The City Engineer presented a plan and a request from the,,D.X Station at the corner
D.X.StatioYi College and Spring Streets to change their drive -way, after discussion, Alderman Feathers
• made a motion that the plan be approved, subject to the supervision of the City Engineer..

Alderman Williams made a motion that the rules and regulations be approved,
this motion was seconded by ALderman.White, and was passed unanimously by the Council.
RULES AND REGULATIONS
GOVERNING METHODS OF PA'l1NG:CTY WATER BILLS AND THE EXTENSION OF THE DISCOUNT PERIOD.
Under the authority of Ordinance No.953,, dated August 15,1949, the lI
ollowingrule's and regulations governing the methods of paying City water bills and the
extension of the discount period shall become effective upon approval by the City Council;.
1. METHODS OF PAYING WATER BILLS.Payment of City Water Bills may be accomplished
y the following methods only:
A.By�cash_or negotiable instruments acceptable by local banks,
endered in person or delivered .to the.City Water P ant.
Be By filing a signed statement with the City Wffter P ant and with the
bank in which the water customer. maintains a checking ac count,aathorizing the' City Water
iIlant to treat the,customerls water bill receipt as a per's'onal check and deposit the receipt
to the proper City Water *Plant Accbunt. 'The statement shall also authorize the Customer+s
lank to accept and treat the receipt as a personal check against his account.
2. EXTENSION OF THE DISCOUNT PERIOD. The discount period for the paijment of
Gity Water bills is extended thru the Fifteenth of the month as follows:
A. For all Federal and Sate Agencies.
Be For Water customers residing outside the Washington County limit
ho, due to the time element of.Postal Service, are unable to receive the water bill and
emit payment within the present Ten day discount period.
C. All other water customers must comply with the Ten day discount
eriod as prescribed by Ordinance No.943.

ROPERTY, IN THE VICINITY OF THE FAYETTEVILLE MUNICIPAL AIRPORT, BY CREATING AIRPORT
PF ROACH, TRANSITION, AND TURNING ZONES AND ESTABLISHING THE BOUNDARIES THEREOF;
ROVIDING CHANGES IN THE RESTRICTIONS AND BOUNDARIES OF SUCH ZONES; DEFINING CERTAIN TERM

motion that the rules be suspended and the Ordinance placed'on its second resding,this

The Clerk then read the Ordinance the second time, and after discussion,

laced on its third and final r@ading; this motion was seconded by Alderman Kincaid, and
as passed unanimously by the Council.

[ROWTH, AND OTHERWISE REGULATING THE USE OF PROPERTY, IN THE VICINITY OF THE FAYETTEVILLE
[T1TTTCTPAL AIRPORT, BY CREATING AIRPORT APPROACH, TRANSITION, AND TURNING ZONES AND ESTAB=
JSHING THE BOUNDARIES THEREOF; PROVIDING CHANGES IN THE RESTRICTIONS AND•BOUNDARIgs OF
fUCH ZONES; DEFINING, CERTAIN TERMS USED HEREIN; PROVIDING FOR ENFORCEMENT; AND IMPOSING

In.pursuance of the authority conferred by The Airport Zoning Enabling Act,
Let 116, Acts of Arkansas, 1941, and for the purpose -of promoting the public health,
afety,and general welfare, by preventing the creatiaon or establisbmerit of airport hazard

BE IT ORDAINED BY THE CITY COUNCIL OF.THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION ONE:. Short Title. This ordinahce`shall be known and may be cited as
he " Airport -Zoning Ordimance of ayetteville, Arkansas..
SECTION TWO : DEFINITIONS. Aq used in this,ordinance, unless the context
otherwise requires:
(1) "Airport" means Fayetteville Municipal Airport
(2) "Airport hazard" means any structure or tree or use of.land which obstr
the air space required for the flight of aircraft in landing or taking -off -at the airpo
or is otherwise hazardous to such landing or taking-off.of aircraft.
(3) "Non -conforming use" means any structure, tree, or use'o.f land which
does not conform. -to a regulation prescribed in this ordinance or amendment'.thereto,.asf,
the effective date of such regulation.
(4) "Persons" means any individual, firm, copartnership,conporation,compan
association, joint stock assooibi0h or body pblitic,and iheludes any trustee, receiver,
assignee, or other similar representative thereof.
(5)!! Structure" means any object constructed or installed by man, includ
but wiyhout limitation,•buildings, towers, smokestacks,,and overhead transmission line
(6) "Landing Strip" means the area of the Airport used for the landing,
take-off,or taxiing of aircraft.
(7) "Tree" means any object of natural growth.

