P.inutes of the regular meeting of April 10th, were read and approved. "NC PARKING I Alderman Richardson presented a petition signed by a number of property owners Li4dell aFla residents asking that a " NO PARKING ZONE" be established on the West side of Lindell AvPI enue, extending one-half block north from Douglass to the end of the pavement, this �Lgion was seconded by Alderman Feathers and was passed unanimously by the Council. M.glson re igns The resignation of Martin Nelson as Commissioner' in Street Improvement District Mrc.PS.J N .47, was presented, Alderman Richardson made a motion that his resignation be accepted, Pecan and that Mrs.M.J.Peden be Appointed as Commissioner in Street Improvement District No. 47.' Ap.ointed T is motion was seconded by Alderman Feathers, which was passed unanimopsly by the Council. Alderman Kent reported that the bills had been approved, Alderman Williams made motion that the bills be allowed as approved, and on roll call by the Clerk, the following vote resulted; Ayes: Richardson, Feathers,-McGoodwin, Bohej,liilliams, Kincaid and Kent. Nays Alderman White voted"No"as to the approval of the bill for a postage machine for 624.66, o the ground that the proper proceedure had not been complied with in the purcgase of the achine',but that his vote was'"AYE" on all the other bills, and the Mayor declared the bills approved, as there were 7 Ayes, and 1 nay. Alderman Feathers made a motion that the City Engineer,.City Attorney and Build- ing C mmittee be instructed to prepare an ordinance which will modify the present one concering the construction of -tanks to contain gasoline, butane and propane, etc:, this otiorr was seconded by Alderman White, and was passed zjnanimously by the Cogmcil. Mar to Alderman Williams made a motion that the Mayor be instructed to write a letter write of appreciation"to members of -the Volunteer Fire Department thanking the men for their letter almost perfect, attendance at a school completed last Friday Night on rescue and safety of Appre, leasures, this motion was seconded by Alderman Kent and was passedjunanimously by the Council. Alderman Bohe introduced AN ORDINANCE REGULATUNG THE CONSTRUCTION OF SIDEWALKS, STREET CURBING AND / OR GUTTERING, TIS CUTTING OF SIDEWALItS FOR THE CONSTRUCTION OF DRIVES, -LHE CONSTRUCTION OF DRIVES; PROVIDING FOR PERMITS, THE FIXIN9 OF COMPENSATION FOR INSPECTIOP PROVIDING FOR ENFORCEITEN'f, AND IMPOSING PENALTIES; REPEALING ORDINANCES OR PARTS OF ORDIN N ES IN CONFLICT HERZ+VITH. The Ordinance was read in its entirety by the C1erk,Alderman Vlilliams made motion that the rules be suspended and the Ordinance placed on its second reading;,'this otion was seconded by Alderman Richardsmn and was passed unanimously by the Council. The Clerk then read the Ordinance the second time, after discussion, Alder an 'Nilliams made a motion that the rules be further suspended and the Ordinance placed o is third.and final Ueading, this motion was seconded by Alderman Richardson, and was pas nanimously by the Council. COPY OF ORDINANCE No. 968 AN ORDINANCE REGULATING THE CONSTRUCT IO OF SIDEWALKS, STREET CURBING 1!I•TD/OR/ TTERING, THE CUTTING OF SIDEWALKFOR THE CONSTRUCTION OF DRIVES, THE COITSTRUCTION OF IVES; PROVIDING FOR PERMITS, THE FIXING OF COMPENSATION FOR INSPECTION, PROVIDING FOR FORCEMENT, AND IMPOSING PENALTIES; REPEALING ORDINANCES OR PARTS OF ORDINANCES IN CON - ICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF''FAYETTEVILLE, ARKANSAS: Section 1. That hereafter no sidewalk, street curbing and /or guttering,and drive .hall be: constructed, or sidewalks or curbing cut for the purpose of replacing or the onstruction of drives unless the same shall be properly ordered by the City Council or ' ermithas been issued by the City Engineer of the City og Fayetteville. Section 2. A permit may be issued for the construction ofsidewalks,street curbin and /or utt—ge ng, drives,and the cutting of sidewalks -or curbing for their replacing or onstruction of drives, by the City Engineerafter a plan or clear description of -the wor o -be done is furnished and it is detef'mined by the City Engineer that the proposed work eats all the requirements and /Or specifications as herein stated. Any peimi.t issued hall expire three months from the'date of issue and may be renewed upon application, -0, rovided the work has been started. Section 3. Specifications. 312 (ORDINANCE N0. 968 CONTINUED) SECTION 3. SPECIFICATIONS (A).All sidewalks, street curbing and /or guttering, and drives shall be constructed on rades as established by the City Engineer. It shall be the responsibility of the owner o establish property lines by competent survey at his own expense. (B). Normally, sidewalks will begin one foot -from property or street lines and extend th roper width toward the center of the Street. Where streets are thirty feet or less in w he sidewalk will begin at the pr reerty or street line. (C). Minimum width of sidewalks,ift--the residetial zones of the City,shall be four feet. dinimum width: -of sidewalks in all other zones shall be five feet. A residential zone is 'defined for this ordinance as being any one side of a block in which fifty perccent or nore of the frontage on that side is occ:upled by single or two family residences. (D). All sidewalks, street curbing and /or guttering, and drives shall be constructed of a Portland cement concrete mixture. The base course shall be a mixture of sound, clean, .rushed stone or gravel, cleansharp and graded sand,and Portland Cement, in approximatel he proportion of one part of cement,two D A s of sand, and four parts of gravel or stone which will produce a concrete of a comprehe5dive strength of 3,000 pounds per square inc after a twenty-eight day set under standard laboratory methods. The surface or wearing course shall consist of one part of Portland Cement to two pa's of clean,sharp,graded sa _?