The -Mayor presented the Lease agreement to the Girl Scouts, covering a part of irl he Bradley tract of land', -after discussioh, Alderman Feathers made a motion that the LEASE cout e approved; this motion was seconded by Alderman Kincaid, and was passed unanimously.by ase he Council. COPY OF LEASE This -'agreement madb`and entered into this day of March, 19502 in Fay- tteville, Washington County, Arkansas ,,.by and between the CiTy of Fayetteville $Arkansas, municipal corporation by its duly authorized Mayor, Powell M.Rhea, hereinafter called essor, and the Fayetteville(Arkansas)) Girl Scouts by their duly authorized President. .Irs H.H.Brockway and Secretary, Mrs Tom Pearson, hereinafter called Lesse, VIITNESSETH: 1. That "Lessor., for the -'consideration of $1.00 and other good and valuable onsiderations,purposes and covenants as hereinafter set out, does hereby let*, lease andl emise unto the lessee, for'the term beginning the.13th day of March, 19.50,..aind;,end ng.6 he 13th day of March, 1975; the following land and property situated in Fayetteville, 'Jashington County, Arkansas, to -wit: A part of the NE1' of the SW of'Section.10 Township 16 North, Range 30 West, described as follows: Beginning at a point 660,feet East and 292 feet south of the Northwest corner'of said 40 acre tract, running thence south 133 feet; thence west 215 feet; thence north 133 feet; thence east 215 feet to the point of beginning. - To have and to Iiold"the same unto the said lessee for and during the term aforesaid, upon the terms and conditions hereinafter expressed. 2. It is matually agreed that unless Lesse,has startodrd or commenced with the improvements to be made on said property within three (3) years from the date of thi lease agreement then and in such event said lease shall be considered null and void and of no effect. 3. Leasee agrees not'-to'commit waste,.nor permit waste to be done to or up the aforesaid property and --premises and that said property will be maintained in as good condition as the property adjacent to and surrounding said leased property which is now controlled by Lessor.' 4. It is mutually agreed that Lessor may, at any time, elect to terminate saip lease by notice in writing to Lessee, and Lessor agrees to reimburse Lessee for all improvements made on said property prior to receipt of such notice. 5. It is mutually agreed that at the expiration of said lease,Lessee shall have the option to remove.any or all improvements 31M3 IiYdttIXX which must be completed within three (3) months -at end of which period all improvements become the sole and exc - sive property of Lessor. Letter of commendation s Alderman Williams made a motion that the Mayor be instructed to write a letter to Fire to the Fire Department commending them for their excellent performance at the District Depts meeting held at -Siloam Springs, February!Bth, by which the -y were enabled to retain the TROPHY for another year for the'local Fire Department, this motion was seconded by Alder - Kincaid and was^passed unanimously by the Council. Proposal of The Proposal of the Sportsmen's Club, Inc. to operate Boating and Fishing Sb rtmen's facilities on City Lake -cane up for discussion, and Alderman Feathers made a motion that C 1i ib further action on -the matter be held in abeyance till more information is 'available and that the City retain control of the Lake,'thi,s motion was seconded by Alderman 'White, and was passed unanimoysly by the Council. t Post Lake Alderman McGoodwin made a motion that the Mayor be authorized to "POST" the " "NO FISHING lake with "NO FISHING" signs to be in effect till iteis opened for fishing by action of the Council: This mot -on was seconded by Alderman Feathers and was passed unanimously by the Council. P,oposal Price Dickson, acting for the Sportsmen Club, asked permission to withdraw WL thdrawn their proposal for the present, Alderman White made a motion that the reqest be granted and the Proposal be returned, this motion was seconded by Alderman Richardson, and was passed unanimously by the Council Hyden McIlroy TLie Mayor reported Hayden McIlroy had submitted his resignation as a member resigns of the BOARD OF PUBLIC AFFAIRS, since -he was a first cousin of the Mayor, and the Mayor Jim Kayes stated that he wanted to' submit the -name - of - Jim Kayes to take the Place of Hayden McIlroy, a�poited Alderman McGoodwin made a motion' -that the resignation of Hayden McIlroy be accepted, and BD Pub Aff' d:hat the appointment of Jim Kayes as a member of the BOARD OF PUBLIC AFFAIRS be approved; this motion was seconded by Alderman Williams, and was passed unanimoysly by the Council. The Mayor presented a proposal from the Chamber of Commerce that the new lake' nLAKE rorth of town be given the name of " LAKE FAYETTEVILLE", Alderman White made a motion that he proposal of the Chamber of Coninerce be approved and the Lake given the official name of AYETTE" AKE FAYETTEVILLE", this motion was seconded by Alderman Williams, which received the unan000 ville" ,ous vote of the Council, Alderman White made a inotion that the Mayor be authorizedeto confer with the TD buy Board of Public Affairs:;and to place bids for the purchase of 3 new trucks and that the 3 trucks Mayor be authorized to sell the 4 ton garbage truck, this motion was seconded by Alderman ichards4n, and was passed unanimously by the Council. q St.Lights A reduction by the Southwestern Gas & Electric o,of rates charged for 'oAra- red ction ting street lights in the City was reported, which will allow the City to install 14 more corner lights or increase the power of thepresent white way without raismng the expense. Ins ec T�e Mayor presented a copy of the 1949 audit for the City, Water'Departmen d Sewer -Department prepared by Sinderson,Little & LaShell, Alderman McGoodwin made a 1949 Audit motion that the Audit'be accepted; this motion was seconded by Alderman Feathers and was, passed unanimously by the Council, City Attorney Price Dickson brought up the_question of a settlemeilt.;with H.E,Swift for his salary for the year 1949 as manager of the City Park and recomme'mded that the City pay him 25% of the grojs's receipts for the year less 25% of the amount the City could be liable for as Federal Tax on the swimming pool from the time'the City star --ed operating it till -it was closed, which amount would be put in escrow till a final settle! ent of the Federal tax is made, then if no further payment is necessary for Federal tax$ then the amount in escrow would be paid to Mr.Swift less 25% of the amount already paid.. y the City on a compromise settlement with the Government, AlderrnaniEeathers,,made a'i-iotio tlhdtrthe.
