OUNTY, ARKANSAS. ,PET IT ION Comes J.R,Bates, hereinafter known_ and designated as the 6ivner, and for his petiti erein, states: That he is the bwner.of certain real property, situated in said City,which s not -served by the present sewer system, and that he desires to construct, own, use and aintain"a sewer system, to -be connected with the sewer sI*stem of said city, for the bene f his said property. That he has prepared and.herewith submits the plans and specifications fop he laying of six(6) inch -sewer line and constructing manholes, which have been approved y the City Engineer of said City, which plans and specifications show the locatioh,and ail ther pertinent data and information concerning the proposed•construction. That'he proposes to permit other owners of real property which could be erved'by such proposed sewer system to"connect therewith upon the payment of the sum of 400.00 -to him for each connection so made. That he proposes to turn said system over to_the City of Fayetteville, rkansas;'at'any time he -has received the'originalcost plus,Six Percent (60) interest ess p200,00, prior to April lst, 1965, and if upon said date the said system has n6t been o turned over and delivered to the'said City, it automaticallly becomes a part of the ewer system of said City on said date. That it is necessary'to use the right of way of Bates Avenue and Cleve - and Street in said City for the purpose of laying and maintaining said system,and he here y requests that he be granted- permission to lay and maintain a private sewer system on nd-over the"right of'way of Bates' -Avenue and Cleveland Street in said City, and said pe�- ission to day and construct"said sewer be'continuous for a period of six months from thea ate of the granting thereof, --and that this period of ownership and the right to maintain aid sewer be continuous for a period of not exceeding fifteen years from April lst, 1950. T}zat the plans and specifications which are attached hereto and made a art of this petition require the laying'of approximately 615 lineal feet of sewer line nd the construction of 2 brick manholes, complete with frame and cover. All of which is respectfully submitted and the permission to construct maintain same is earnestly reqested forthwith to the end that same mag be promptly editiously constructed and put to use. ON 1 t i 30;0 I lderman Bohe introduced an Ordinance entitled " AN ORDINANCE AUTHORIZINff HE PURCHASE OF THREE TRUCKS FOR TIT STREET DEPARPMENT' OF TIE'CITY OF FAYETTEVILLE,I RKANSAS, ?SID FOR" OTHER PURPOSES". --' The Ordinance ivas read in its entirety"by the Clerk, Alderman l,"lilliams made, a otion that'the rules be suspended, and the Ordinance placed on its second reading, this otion was seconded by Alderman Richardson,which was passed unanimously, The Clerk then read the Ordinance the second time, and after discussion, Alderman ichardson made a'motion that the rules be further suspended and the Ordinance plac;eddon te'third ;snd-final readint, this motion was seconded by Alderman Kent, which was passed nanimously by the Council. The Clerk then 'read the Ordinance the -third and final time. i Tie Mayor then put the question "Shall the -Ordinance pass"4, and on roll call by the Cler he-follovuing vote "resulted•, Ayes; Richardson, Feathers, McGoodwin,'Bohe, 'Nilliams,) incsid and Kent. Nays:None. Absent and not voting :`Alderman White. And the Mayor .eclared the Ordinance passed , as there were 7 Ayes, and no Nays. Alderman-McGoodwin made a motion that the emergency clause be adopted, thi otion was seconded by Alderman Williams', and on roll call by the Clerk, the following ot'e resiilted'Ayes: Richardson, Feathers, McGoodwin, Bohe, Williams, Kincaid and Kent. ays':Ilone. AN ORDINANCE AUTHORIZING THE PURCHASE OF THREE TRUCKS FOR THE STREET DEPART - OF THE CI'T'Y OF FAYETTEVILLE, ARKANSAS, AND FOR (DTIR PURPOSES. MiEREAS, the Street Department of the Ciijy of Fayetteville, Arkansas is in d of three trucks by reason of the fact that present equipment is worn beyond repair the functions required of the Street Department cannot be maintained :without the chase of said trucks. NOW, THEREFORE, BE IT ORDAINED BY TITE CITY COUNCILTOF THE CITY OF FA`_ETTE Section 1. There is hereby appropriated out of the Street Fund the sum of ouraThousand One Hundred Sixty Four and 09 100 Dollars ($"4,16409 ) for the pur'p'ose o: purchasing three trucks. Section 2.'The\Board of Public Affairs is hereby directed to advertise for ids for said trucks as set forth in their recommendation and to proceed with the awardi; f a contract and the purchase\of said trucks as provided by Section 19-1022 et seq and o arrange for delivery of said\vehicles at the earliest possible time. Section 3. This Ordinance shall take effect and be in full force from and iter its passage.
