City Engineer W.C.Smith, Asst ity Engineer John MaHaffey, Fire Chief Burl Skelton, and Aldermen; Richardson, Feathers, cGoodwin, Bohe, Williams, Kincaid, White and Kent'; The absence of City Clerk J.W.MCgehee as noted, and City Attorney -Price Dickson acted as City Clerk. Minutes of the regular meeting of January 16th were read and approved. derman Bohe imtroduced an Ordinance, entitled "AN ORDINANCE TO CLOSE^ AND VACATE FIVE ET ON EACH SIDE OF N, POLLARD STREET BETWEEN E.PROSPECT STAND E.CLEBURN ST.,RESERVING RIGHT-OF-WAY FOR SIDEWALK ON THE 47EST FIVE(5) FELT, AND FOR OTHER PURPOSES. The Ordinance was read in its entirety by the Clerk,Alderman Kent made a moti hat the rules be suspended and the Ordinance- placed on its second reading, this motion as seconded by Alderman Richardson and was passed unanimously by the Council. The Clerk then read the Ordinance the 'second time and after discussion Alderm eathers made -a motion that the rules be further suspended and the Ordinance placed on i hird and final reading, this motion was seconded by Alderman Richardson, and was passed nanimosly by the Council. Tfie Clerk then read the Ordinance the third and final time. he Mayor then put the question "Shall the Ordinance pass"?, 'and on roll call by the lerk, the following vote resulted; Ayes: Richardson, Feathers, Bohe, Williams, Kincaid, hite and Kent. Nays: McGoodwin. And the Mayor declared the Ordinance passed, as there ere 7 Ayes, and 1 Nay. RESERVING A RIGHT -OF -Clay FOR IDE7ALK ON TITE WEST FIVE (5) FEET, AND FOR OTIER PURPOSES. Whereas, a petition was duly filed with the City Council of the City of Fayette ille, Arkansas, on the 3rd day of January, 1950, asking the City Council to vacate and abandon all that portion of the street designated on the plat of A.L.Trent's Revised Plai f Citi Park Addition to -said City, now appearing of record in Plat Book at Page 125 in i office of the Recorder of Washington County, as North College Extension(re-named North Pc lard) comprising the East five feet of said street and the 4est five feet of said street beginning at East Prospect Avenue and ending at East Cleburn Street. Whereas, after due notices as required by law, the Council has, at the time and lace mentioned in the notice, heard all the persons desiring to br heard on the questiol and has ascertained that the portiori.,of .street as hereinbefore described has heretofore been dedicated to the public -use as a street herein described; that the portion sought to be vacated has not been actually used by the'public'generally for a period of ay leas' five years subsequeht to the filing og the plat; that all the owners of the property abutting upon the -portion of the street to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of said portion of street . Now, therefore, be it ordained by the City Council of the City of Fayetteville, Arkansas: Section 1. The City of Fayettevulle, Arkansas, hereby releases,vacates and abandons all its rights, -together with tie rights of the public generalllye in and to th portion of street designated as follows: A strip fbve (5) feet.wide off the East side and a strip five (5) feet wide off the Wrest side of Pollard Avenue(Originally platted as North College Extension) between East Prospect Avenue and East Cleburn Street (originally platted as Garland Ave.), so th Pollard Street between East Pro#ect and East Cleburn Streets shall be forty feet in wid instead of fifty feet as platted in Plat Book Page -125 in the Office of Circuit Clerk of Washington County, Arkansas,with a right-of-way reserved by the City of Fayetteville, Arkansas, for sidewalk on the West five (5) feet above described. Section 2. A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the deed records of th County, The absolute ownership of said abandoned portions of street shall vest as follo The Strip lying along the East side of said street shall vest in the owners of the real estate abutting on the East Side of said street, and the strip lying along the Wesb side of said street shall vest in the owners of the real estate abutting on the Wrest side of said street. " Approve AttestcUty Clerk City Engineer Carl Smith made a report as to. the improvements needed at the City Park, after discussion, Alderman Richardson made a motion that the matter be referred to the