The Ordinance was read in its entirety by the Clerk, Aldermam Williams made on that the rules be suspended and the Ordinance placed on its second reading, this seconded by Aldermen McGoodwin, amd was passed unanimously by the Council* the Clerk then read the Ordinance the second time and after discussion, Alderman ncald made a motion that the rules be further suspended and the Ordinance placed on it ird and final reading, this motion was seconded by Alderman McGoodwin, and was passed .animously by the Council. BE IT ORDAINED By THE CITY CDUNCIL.OF.THE•�CITY OF FAY ETTEVILLEv ARKANSAS: Tat there is hereby created a City Planning Commission as provd)ded by Section 19-2811, Arkansas Statutes (1947) which shall consist of nine members,who shall serve without comp sation and at least two-thirds of whom shall not hold any other municipal office or appoil- ment, which commission shall have such powers as are now or may hereafter be granted to i' by statute. tk Section 2. (Copy of Resolution f©llows•on Page 269) ENT OF A tion i f 269 HEREAS, The City Council -of the City of Fayetteville,.Arkansas has heretofore authorized its Mayor and City -Clerk to execute a deed to the Fayetteville Industrial Foundation,Inc. of its interest in the property known as the garment factory building and lands for the ^ sum of Ten Thousand ('$10,000.00) Dollars, and WHEREAS, one of.the conditions of the conveyance was that no profit derived fro the operation of said garment factory building should ever be used for the benefit of any individual which condition was inserted therein because the Fayetteville Industrial Foundation, Inc. was not a non-profit corportion, and • WHEREAS, the Fayettevile (Arkansas) Chamber,of.Commerce, Inc., is a non-profi corporation and the Industrial Foundation, Inc. has agreed that said garment factory building and lands may be,conveyed by the City of Fayetteville to the Chamber of Commerce of the City of Fayetteville, Arkansas to the end that no restrictions will appear in the deed, and WHEREAS, it appears that the citizens committee which raised.the major porti If the funds for the building of the garment factory building was a committee promoted, created and authorized by.the Fayetteville (Arkansas) Chamber of Commerce, Inc. of the C of Fayetteville, Arkansas.and that said citizens committee, by reason of their inability to raise all of the funds.necessary to complete said building, conveyed the lands and building to Water Improvement District Nm. 1 of the City of Fayetteville, Arkansas 'and t. Board of Managers of the --City Water., -Plant of the City of Fayetteville, Arkansas, in con- sideration of the City WRter Plant paying the balance due for the cmnstruction of said building,which conveyance. was in, trust, however,and not an absolute grants and WHEREAS, subsequently the City Water Plant,of the City of Fayetteville, (rkansas acquired additional lands outright for use in connectio8:•with•said19arment factory building and that the Witter Plant of the City of Fayetteville now has a pricip.al I of°about Seven Thousand Two Hundred ($72200.00) Dollars invested in said garment fr.c factory building and lands used in connection therewith, and WHEREAS, Oberman and Company, the present tenants in said building are emanding additional extensive improvements which the City of Fayetteville is unable&o provide and it is the desire of the City of Fayetteville to dispose of its beneficial interest and whatever interest it may have in trust to•the end that the improvements demanded by Oberman and Company may be made and the Cityof Fayetteville_rreceive reimburs mentfor funds heretofore invested by its water plant. THEREFORE, be it resolved by the City Council of the City of Fayette - Ville, Arkansas: That the Mayor and City Clerk of the City of Fayetteville, Arkansas be and they are hereby authorized to convey to the Fayetteville (Arkansas) Chamber of Commerce, Inc. whatever interest it -may have in the garment factory building in the City of Fayetteville, Arkansas, together with the lands used in connection with said building whether acquired by conveyance from the trustees of the garment factory or by outright purchase, for the sum of Ten Thousand ($102000000) Dollars which shall be paid by the Fayetteville (Arkansas) Chamber of Commerce, Inc. when title to the lands% upon which the garment factory building is located and other lands used in connection therewith is quiet and confirmed by the Chancery Court of Washington County, Arkansas in the Fayetteville (Arkansas) Chamber of Commerce, Inc., providedefurther that should the Fayetteville ('Arkansas) Chamber of Commerce be unable to quiet and confirm title to said..lands in them or should the Fayetteville( Arkansas) Chamber of Commerce fail to consumate the proposed I xpansion program with Oberman and Company withih a reasonable time, then the Fayettevill (Arkansas) Chamber of Commerce, Inc., shall reconvey the interest herein -authorized to be conveyed, to the City of Fayetteville, Arkansas, a Municipal Corporation. BE IT ORDAINED -BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. Section 9 of ordinance No. 789 of the ordinances of the City of Fay. stteville, Arkansas is hereby amended to read as follows: The words " 'Residents of the City of Fayetteville, Arkansas" for the purpose :>f this ordinance mean any person whose residence is within the limits of the City of Fayetteville; also, any person, persons, firm, corporation or organization owning or us; a place of business, warehouse, office,factory, or location for business purposes within the limits of the City of Fayetteville, Arkansas. This ordinance shall not apply to tour: visitors or other non-residents of the City of Fayetteville, Arkansas.