SECTION THREE: Establishin A irport Hazard Area. For the purposes of this

Ordinance, an area of land and ater within a radius of 2, 6 ' of a point hereinafter
described and established is hereby declared to be the airport hazard area, and the
whole of such area is made subject hereto.
SECTION FOUR: Radius point of Fayetteville Municip al Airport Hazard Area*

>uth runway; is hereby established as the radius point of the Fayetteville Municipal

SECTION FIVE: Division of Air ort Hazard Areas in the Zones.

)nes, Transition Zones, and Turning Zones. Such zones are determined bg reference to surf
ace areas and by height and use limitations.
SECTION SIX: Designation of Landin, Strips. For the purpose of fixing
ad determining the locations an res r c ions o sur ace zones, certain landing areas or
^ips are hereby designated and declared upon the surface"area-of the airport, as follows:

SECTION SEVEN: SchematicDraw&1 Attached -Purpose Thereof.

elating to Fayetteville Municipal Airport. Its purpose and use is restricted to verifying
he meaning and explaining this ordinance omly as to the general plan and principals in -
,volved in determining the location and areas of the various zones; It is drawn only to an
approximate scale and upon an assumed level of surface elevations, and shall not goverm
in establishing an exact point or boundary line.
SECTION EIGHT: Approach Zone Surface Areas. There are hereby estab-
ljshed and declared to be approach zones a an Joining•eac�end of each landing stripe
tae surface areas of such approach zonesrform a trapezoidal pattern and as to the respect
ive landing strips are bounded as follows: NORTH -SOUTH LANDING STRIP. Each being 500, wide
at each end of the landing strip, and lying 2501 each si e o i s center line, then diver7-
ng to a width of 1636.361, lying 818.18' each side of the projected centerline of said
landing strip at a distance of 6,0001.
SECTION NINE: Transition Zone Surface Areas. There are hereby estab-
lished and declared to be Transition Zones o wo types determined as follows:
(1) Ttiat which lies adjacent to each side of each approach zone, the surface area
5oundaries of which form triangles.One surface boundary of such transition --zone of 1050
Feet long and lying along the extension of the end of -the landing strip. Tjae second -surface
boundary is the same 'as the longer boundary line of the approach zone. The third'surface
boundary is a straight line connecting the outer points and closing the triangle.
(2) T4at which lies adjacent to each side of the .landing strip, the surface area
boundaries of which form rectangles. One surface.boundary of such transition zone is the
longer boundary of the of the landing strip. Two Surface boundaries -are each 1.050 feet
long and lying along the extenskons of the ends of the landing strip. The fourth surface
boundary is a line parallelling the longer boundary of the landing strip and of equal
length to it.

SECTION TEN : Turning Zone Surface.Area. Therelis hereby established and declared
to be a turning zonesumer ace which shallbe alld consist of all of the area lying within
the airport hazard area not otherwise herein specificallly included in the landing strips
or another zone surface area.
SECTION ELEVEN; -Height Limitations.- Except as otherwise provided in this ordinan
nD structure or tree shall be erected,altered, allowed to grow, or maintained in any air -
p rt approach zone surface area, airport turning zone surface area, or airport transition

SECTION TWELVE: Approach Zone Surface Areas Hemght'Limitations

being represented by a sloping plane, the base of which coincides with the end of the
h nding strip and extends outward and -upward on a ratio of'40'feet horizontal to 1 foot
•v.artical and to a total -horizontal projected "distance of 6,000 feet from the end of the
landing strip and a total height of 150 feet above the elevation of the end of the landing

SECTION THIRTEEN. Transition Zone'SurfaceAreas Hei ht Limitations.
A height limitation within each ransi i.on zone is ere y es a is e w is w=ii provide
a clear space above the entire surface area-bf the transition zone, the height limitation
being represented by a sloping plane, the -base -of which coincides with one edge of the land-
iag strip and the longer side of the two-apprbach zohes-and extends'outward and upward on
a ratio of 7 feet horizontal to 1 foot vertical and to a total horizontal projected distance
of 1,050 feet'and a height of 150 feet above the elevation of the nearest point of the
1 ding strip.
SECTION FOURTEEN: Turning Zone Surface Areas

