Present: Mayor Powell M.Rhea, City Clerk J.1"I.McG01hee1 City Attorney Price Dickson, City Engineer W.C.Smith, Fire Chief Burl Skelton, and Aldermen; Richardson, Feathers, McGood Bohe, Williams, Kincaid, White and Kent. The application of Harry O.Jackson for a permit to erect a grocery store and Jackson filling station came up for a hearing, and a petition containing the names of 16 proper Bldg permt owners !bsid ng on Highway No.45 East or upon lands adjacent thereto, and in the neighb rejected of the land or site fo��,.the n nposed drive-in market and filling station included in th above aplication,yi�q�%'.W'91"'�Iat the permit be issued. After hearing all interested pa who desired to be heard on the subject, Alderman White made a motion that the building permit be denied, this motion was seconded by Alderman Bohe, which was passed unanimous by the Council. R. Goff The Plat of R.D.Goff^s Subdivision, which had been referred to the Planning Plat omission for recommedation, came up for discussion, and Mr.W.H,Pryor, chairman of the Manning Commission was preseent and stated that they were ready to recommend the accepts pf the Platif the wording of the EASEMENT for five feet for the utilities was clarified, lderman Feathers made a motion the Plat be accepted when the wording of the Easement was larified and that the City Engiheer and City Attorney be instructed to have the wording he easement clarified, this motion was seconded by Alderman Richardson and was passed nanimously by the Council. Y.C.Campbell appeared before the 7Coin2i and requested the Council to re - C pbell onsider their action at the adjourned meeting �vlult reference to his application for re - beer per- iewal of a beer permit, after discussion, Alderman White made a motion to re -consider th( mction ,this motion was seconded by Alderman Kincaid, and on Poll call by the Clerk, the ollowing vote'resulted;-Ayes: Feath'ers,Kinoaid,White and Kento Nuys: Richardson, MCGoodl ohe and"Xilliams, The Mayor then cast his +vote'in favor of reconsidering, and declared 1 otion passed, as there were 5 Ayes, and Nays. Alderman White made a motion that the the petition signed by 59 persons in the vicinity of J.C.Campbell^s store on Huntsville Street requesting the renewal of a Beer. License for J.C.Campbell (which petition was presented at the adjourned meeting of the ,ouncil June 26th) be approved and that the Mayor be instructed to write a letter to Deaa Qonley, Revenue Commissioner requesting him to -give the petition vAsr careful considerate( his motion was seconded by Alderman Kincaid, and on roll call by the Clerk,the followinj vote was recorded; -Ayes: Feathers,Williams, Kincaid, White and Kent. Nays: Richardson, 4cGood^sin and Bohe. and the Mayor declared the motion passed, as there were 5 Ayes, and Nays. Opening` The City Engineer brought up the question of openfng a -part of 4th Street and of part a 12 foot alley in Block 21 Ferguson) and reported that the title would have to be clea of 4th St p before the City could take any steps to open said street aned alley, Alderman Feather d 12 rade a motion that the FARM BUREAU COOPERATIVE be notified that if they would clarify th foot alley title to said Street and Alley that the City would proceed to open them up, this motion as seconded by Alderman Williams, and was passed unanimously by the Council. Alderman Bohe introduced an Ordinance, entitled "ADT ORDINANCE LEVYING THE ASSESSMENT OF BENEFITS IN STREET IMPROVMTENP DISTRICT N0. 56 OF THE CITY OF FAYETTEVILLE 'IASHINGTON COUNTY, ARKANSAS, PROVIDING FOR THE ANNUAL LEVY OF ASSESSMENTS AND TIE COLLEC ION THEREOF, AND FOR OTHER PURPOSES." The Ordinance was read in its entirety by the Clerk, Alderman Feathers made a motion th the rules be suspended, and the Ordinance placed on its second reading, this motion was seconded by Alderman Richardson, and was passed unanimously by the Council. The Clerk then read the Ordinance the secondtime, and after discussion, Alderman Feathers made a motion that the rules be further smspended and the Ordinance placed oni,: its third and final time, this motion was seconded by Alderman Kincaid, and was passed unanimously by the Council. The Clerk then read the Ordinance the third and final -time, The Mayor then put the question " Shall the'Ordmnance pass?", and on roll call by the Clerk, the following vote was recorded; Ayes:'Richardson, Feathers, McGoodwin, Bohe, Williams, Kincaid, White and Kent. Nays: None. And the Mayor declared the Ordinance passed, as there were 8 Ayes, and no nays. Alderman Richardson made a motion -that the emergency clause be adopted, this motion was seconded by Alderman McGoodwin, and on roll call by the Clerk, the follc ing vote was recorded; Ayes: Richardson, Feathers,l;cGoodwin, Bohe,�Williams, Kincaid, White and Kent. Nays:None, and the Mayor declared the emergency clause adopted. ORDINANCE N0.973. On and after July 15,1950'Lake Fayeteville shall be opened to the general pub- ic for boating and fishing in the manner as hereinafter provided. 2. All fishing in Lake Fayetteville shall be done either from the bank or shore r from boats and no wading or swimming -shall be permitted in said lake. Fishing and oating shall be permitted only during daylight hours. No night boating or night fishing s permissible and all persons except those necessary for the protection of propertv-yof he City of Fayetteville shall be off City Property during.the night time. 3. No picnickigg or other recreational activity shall be permitted on any part f Lake Fayetteville or -the lands surrounding the same belonging to the City of Fayette- ville until further arrangements have been provided for proper sanitation. 4. No person, firm or corporation shall launch any boat on Lake Fayetteville nor hall they fish in said lake or any property under the control of the City of Fayettevil sed in connection with Lake Fayetteville'antil and unless they have first procured a fishing permit -and in the event fishing is done from a boat, a boat launching permit als s hereinafter provided. 5. Fees shall be according to the following schedule: Boat permit per day $0.50 Fishing permit per day per person X0.50 provided, however, that no fishing permit shall be required of any person 16 years of a r under 6. All persons desiring to fish or launch a boat on Lake Fayetteville shall firs rocure a fishing permit and/or boating permit as -the cnge may be at the permit building ocated at the North end of the Dale All boats shall be launched in the*lake at or near he boat canal located on the North end of the upstream side of the dam. 7, in the event motors are used on boats, boats shall be operated in such a manner that they will nota endanger other -boats or the occupants thereof and shall not b operated iii such a manner as to create heavy wake or waves causing undue erosion of the bore line. Be No person shall commit any nuisance while -on Lake Fayetteville or any of the ands surrounding the lake belonging to the City of Fayetteville, Arkansas nor shall any refuse, trash, or other materials be thrown onto the Lake or left about the shore line r on the premises of the City of Fayetteville. 9. runts may be docked on the lake at'or near the vicinity of the boat canal but 11 he City ef-F-syetteville assumes no responsibility for the safety of said boats and unti the City is prepared to. -care for docked boats no charge will be made for docking,provide however, that if boats are docked or left--on-the lake they shall be securely anchored so as not to float free in the lake. Boats may be beached and left in the vicinity of th oat canal if the owner so desires and no charge will be made for beaching or leaving of said boats except that the City will not be responsible for any damage or theft for any oats or any materials left in any boats by the owners.