}e City Engineer shall approve all materials and methods used. h, (E). Minimum thickness for sidewalks shall be a total of five inches, which thickhess shall include the wearing course. Minimum thickhess for drives shall be a total of six i ches "which thickness shall include the wearing surface. (F). Sidewalk surfaces shall slope one=fourth inch in each foot horizontally toward the center of the street. Surdaces of drives shall slope with a rise of two inches in the fi st foot from the flow line of the gutter and one inch or less in each foot thereafter towar' the property line. S (G). All sidewalks, curbing and/or guttering and drives shall be finished to a smooth, trowell finish, lined and edged into squares as directed by the City Engineer and then given a brush finish. Vertical surfaces of curbs or'steps shall be finisey d in a like ma ner. A smooth float finish may'Ibe used if conditions warrant. (H). Suitable approved expansion joints shall be provided at not greater intervals than Fifty feet in all sidewalks, curbing and /or•guttering and drives. An expansion joint shall be constructed in drives on a line parallel to the sidewalk and in line with the property 1 n edge of the sidewalk. (I). Widths of drives from curb to curb for single residential drives shall not be greater than fifteen feet and shall begin at least -two feet from the owners property line. Nlidths of jointly owened residential drives from curb to curb shall not exceed twenty -file a. feet. L Widths of business or commercial drives shall not exceed fifty feet from curb to curb and begin at least four feet each direction from the side property lines and block inter sections. One fifth or more of the frontage on each street must be constructed into sid- walks. No sectmonof sidewalk so constructed shall be less than ten .feet.in length measured parallel to the street. (J). Curbing and/or guttering'shall be cohstructed-in accordance with plans submitted approved by the Cii7Y Engineer. Curbing shall have a minimum height of six inches above flow line of the gutter. All guttering must have a total minimum thickness of six inc (K) All othervrequirements shall meet current accepted practices. Section 4. Providing that nothing contained in this ordinance shall apply to si walks, curbing an /or guttering, and drives constructed and paid for by any improvemen district if the plans and specifications for the said improvement district work are gen ally in accordance with the specifications contained in this ordinance. Section 5. Inspection. The City Engineer shall make all necessary inspections during an after he construction of all sidewalks, curbing and/Or guttering to insure work being done in accordance with the plans and specifications. In the event any or p of any work is not done in a satisfactory manner or not in conformity with the Ilans an specifications, the City Engineer shall notify the contractor and owner of his non-accp of the work. All such rejected work shall be removed and replaced within thirty days of this notification: Two days advance notification must be given the City Engineer for these inspections. Section 6. Permit and bnspection Fees. For each permit issued by the City Engine the app ican s a 1 pay a fee. -of one dollar to the City of Fayetteville. An inspection f of two cents per square foot for sidewalks, three cents per square foot of drive surface and five cents per lineal foot of cmrbing and/Or guttering shall be paid in advance at t time of issuance.of the permit to the City of Fayetteville, The inspection fee is in ad dition to the permit fee. Minimum inspection fee shall be Three ($3.00) Dollard, regard less of the quantity of work involved. All fees shall be paid at time permit is issued. Section 7. Any person, persons, party, firm or corporation violating any of t'' sections one to six of this ordinance shall be deemed guilty of a misdemeanor,and'upon conviction thereof, shall be punished by a fine of not less than Ten (p10.00)Dollars and not more than Fifty ($50.00 Dollars for each offense, and that each day of such violati shall constiatute a seperate offense. . Section Be ...........All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby 'repealed, and that this ordinance shall be in full force and effect from and after its passage and approval and publication. Alderman Bohe introduced "ADT ORDINANCE AUTHORIZING THE PURCHASE OF TINO CARS FOR POLICE DEPARTMENT OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURPOSES: 14 The -Ordinance was read in its entirety by the Clerk, after discussion, Alderman ite rade a motion that the Ordinance pass, seconded by Alderman Richards6n, and on roll 11 by the Clerk, the following vote resulted; Ayes: Richardson, Feathers, MCGondwin,Boh , lliams, Kincaid, White and Kent; Nays:None. COPY OF ORDINANCE N0. 969 AN ORDINANCE AUTHORIZING THE -PURCHASE OF TWO CARS FOR.THE POLICE DEPARTIMENT THE CITY OF FAYETTEVILLE, ARKANSAS, AMID FOR OTHER PURPOSES. 111-LREAS, the Police Department of the City of Fayetteville, Arkansas is in need f two Police cars by reason of the fact that present equipment is worn beyond repair andl he functions required of the Police Department cannot be maintained without the purctase f said cars. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE ,CITY OF FAYETTEVILLE, RIiANSAS : Section 1. There is hereby appropriated. out of the General Fund the sum of 40 THOUSAND FIVE HUNDRED NINETY FIVE ($2,595300) DOLARS for the purpose of purchasing wo cars. Section 2.