SECTION FIFTEEN: Use Restrictions. Notwithstanding any other provisions of
his ordinance, no use may be made of land within any aitport approach zone, transition
zone or turning zone in such a manner as to -create electrical interference with radio
communication between the Airport'and Aircraft, -make it difficult for flyers to distinguish
Between airport lights and others, result in glare in the'eyes of the flyers using the
irport, impair visibility in the vicinity'of the airport, or otherwise endanger the land-
ing, taking off or maneuvering of aircraft.
SECTION SIXTEEN: Non -conforming Use.% The regulations prescribed in Sections
11 to 15, inclusive, of this ordinance shall not be 'construed to require the removal,
Dowering or other change or alteration of any structure or tree not conforming to the
regulations as of the effective date hereof, or otherwise interfere with the continuance
'f any non -conforming use:_ Nothing herein -contained shall require any change in the con-
truction, alteration, or intended use of any structure the construction or alteration of
ihich was begun prior to the effective date of this ordinance, and is diligently prosecuted
d completed within two years thereof.
SECTION SEVENTEEN: Variances. Any person desiring to erect any structire or
nerease the height of any strut ure, or permit the growth of any°tree, or use his proper y

%ariance therefrom. Such variance shall tie allowed where a literal application or enfor e-
ent of the regulations would result in practical difficulty or unnecessary hardship and
he relief granted would not be contrary to'the public interest but do substantialjustice
and be in accordance with the spirit of this ordinance*
SECTION EIGHTEEN: Permit's:
(1) Future Uses. No Material-l.changeeshall be made in the use of land, and no
structure or tree shall be erected, altered; planted, or otherwise established, in and
above any airport appr°ach zone, transition zone or turning zone; as defined and limited
in Sections 8 to 14 inclusive, unless a permit therefor shall have been applied for and
granted. Each such application shall indicate the purpose for -which the permit is desired,
with sufficient particularity to permit it to be determined whether the resulting use,
structure. or tree would conform to the -regulations herein prescribed. If such determinai
tion is in the affirmative, the permit applied for shall be granted.
(2) Existing Uses: Before any"existing use, structure or tree may be replaced,
substantially a tered or repaired, rebuilt, allowed to grow higher, or replanted, in and
above any airport approach zone, transition zones or turning zone, as defined and limite
in Sections'8 to'14 inclusive, a permit must be secured authorizing such replaceipent,
change or repair. No such permit shall be granted that would allow the establishment or
creation of any airport hazard or permit a non -conforming use, structure, or tree to be
made or become higher, or become a Ey
eater hazard to air navigation, than it was on the
effective date of this ordinance or than it is when the application for a permit is made)
Except as indicated, all applications for a permit for replacement, change pr repair of
existing use, structure, or tree shall be granted
SECTION NINETEEN: Hazard Marking and Lighting. Any permit or variance
granted may. if such action is deeme a visa e o e fec ua e he purpose of this ordi_-..•'_„
nance and reasonable in the circumstances, be so conditioned as to require the owner of
structure, or tree in question to permit the City of Fayetteville, at its own expense,
to install, operate, and maintain thereon such markers and lights as may be necessary to
indicate to flyers the presence of an airport hazard.
SECTION TWENTY: Administrative A enc . The City Council of the City of
Fayetteville is hereby designate the administra ive agency charged with the duty of
administering and enforcing the regulations herein prescribed. Tre duties of the City
Council shall include that of hearing and deciding all permits under Section 18.
SECTION TWENTY ONE: Judicial -Review.- Any person aggrieved, or taxpayer
affected, by any deciskon of the City Council may appeal to the 6.4rcuit Court of Washing-
ton County as provmded"in Section 6 of the AIRPORT ZONING ENABLING ACT, ACT 116,
ACTS OF ARKANSAS, 1941.
SECTION TWENTY-TWO: .Penalties; Each violation of this ordinance or of any
egulation, order or ruling promulgated hereunder -shall be punishable by a fine of not
ore ,than •$100.00 or imprisonment`.for not' more than- thirty' d'a$s, or both such fine and
mprisonment, and each day a violation continues shall be a seperate offense.
SECTION TWENTY-THREE: SEVERABILITY. If any of the provisions of this ordinance
r the application thereof to any person.or.circumstances is held invalid; such invalidity
hall not affect other provisions or applications ,of the ordinance which' -can be given efflect
ithout the invalid provisions -or application, and to rthis end the provisions of this ori -
ance are declared to be severable.
SECTION TWENTY-FOUR: EMERGENCY CLAUSE. It is ascertained and declared.that!

occupants of land in its vicinity and for preventing destruction or impairment of the
