
onment in the City Jail for not less than 16 days normore than 30 days, or by both such
fine and imprisonment;
SECTION B. 17111EEP.EAS it is ascertained that the sale of jewelry, watches, clot
and silverware at unlicensed and unsupervised -public auction is liable to be accompanied
I y gross abuse to the detriment of the general public, and
I'141H:REAS this Ordinance is necessary for the protection of the public peace,
health and safety of the Citizens of Fayetteville, Arkansas, an emergency is hereby decl
'and thetprovisions of this ordinance shall be in full force and effect from and after it

AN ORDINANCE VACATING THAT PORTION OF VIILLOVI AVENUE LYING BETWEEN BLOCKS ONE(I)
DID TWO (2) IN EVELYN HILLS, AN ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR
TIER PURPOSES.
,WHEREAS, a petition was duly filed with the City Council of the City of Fay-
tteville, Arkansas on the 26th day of June, 1950 asking the City Council to vacate and
bandon all that Dortion of Willow Street lying between Blocks One and Two in Evelyn Hill,
An Addition to the City of Fayetteville, Arkansas as designated on the -plat of said addi-
ion--now appearing of record- in Plat Boole, page 255 thereof in the office of the Recorder
f Washington County, Arkansas.
,WHEREAS, after due b.otice as required by law, the Council has at the time and
lace mentioned in the notice, heard all persons desiring to be heard on the quer tion an
as ascetained that the portion of the Street above se'scribed has heretofore been dedicat
to the public=use as a s� eet; has not,been actually used by the -public generally for a

Alderman McGoodwin made a motion that' contract for water main extension for

warded subject to the receipt'of monies by the City Treasurer from the Fayetteville
uburban Water District No. 1 . And that on receipt of said monies and the presentation