Board of Public Affairs and that the Council meet in adjourned session Jam ry 31st at 4:O�Clock•P.M. for the purpose of taking the proper action sl that bids may�4bmitted without further delay for the egizipmen needed, this mD(n was seconded by Alderman Kent, and was passed unanimously by the Council. Water Superintendant Carl Smith presenteed a set of RULES REGULATIONS GOVERNING SIZES, TYPES AND NUMBER OF METERS FOR CONSUMERS. Alderman Williams made a motion that the RULES AND REGULATIONS BE APPROVED, this motion was seconded by Aldermam Kincaid and was passed unanumously by the Council. (RULES REGULATIONS ON NEXT PAGE) hl 7 r� 00 RULES AND REGULATIONS GOVERNING SIZES, TYPES AND NUMBER OF METERS FOR CONSUMERS CITY WATER PLANT FAYETTEVILLE, ARKANSAS. Under the authority of Ordimance No. 953, dated 15 of August 1949, the following ules and `Regulations governing the sizes, types, and number of Meters for consumers shall be- ome effective upom approval of the City Council: 1. METER SIZES AND TYPES OF METERS. The minimum size meter shall be 5/8 inc Ir commercial and industrial establishments the ineter size -shall -be consistent with the it•icipated demand and in no case shall the manufacturers rated capacity of the meter be cceeded by the anticipated load. Ti n c: : a:oz1 The type and manufacturer of - meters installed shall be determined by the Water Superintendent, The type of meter shall be in keeping with the expected service., 2; NUMBER OF METERS. At least One meter shall be installed for each one family residence; each apartment ouse or group of apartment houses under one management and ownership; each tourist court; each business or commercial establishment or building; each hospital or school (these may be a group of buildings); each public building or groupment of public buildings; each recreational area; each farm home including service buildings but hot tennant houses; -and each church building or grpoup of church buildings. Additional meters.for the above'may be provided at -the request of the owner or his repr - sentative, upon payment of the required fees for installatioh. Combinations of a'residence or'an apartment/ house with "garage apartments", all located on the same parcel of land is defined as a group pf apartment houses, provided all are owned and operated by one management. A business or commercial establishment or building is defined as any building, lot, or area in which any person, persons, firm or corporation are en- gaged in a business of any type. In a case where an owner has a series of'adjacent store buildings, each such unit is defined as a business or comnercial:;.:building. Upper floors are considered a part of the building concerned'. Any existing conditions which do not comply with this rule may v as time and conditions permit, be corrected upon written notice to the owners concerned t7 by the Water Superintendent. The Mayor presented the request of the Chamber of Commerce to send represent tives to Little Rock in the interest of the Highway development in this area on Iiighways 1,45 and 16•, Alderman Richardson made a motion that the'Mayor, City Attorney and as many Aldermen' -Ids could go be authorized to attend the meeting, this motion was seconded by Ald an Kincaid, and was passed unanimously by the Council. AN ORDINANCE AUTHORIZING THE PURCHASE OF APPARATUS; EQUIPMENT AND MSATERIAL IPI ORDER TO MEET THE REQUIREMENTS OF THE STATE BOARD OF HEALTH FOR THE SWIMMING POOL AT THE CITY PARI; IN THE CITY OF, FAYETT'EVILLE, 1';ASHINGTON COUNTY, ARKANSAS, AND FOR OTHER URPOSES* WHEREAS, the swimming pool at the City Park Sin the City of Fayetteville, Arkansas does not meet the minimum requirements of the State Board of Health for public _ swimming pools, and WHEREAS, it is the desire of the City of Fayetteville, Arkansas to make such improvements as are necessary to meet the requirements of the State Board of Health, and WHEREAS, the Board of Public Affairs of the City of Fayetteville, Arkansas has recoommemdedc to the City Council of the City of Fayetteville, Arkansas the purchase o apparati;.s, equipment and supplies which, when installed, will meet the,requirements of the Board of Health of the State of Arkansas, and has -submitted an estimate of the cost of such materials, equipment and supplies in the total sum of 'x13,900.00.
